Genetic polymorphism at 15 tetrameric short tandem repeat loci in four aboriginal tribal populations of Bengal

POPULATIONS: This study reports the genetic polymorphism observed at 15 short tandem repeat loci D3S1358, TH01, D21S11, D18S51, D5S818, D13S317, D7S820, D16S539, CSF1PO, vWA, D8S1179, TPOX, D2S1338, D19S433, and FGA in four aboriginal populations of Bengal. The analysis was performed to decipher the suitability of CODIS as well as six other highly polymorphic and unlinked markers in Forensic Testing. Studied populations include four tribes: Karmali, Kora, Maheli, and Lodha.     

GHB free acid: I. Solution formation studies and spectroscopic characterization by 1HNMR and FT-IR

In forensic evidence, gamma-hydroxybutyric acid (GHB) has frequently been encountered in one of its salt forms (gamma-hydroxybutyrate), but has also been encountered in its free acid form (GHB). Owing to the physical properties, encounters of the free acid have been largely restricted to forensic exhibits comprising aqueous solutions, such as acidic beverages that have been "spiked" or formulated with GHB salts or gamma-butyrolactone (GBL). The analysis of GHB free acid presents particular difficulties including the potential for altering the original proportions of GHB free acid, GHB carboxylate, and GBL in the course of analysis, and discrimination between GHB free acid and carboxylate forms. In this work, the formation of GHB free acid in aqueous solutions (water and/or D2O) was studied as a function of solution pH. Proton nuclear magnetic resonance (1HNMR) and Fourier-transform infrared spectrometry (FT-IR) measurements were obtained on freshly prepared mixtures of NaGHB and HCl stock solutions representing a series of points along the GHB titration curve. Both 1HNMR and FT-IR were shown to track the changing proportions of GHB free acid and carboxylate forms as a function of pH, while simultaneously monitoring for the formation of the lactone (GBL). The results were consistent with acid-base conversion behavior for a carboxylic acid. 1HNMR was shown to provide an ideal means for analysis of aqueous-based GHB/GBL forensic exhibits based on simple dilution of the neat liquid exhibit, without altering the original proportions of GHB free acid, carboxylate, and GBL in the samples.

Pflichtteilsverkürzung durch Einbringung des Vermögens in eine Stiftung / Beginn der Zweijahresfrist nach § 785 Abs 3 ABGB

Auch Zuwendungen an Privatstiftungen k?nnen nach ganz herrschender Meinung Schenkungen iSd § 785 ABGB sein, selbst wenn die Zuwendung zugleich mit dem einmaligen Stiftungsakt erfolgt. Im Schutz vor einer Wertvernichtung durch Verm?gensverteilung liegt keine Rechtfertigung dafür, das – bei Schaffung des PSG unangetastet gebliebene – Pflichtteilsrecht mit Hilfe einer Stiftung "auszuhebeln". Unabh?ngig davon, welcher der in der Literatur vertretenen Meinungen zur Nichtausl?sung der Zwei-Jahres-Frist des § 785 Abs 3 Satz 2 ABGB im Einzelnen gefolgt würde, bewirkt der Umstand, dass in der Stiftungserkl?rung ein umfassender ?nderungsvorbehalt zugunsten des Stifters und ein Widerrufsvorbehalt des Stifters vorgesehen sind (wobei beide Vorbehalte auch für Stiftungszusatzurkunden gelten), dass dem Stifter noch so wesentliche Einflussm?glichkeiten auf das Stiftungsverm?gen verbleiben, dass das von § 785 ABGB geforderte Verm?gensopfer noch nicht als erbracht anzusehen ist. Auf eine Umgehungsabsicht kommt es nicht an.
