In Opinion 1/2010, the Article 29 Data Protection Working Party has provided additional guidance concerning the concepts of ‘controller’ and ‘processor’ contained in Directive 95/46/EC. This guidance aims to assist practitioners in their determination of whether an entity is acting as a controller or as a processor towards a particular data processing operation. Despite the fact that this opinion is informative, the existing framework still appears to leave room for a considerable amount of legal uncertainty. This uncertainty is attributable in part to the nature of the existing concepts, but also (and perhaps to a larger extent) to their apparent misalignment with current processing realities. In this paper, the author seeks to articulate why the existing concepts often remain difficult to apply in practice, in order to enable a constructive reflection on how these issues might be addressed in the future.  相似文献

用浸渍法测定了楝素、三氟氯氰菊酯、苦皮藤、高效氯氰菊酯、溴氰菊酯、哒嗪酮、螨净 7种药物对未吸血的微小牛蜱 (Boophilusmicroplus)幼蜱、若蜱、成蜱及其饱血雌蜱的半数致死浓度(LC50 )。结果显示 ,所用药物中半数致死浓度最低的 3种药物是楝素、三氟氯氰菊酯、苦皮藤。植物性杀虫剂楝素对未吸血微小牛蜱的幼蜱、若蜱、成蜱及饱血雌蜱的半数致死浓度分别为3.0 1~ 3.13、4 .37~ 4 .77、11.18~ 11.36、2 75 .5 0~ 2 76 .5 0mg/L ;植物性杀虫剂苦皮藤对未吸血微小牛蜱的幼蜱、若蜱、成蜱及饱血雌蜱的半数致死浓度分别为 4 .2 2~ 4 .4 2、10 .30~ 10 .5 0、82 .5 0~82 .70、6 35 .30~ 6 36 .70mg/L ;人工合成的除虫菊酯类的三氟氯氰菊酯对未吸血微小牛蜱的幼蜱、若蜱、成蜱及饱血雌蜱的半数致死浓度分别为 3.4 2~ 3.4 4、7.10~ 9.0 6、4 2 .30~ 4 2 .5 0、5 45 .5 0~5 46 .70mg/L。  相似文献

Article 14 of the European Convention on Human Rights, as applied by the UK judiciary under the Human Rights Act 1998, is in danger of becoming as 'parasitic' as it is often described. Judges have inappropriately narrowed the scope of the 'ambit' of other Convention articles, and thus limited the number of claims to which Article 14 can apply, by defining it according to considerations more properly weighed in a justification analysis incorporating proportionality. The emerging approach departs from Strasbourg jurisprudence, and fails to give full effect to the language and intent of Article 14. This trend need not continue. This article begins the process of fashioning a new conception of the ambit of Convention articles: one that could change the fortunes of Article 14 cases in the UK, but that flows naturally from the precedents of the European Court of Human Rights, and gives effect to the spirit of the HRA.  相似文献

Mandatory data breach notification laws have been a significant legislative reform in response to unauthorized disclosures of personal information by public and private sector organizations. These laws originated in the state-based legislatures of the United States during the last decade and have subsequently garnered worldwide legislative interest. We contend that there are conceptual and practical concerns regarding mandatory data breach notification laws which limit the scope of their applicability, particularly in relation to existing information privacy law regimes. We outline these concerns here, in the light of recent European Union and Australian legal developments in this area.  相似文献

我国《合同法》第114条约定违约金的性质得由当事人自由约定。对违约金的性质没有约定或者约定不明确的,当事人可以通过补充协议的方式来约定或者明确违约金的性质。不能达成补充协议,应当通过补充性解释来确定违约金的性质。以上方法依次用尽,仍不能确定约定违约金的性质的,应当认定约定违约金的性质是赔偿性为主、惩罚性为辅。《合同法》第114条第3款是赔偿性违约金,不是惩罚性违约金。《合同法》第114条第1款“约定因违约产生的损失赔偿额的计算方法”得出的损害赔偿额是赔偿性违约金。  相似文献

This paper aims to assess the proposed General Data Protection Regulation through the framework of default entitlements in personal data. The notion of default entitlements comes from economic analysis of law and provides new insights into the implications of the data protection reform. While, under the principle of informational self-determination the default entitlements should lie with the individual, the Commission is shown to assign a great deal of default rights to others, including the Information Industry. This article cautions against the possibility of reducing the European system of data protection rooted in the values of individual autonomy and informational self-determination to a mere set of administrative rules channelling the flow of personal data, yet without a clear direction.  相似文献

This article analyses the Article 50 TEU debate and the argument that for the UK Government to trigger the formal withdrawal process without explicit parliamentary authorisation would be unlawful, because it would inevitably result in the removal of rights enjoyed under EU law and the frustration of the purpose of the statutes giving those rights domestic effect. After a brief survey of Article 50, this article argues first of all that the power to trigger Article 50 remains within the prerogative, contesting Robert Craig's argument in this issue that it is now a statutory power. It then suggests a number of arguments as to why the frustration principle may be of only doubtful application in this case, and in doing so it re‐examines one of the key authorities prayed in aid of it ‐ the Fire Brigades Union case.  相似文献

我国《物权法》第101条关于按份共有人优先购买权制度的规定过于简约,存在诸多适用上的争议。作为制度分析的起点,应将按份共有人优先购买权的法律性质界定为形成权,从而以避免理论上的缺陷。从解释论的立场出发,可通过民法解释学的方法阐明《物权法》第101条前段的"转让"和"份额"的含义。在《物权法》第101条相关规定阙如的情形下,应通过比较法和规范意旨之分析,明确按份共有人优先购买权的行使、行使的效力和权利冲突等具体问题。  相似文献
