论《海牙选择法院协议公约》的适用范围

《海牙选择法院协议公约》是2005年海牙国际私法会议通过的第一个关于管辖权和判决承认与执行的国际公约。公约仅适用于当事人签订有排他性选择法院协议的国际性民事或商事案件,同时也附加有多种例外情况。研究公约的适用规则可以为我国加入和适用公约提供参考。     

特朗普政府对朝核问题的危机管理及前景研判

2017年的朝核危机实质上是特朗普政府实施边缘政策而带来的一场危机,即,通过极限施压迫使朝鲜在战争和让步之间做出选择,以推动半岛无核化进程。然而,特朗普政府对朝核问题的危机管理因朝鲜的外交对冲、美国国内政治因素的制约以及国际合作的缺失使双方谈判陷入僵局,美国国内甚至出现是否会默认朝鲜有核的争论。若要真正推动朝鲜半岛无核化取得实质性进展,特朗普政府的现实方案仍是设定有限目标,并由联合国安理会制定可逆条款,约束美朝不信守承诺的行为,以国际社会的担保减少美朝互信缺失带来的消极影响,加快推进半岛无核化的和平进程。     

一个综合视角下的国际制度化动力分析

制度化动力是国际制度分析的重要问题之一。制度化动力往往包含理性选择和社会建构两重因素,二者之间存在密切的互动关系。在高级制度化形式下,制度化动力以理性计算为起点吸收社会性因素,转化为战略性社会建构动力并有机结合于国家间社会化进程之中,将制度化从工具性制度化推向建构性制度化,对国家产生根本性影响。     

Why Place Really Matters: A Qualitative Approach to Housing Preferences and Neighborhood Effects

The idea that a person’s neighborhood or zip code can predict his or her life outcomes has motivated a host of housing policies aimed at redressing racial segregation and breaking up areas of concentrated poverty. This article critically examines underlying assumptions about high-poverty neighborhoods that motivate those policies. Using ethnographic methods, I present the location preferences of residents living in a low-income neighborhood in Columbus, Ohio, and show the ways in which their perceptions of their neighborhood run counter to common portrayals. This analysis provides clues as to why the underlying logic of dispersal and mobility may be flawed. I conclude that place matters very much to people living in this neighborhood, just not in the way commonly implied by dispersal and mobility policy advocates. The implication is that stability, rather than mobility, ought to be the focus of more housing discussions.

论中国海事侵权的法律适用

传统上,中国海事侵权案件的法律选择依照《中华人民共和国民法通则》第146条和《中华人民共和国海商法》第273条及第275条的规定。在《中华人民共和国涉外民事关系法律适用法》颁布后,海事侵权案件（包括船舶碰撞）的法律选择完全可以依照该法第44条的规定,但在适用侵权行为地法规则时须做些调整,对于发生于船舶内部的侵权行为和仅涉及两艘同国籍船舶的海事侵权案件须视船舶为侵权行为地而适用船旗国法律,对于发生于公海的无船旗国法律可适用的海事侵权案件则适用法院地法律。《中华人民共和国海商法》关于海事赔偿责任限制法律适用的规定也可并入《中华人民共和国涉外民事关系法律适用法》。

朝鲜半岛对中国国家安全的特殊性和重要性是不言而喻的。对此,人们惯以"唇亡齿寒""唇齿相依"等词来形容这一特殊的地缘关系。历史证明,朝鲜半岛局势的任何变化,均会对中国国家安全产生直接或是间接的重要影响。朝鲜半岛的地缘形势变化,关涉多重中国核心利益的维护、实现和扩展。对中国而言,在"大周边"战略的基本框架之下,加快制定和实施具有前瞻性、全局性和可持续性的朝鲜半岛战略,与朝鲜半岛国家开展更加灵活、务实和全面的合作关系,对中国在21世纪上半叶更好地保持周边环境的整体和平稳定,进一步把握战略机遇期,努力实现国家跨越式发展的战略目标,具有十分重大的现实意义。     

论涉外婚姻关系的法律适用——兼评《涉外民事关系法律适用法》的相关规定

2010年10月28日通过的《涉外民事关系法律适用法》,于2011年4月1日起开始施行。在该法颁布实施之前,我国涉外婚姻家庭案件适用的法律主要是我国《民法通则》第八章:涉外民事关系的法律适用。该法实施之后,我国涉外婚姻家庭案件将以该法为基本的依据。因此,该法的实施,对我国涉外婚姻家庭案件的处理具有重大理论和实践意义。     

Extending the rational choice model from the economy to society

That the extension of the rational choice model beyond the economy to all society can finally lead to integration of social theory is often claimed by the model’s advocates. The underlying assumption is that this model is valid for both the economy and society, in the form of an economic approach to, or a utilitarian paradigm of, all social behaviour. The meta-theoretical presupposition or injunction that agents are (should be) profit-seekers or utility-optimizers is therewith given the mission to integrate and ‘save’ contemporary social science. However, such extensions of the rational choice model from the economy to society neglect the fact that this presupposition has been partly mitigated and compromised within economics itself. If so, then suspicion is strong that the rational choice model would be even less appropriate for the other social sciences and thus fall short of achieving its self-designated role of integration of social theory. The conclusion of an interdisciplinary analysis drawing both from economics and sociology is that rational choice is far from being an integrative model of the economy and society.
