B2C交易中的消费者权益保护问题

网络购物的飞速发展不但没有扭转传统购物中消费者的弱势地位,而且它使经营者和消费者之间的地位更加悬殊,致使网络交易中侵犯消费者权益的行为屡屡发生。消费者权益在互联网环境下如何进行保护,是人们面临的一个新课题,本文主要分析了网络环境下消费者权益保护面临的问题并提出解决对策。     

Personal identification by the comparison of facial profiles: testing the reliability of a high-resolution 3D-2D comparison model

Identification from video surveillance systems is frequently requested in forensic practice. The "3D-2D" comparison has proven to be reliable in assessing identification but still requires standardization; this study concerns the validation of the 3D-2D profile comparison. The 3D models of the faces of five individuals were compared with photographs from the same subjects as well as from another 45 individuals. The difference in area and distance between maxima (glabella, tip of nose, fore point of upper and lower lips, pogonion) and minima points (selion, subnasale, stomion, suprapogonion) were measured. The highest difference in area between the 3D model and the 2D image was between 43 and 133 mm(2) in the five matches, always greater than 157 mm(2) in mismatches; the mean distance between the points was greater than 1.96 mm in mismatches, <1.9 mm in five matches (p < 0.05). These results indicate that this difference in areas may point toward a manner of distinguishing "correct" from "incorrect" matches.     

超临界CO2萃取三七脂溶性成分的工艺研究

目的:研究超临界CO2萃取三七脂溶性成分的萃取工艺。方法:在单因素实验的基础上,采用均匀设计方法考察萃取压力、萃取温度、分离压力、分离温度对萃取收率的影响。结果:较佳萃取工艺条件为:萃取压力30 MPa,萃取温度48℃,分离釜Ⅰ压力8 MPa、分离温度30℃,分离釜Ⅱ压力5 MPa、分离温度30℃,萃取时间2.0 h,CO2流量35 L/h,三七颗粒度60目。结论:用超临界CO2萃取三七,可以较好的获得其脂溶性成分,提取物可以供进一步深入研究。     

Abweisung des Grundbuchsgesuchs wegen Ungereimtheiten in den vorgelegten Urkunden und Zweifeln an der ausdrücklichen Erklärung des Verkäufers

Das geh?ufte Auftreten von Ungereimtheiten (hier: Nichtübereinstimmung der Geburtsdaten des Verk?ufers in den vorgelegten Urkunden und unzutreffende Gesamtfl?che) in Kombination mit dem Inhalt einer Spezialvollmacht, der den Machthabern in ungew?hnlicher Weise v?llig freie Hand bei der Ver?u?erung der Liegenschaft einr?umt und keinerlei Schranken zur Wahrung der Interessen des Verk?ufers vorsieht, verlangt nach einem strengen Ma?stab bei der Prüfung nach § 94 GBG. Rechtfertigen die M?ngel der vorgelegten Urkunden bei einer im Rahmen der vorzunehmenden Ermessensausübung geforderten Gesamtschau schwerwiegende Bedenken im dargestellten Sinn und bleiben daher Zweifel an der ausdrücklichen Erkl?rung desjenigen, dessen (hier: des Verk?ufers) Recht beschr?nkt belastet oder aufgehoben werden soll, dass er in die Einverleibung einwillige, muss dies zur Abweisung des Grundbuchsgesuchs führen.     

Article 53(b) EPC: A Challenge to the Novartis Theory of European Patent History

The authoritative ( Novartis/transgenic plant systems ) interpretation of the Article 53(b) EPC exclusion from European patentability of plant and animal varieties, and essentially biological processes for the creation of plants and animals, is considered, and its significance for the trend of EPO jurisprudence and legitimacy of the EC Biotechnology Patenting Directive noted. The Enlarged Board of Appeal's justification for that interpretation in Novartis with reference to the exclusion's legislative history is challenged, and an alternative theory of that history proposed, based on a thorough analysis of the unpublished travaux préparatoires for the Strasbourg and European Patent Conventions. In addition to elucidating the framers' (actual and presumed) intent with respect to the Article 53(b) exclusion, that analysis offers an insight into post-war legal unification methodology and its continued impact on one of the most contentious and technical areas of intellectual property law.     

Entspricht das durch Baumaßnahmen erzielbare bessere Raumklima des WE-Objekts schon allein dem nach § 16 Abs 2 Z 2 WEG 2002 geforderten wichtigen Interesse des änderungswilligen Wohnungseigentümers?

Nach stRsp kommt es bei der Beurteilung des wichtigen Interesses des ?nderungswilligen Wohnungseigentümers nach § 16 Abs 2 Z 2 WEG 2002 (früher: § 13 Abs 2 Z 2 WEG 1975) immer auf die Umst?nde des Einzelfalls an, die in ihrer Gesamtheit zu beurteilen sind. Dabei ist dem Rechtsanwender ein gewisser Ermessensspielraum einger?umt. Eine erhebliche Rechtsfrage nach § 528 Abs 1 ZPO liegt nur dann vor, wenn der Ermessensspielraum so grob fehlbeurteilt worden ist, dass die Rechtssicherheit dadurch in Frage gestellt wird. Das im vorliegenden Fall durch beabsichtigte bauliche ?nderungen verbesserte Raumklima des WE-Objekts oder dessen damit erh?hte Wohnqualit?t allein erfüllt noch nicht das von § 16 Abs 2 Z 2 geforderte wichtige Interesse des Wohnungseigentümers.     

C2C环境下的中国税收法律问题探究

中国现行的税收征管法律制度随着新中国的成立和改革开放的发展逐步形成,但是面对C2C这种新兴的网络购物模式,中国现行税法便显得无所适从,本文将层层剥开C2C环境下中国税收法律制度中存在的诸多问题并加以解决以完善C2C环境下的中国税收法律制度。     

短串联重复位点ACTBP2(SE33)的扩增片段长度多态性研究

应用变性聚丙烯酸胺凝胶电泳（dn－PAGE）结合银染色技术对短串联重复（STR）位点ACTBP2（SE33）的扩增片段长度多态性（Amp－FLPs）进行了研究。在210名无关中国个体中观察到了25个等位基因，等位基因频率分布在0．007～0．093之间。基因型的分布符合Hardy－Weinberg定律，个体识别能力（DP）值为0．99，杂合度（H）为98．7％。七个家系分析的结果表明，该位点的遗传符合孟德尔遗传法则，未观察到变异。对几种常见的法医物证检材的分析表明，该分型系统对DNA降解放为严重的检村适用性强，而且灵敏度高（0．5ng），适合于法医学实际应用。     

猪2型圆环病毒核酸疫苗的研制及其对小白鼠的免疫效果

为研制猪2型圆环病毒(PCV2)新型核酸疫苗,以pcDNA3为载体,与PCV2的ORF2及其高变区V1、V2、V3、V1-V2连接,分别成功构建了真核表达质粒pcDNA3-ORF2、pcDNA3-V1、pcDNA3-V2、pcDNA3-V3和pcDNA3-V1-V2。对阳性真核表达质粒大量生产并纯化后,以每只小白鼠0.2 mg免疫5周龄左右的雌性小白鼠,然后用ELISA检测免疫小白鼠血清中抗体的产生情况。结果显示,这5种真核表达质粒均能刺激小白鼠产生特异性抗体,但相比之下,真核表达质粒pcDNA3-V1-V2诱导小白鼠产生的抗体水平更高,维持的时间更久。表明质粒pcDNA3-V1-V2的免疫效果较好,有望成为防制猪2型圆环病毒的候选疫苗。
