Adaptation of the Narcissistic Personality Inventory among a Portuguese sample of incarcerated juvenile offenders

The aim of the present study was to assess the psychometric properties of the Narcissistic Personality Inventory (NPI) and two of its short forms (NPI-16 and NPI-13) among a Portuguese sample of male incarcerated juvenile offenders (N?=?221). Of these, only the NPI-13 short version demonstrated a good fit in terms of its factor structure. The NPI-13 also showed promising psychometric properties in terms of its internal consistency, convergent validity, discriminant validity, and criterion-related validity. Statistically significant associations were found with age of crime onset, crime seriousness, conduct disorder symptoms, alcohol abuse, and cannabis use. These findings justify the use of the NPI-13, especially its Entitlement/Exploitativeness dimension, among incarcerated male youths.

Zu den bedeutendsten Neuerungen durch das Handelsrechts-?nderungsgesetz, BGBl I 2005/120, z?hlen die §§ 38 f UGB, nach denen der Erwerber eines Unternehmens vorbehaltlich abweichender Vereinbarung mit dem Ver?u?erer die bestehenden unternehmensbezogenen Rechtsverh?ltnisse übernimmt. Dadurch sollen vor allem Schuld- und Vertragsübernahmen im Zuge von Unternehmensübertragungen erleichtert werden. Im übrigen sind Reichweite und Wirkungsweise der Neuregelung unklar. Als Eckpunkte lassen sich die Behandlung der unternehmensbezogenen Rechtsverh?ltnisse des Ver?u?erers als Unternehmenszubeh?r und die Ersetzung der bürgerlich-rechtlichen Zustimmungsrechte Dritter durch nachtr?gliche Widerspruchsrechte identifizieren. Damit erleichtern die §§ 38 f UGB eine stichtagsbezogene Verfügung beim so genannten asset deal.     

腐败犯罪的法律控制与国际刑法的演进——以《联合国反腐败公约》为视角

《联合国反腐败公约》是国际社会控制腐败犯罪最重要的国际刑法公约。该公约在国际层面明确了腐败犯罪的定罪范围,扩大了腐败犯罪的主体,发展了国际刑法中犯罪构成理论,首创了腐败资产必须返回机制,突破了双重犯罪原则和政治犯罪不引渡原则,拓展了国际刑事合作领域。     

Effects of Governance Practices and Investment Strategies on State and Local Government Pension Fund Financial Performance

Abstract

Recent statistical studies concerning state and local government pension funds’ boards of trustees have focused on two complementary issues. First is the influence governance practices have on administration of fund assets. Second is the impact of investment strategy choices on funds’ total rates of return. Reported results indicate that the primary effects of governance practices on pension outcomes are indirect via asset allocation decisions. This study re-examined these issues using abnormal return as an inherently valued measure of risk adjusted financial performance. An innovation of the investigation is that “process analysis” was used to decompose the direct and indirect effects of governance practices on financial performance. Results suggest that while both types of effects exist, direct impacts dominate relative to mediating processes.     

“民族资产解冻类”诈骗犯罪防控研究

信息化时代带给人们诸多便利的同时,也使人民财产安全问题日益凸显。近年来,借助现代化通信工具实施的“民族资产解冻类”诈骗犯罪层出不穷,社会影响极其恶劣。通过对无讼网全国近8年(2011年-2018年)公开的“民族资产解冻类”诈骗犯罪121份案件判决书进行数据化分析发现,“民族资产解冻类”诈骗犯罪具有涉案金额大、涉案人员多、涉及地域广、组织化特征明显等特点。公安机关防治此种诈骗犯罪时,存在识别难、发现难、抓捕难、打击难的现实困境。为此,可从预防、打击、稳控三个层面入手,通过全方位宣传、加强预测预警、开展重点区域集中打击、做好重点人员回访工作等,提高公安机关应对这一社会治安难点问题的能力。     

Confirmatory Factor Analysis of the Maslach Burnout Inventory

Abstract

Although the Maslach Burnout Inventory (MBI) is widely used to assess burnout in human service workers, doubt has been cast on the usefulness of the conceptualization on which it is based and the independence of its subscales. A confirmatory factor analysis using the methodology employed in a previous study of child welfare workers revealed that the final model had only a minimally adequate fit and the constructs of emotional exhaustion and depersonalization were not separate and unique. The findings suggest that research in child welfare settings should avoid continued reliance on the MBI for the assessment of burnout. Scales that are balanced in terms of positive and negative items and where each dimension represents a distinct construct need to be developed.     

Underreporting of Bestiality Among Juvenile Sex Offenders: Polygraph Versus Self‐Report

Juvenile sex offenders (JSO) are a specific subset of delinquent adolescents that are receiving more attention because of the crimes they commit and the issues surrounding how to successfully treat their deviant behaviors. Given JSO are such predominant treatment concerns in society, it is essential to identify and target key risk factors. One sexual behavior, bestiality, may be of particular importance to address in treatment. In a meta‐analysis conducted by Seto and Lalumiere, a 14% rate of bestiality among JSO was reported. This current study examined the differences in JSO (n = 32) who admitted bestiality based upon a self‐report measure, the Multiphasic Sexual Inventory‐II (MSI‐II), compared to information elicited by polygraphs. The results indicated extensive underreporting of bestiality behaviors between these two sources of information (MSI‐II = 37.5%; polygraph = 81.25%). These findings are important given the reliance treatment programs place on information elicited from self‐report tools.     

论新《刑事诉讼法》中的判决前财产没收程序

2012年3月14日,十一届全国人民代表大会第五次会议审议通过了《关于修改〈中华人民共和国刑事诉讼法〉的决定》,在特别程序一章增设了犯罪嫌疑人、被告人逃匿、死亡案件违法所得的没收程序。但该程序在修改过程中和新法颁布后都引起了一些质疑,其中最大的疑问就是犯罪嫌疑人、被告人未经人民法院审判,其财产即被没收是否有违《刑法》和《刑事诉讼法》未经人民法院依法判决,对任何人不得确定有罪的基本原则。回应上述疑问的关键在于从法理层面厘清概念、归纳特点并界定性质,这样我们才能准确理解和适用该程序。
