Developing urban space: the changing role of NGOs in Bangladesh

Rapid urbanisation has been an emerging issue in recent decades, particularly for developing countries such as Bangladesh. As one of world’s largest international NGOs, BRAC, based in Bangladesh, is transiting towards a more integrated approach for alleviating urban poverty. This article presents BRAC’s current journey for eradicating urban poverty and outlines the characteristics of urban poverty, key issues faced by the urban poor, and learning that BRAC has accumulated through its urban interventions. Introducing the concept of “coproduction”, the article identifies BRAC’s priorities to eradicate urban poverty within the context of an overall urban strategy.     

Meeting development goals: evidence from the Civil Society Education Fund

In recent years, the Civil Society Education Fund has supported national education civil society coalitions (NECs) in low-income countries so that they put pressure on governments and donors to implement the Education for All agenda and the Millennium Development Goal on education. This article draws on literature on global governance as well as on an extensive evaluation of the CSEF to explore the actual contribution of this initiative to the activity of NECs. The article highlights the achievements and shortcomings of the CSEF and includes a set of practical recommendations on the role of global civil society in international development processes.     

The state of public discourse in Kenya’s post-Moi era: Where are Kenya’s organic intellectuals?

One of the defining moments in Kenya’s political landscape was the defeat of KANU, the party that had been in power since the country’s independence in 1963, by the National Rainbow Coalition, NARC in 2002. The victory was hailed as a new dawn that would entrench good governance, equity, rule of law, and human rights. After all, the victory was a culmination of many years of agitation against KANU dictatorship. Furthermore, NARC was a mass movement with national appeal and led by renowned anti-establishment politicians, civil society, and activist intellectuals and clergy. But, these aspirations would be betrayed by fragmentation of elites in NARC and re-invention of corruption by the same elites. This paper investigates the ramifications of the NARC collapse to the country’s post-Moi democratization process, more so the diminished role of intellectuals in public discourse. The paper demonstrates the urgent need for organic intellectuals and the way forward.     

论民事法律行为的构成要件及其理论意义

民事法律行为制度作为民法学领域的一项重要制度,其构成要件理论引起了人们的广泛争鸣。鉴于长期存在的理论混淆,文章从一般构成要件与特别构成要件角度出发加以分析,进而探讨明确界定民事法律行为构成要件的重大理论意义。这一界定有利于完善法律行为要件论,有利于理顺构成要件与生效要件的逻辑关系,有利于为举证责任提供理论依据。     

提高公务员依法行政能力刍议

提高依法行政能力是公务员队伍建设的重要课题,直接关系到整个国家依法治国能否有效进行。目前公务员依法行政能力与形势的要求相比,还存在着一定的差距,这在相当程度上影响着我国依法行政水平的提高。为了实现法治政府建设的目标,必须通过加强对公务员的培训,建立和完善对公务员评价考核制度,实行行政执法责任制,使公务员真正树立行政法治观念,不断提高依法行政能力。     

类推适用的私法价值与司法运用

凡制定法皆可能存在法律漏洞,类推适用是在法律对系争事件或说个案存在法律漏洞时的一种漏洞补充方法。类推适用的私法价值既是法律正义价值的体现,也是法律存在漏洞并且必须补充和法官不得拒绝审判原则的必然要求;基于中国的法律文化传统,我国民法典应该确认类推适用的地位并确定具体的规则。     

外国公务员惩戒制度与借鉴

外国公务员惩戒制度的主要内容包括惩戒的条件、惩戒的形式、惩戒机关、惩戒程序和不服惩戒的救济 ;比较一致的特点有 :惩戒条件的概括性、惩戒形式的多样性、惩戒机构的双轨制和惩戒程序的严格性 ;对中国而言 ,值得借鉴的经验有 :公务员惩戒制度应高度规范化 ;责、权、罚相适应的规则体系是合法惩戒的根本 ;宽严适中、层次分明的惩戒条件和形式是合理惩戒的重要条件 ;完备严格的程序是惩戒发生预期作用的保障。     

Farmers,peanuts, and aflatoxins in Uganda: A gendered approach

This article describes a collaborative research for development project that used participatory methods to engage smallholder farmers in Uganda in post-harvest aflatoxin management. It is based primarily on qualitative research with peanut growers tracing ‘the path of the peanut’ through their hand-drawn maps and journal writing. By focusing on everyday life and including recipes and drawings, this research encouraged women's participation and emphasised women's roles. A unique partnership among universities, women's organisations, and farmers created an environment of mutual learning and produced a book documenting food preparation and other post-harvest practices as part of a study and capacity-building effort on peanuts and aflatoxins.     

美国金融危机对东亚新兴经济体的贸易传染渠道分析

美国金融危机到底以何种方式在全球传播,以至于演变成全球经济海啸,一直是近几年学术界所关注的问题之一。本文以美国金融危机对外传播的贸易传染渠道为切人点,分析了美国金融危机通过贸易伙伴型传染和贸易竞争对手型传染这两个贸易传染子渠道对东亚新兴经济体的溢出程度。对面板数据进行的GLS实证结果显示,美国金融危机通过贸易传染渠道的溢出,与大部分东亚新兴经济体经济波动之间存在10％以上显著性水平的相关性,因而贸易传染渠道是美国金融危机对东亚溢出的一个重要机制。     

New Challenges Posed by Robots to China’s Civil Code in the Age of Artificial Intelligence

In the age of artificial intelligence (AI), robots have profoundly impacted our life and work, and have challenged our civil legal system. In the course of AI development, robots need to be designed to protect our personal privacy, data privacy, intellectual property rights, and tort liability identification and determination. In addition, China needs an updated Civil Code in line with the growth of AI. All measures should aim to address AI challenges and also to provide the needed institutional space for the development of AI and other emerging technologies.
