精神病司法鉴定若干法律问题研究

精神病鉴定因涉及精神病医学、心理学、法学以及社会学等诸多领域的专门知识而呈现出复杂性。与其他医学学科相比,精神病医学的发展相对缓慢,在一定程度上制约了精神病鉴定制度的发展,甚至影响了鉴定程序启动的正常展开。精神病鉴定制度的不完善及其程序启动的失当又导致实践中出现精神病鉴定的乱象。从司法鉴定实践中可以发现,精神病鉴定本身的可靠程度以及刑事责任能力的评定与鉴定启动、鉴定结果选择等具有内在的互动性。尽管精神病鉴定制度无力解决精神病医学不发达的根本性问题,但科学的精神病鉴定制度对精神病鉴定技术、鉴定能力与鉴定质量的提高有较大的助益。     

May Mediators Draft Settlement Agreements?

This article surveys the current law in various states as well as the Model Rules of Professional Conduct regarding whether a mediator‐lawyer may draft a settlement agreement at the conclusion of a mediation. It includes a look at the traditional boundaries between a lawyer and a mediator and concludes with a recommendation on how California should approach whether a mediator‐lawyer should be allowed to draft a settlement agreement for parties at the conclusion of a mediation.     

论指挥员在作战行动中的战争法意识

现代战争法或日武装冲突法是规范交战国及其武装部队之间的关系和作战行动的原则和规则的总称.战争法能否得到遵守和执行,关键取决于双方军队的军人,尤其是各级指挥员.如何根据军事行动的具体任务,在战争法基本原则的框架内,将作战指挥与战争法要求结合起来,是我军适用战争法的前提,为此,各级指挥员必须了解战争法,强化依法指挥的意识.     

Understanding Parental Gatekeeping in Families with a Special Needs Child

Supporting the positive development of a special needs child is especially challenging when parents have separated or divorced. Invariably, there is an increased need for collaborative co‐parenting wherein information is shared and intervention plans can be implemented effectively. In this article, the evolving literature on parental gatekeeping is applied to families with special needs children, as it offers a useful model for understanding the strengths and liabilities of co‐parenting relationships. We describe some of the typical and unique gatekeeping dynamics that occur when children suffer from developmental, physical, and/or psychiatric syndromes that require specific treatment and specialized parenting skills. Examples of both restrictive and facilitative gatekeeping are described as they manifest in these families. Implications for decision making are also discussed.     

犯罪现场中非犯罪行为研究

犯罪现场中非犯罪行为一直是侦查领域研究的一个热点问题。加强犯罪现场中非犯罪行为的研究,有利于提高侦查人员对犯罪现场的全面认识,开辟认识犯罪现场的新视野以及开拓新的侦查思路。为此,有必要对犯罪现场中非犯罪行为的概念、价值,犯罪现场中非犯罪行为信息在侦查破案综合运用中存在的问题及对策进行探讨与研究。

追踪与研判:《南海行为准则》制定问题的研究动向

本文梳理了近年来国内外学者关于《南海行为准则》制定问题的最新研究成果,试图在一定程度上展现学界对准则问题的基本认知,以期为相关部门和国内学界开展进一步的对策研究提供有益借鉴。在行为准则制定工作久拖不决的情况下,部分学者倡议的先行尝试制定岛屿规则、专属经济区行为规则等"准则单行本"或绕开《联合国海洋法公约》而另行创制《南中国海海洋法公约》等新观点尤其值得国内重视和研究。     

网络环境中不端行为的成因及治理对策

近年来，互联网正以惊人的速度在全球扩张。而利用网络传播非法信息，威胁国家政治稳定和社会安定的情况日益突出，通过网络从事色情、赌博及盗窃、诈骗等违法犯罪行为日益猖獗，网络黑客入侵、计算机病毒扩散等情况日渐严重。公安机关应加强网络监管，切实把握网上斗争的主动权，强化网络侦察，严厉打击各类涉网违法犯罪行为，着力加强对网络舆论介入式控制，引导网络健康发展。     

论资助危害国家安全犯罪活动罪

资助危害国家安全犯罪活动罪是1997年刑法典增设的罪名。其中的“资助”包括不符合共同犯罪成立条件的资助行为。对资助的时间不应加以限制；资助的对象应扩展为“境内外组织、机构或个人”；其“着手”应当是资助人“欲”向被资助人交付金钱、场所或者物资之时。     

Diagnostic Bias and Conduct Disorder: Improving Culturally Sensitive Diagnosis

Disproportionately high rates of Conduct Disorder are diagnosed in African American and Latino youth of color. Diagnostic bias contributes to overdiagnosis of Conduct Disorder in these adolescents of color. Following a diagnosis of Conduct Disorder, adolescents of color face poorer outcomes than their White counterparts. These negative outcomes occur within mental health and juvenile justice settings. The aims of this article are to: (a) identify the factors that contribute to overdiagnosis of Conduct Disorder in adolescents of color, (b) discuss the associated negative outcomes, and (c) provide recommendations for culturally sensitive diagnosis of adolescents of color with conduct problems in order to reduce overdiagnosis. Clinical and research implications will also be presented.
