海峡两岸合作勘探开发东沙海域油气资源探析

在海洋油气勘探与开发方面,海峡两岸的合作前景十分广阔。东沙海域作为潜在的油气资源富集区,区位优势明显。两岸可在东沙海域全面推进油气资源的合作勘探与开发,为今后在其他海域合作积累经验,共同维护南海油气资源开发权利和南海主权。     

论联合商标的作用与规范机制的构建

联合商标作为一种防御商标,在许多国家得到认可与应用。设计联合商标制度的初衷是为了更好地保护正商标。我国的《商标法》虽然没有“联合商标”的概念,但在商标转让等实务中,依然可见其踪影。联合商标在有效保护商标权人权利的同时,存在着损害相关公众利益的可能性,而目前《商标法》及相关立法处于空白状态。国内外专家学者对此也鲜有论述。从维护相关利益的角度出发,规范联合商标权利人的权利、行使方式,具有重要的现实意义。     

试论政府服务与政府执法的关系

政府的性质和政府与公民的关系决定了服务是政府的天职,法律的本质决定了执法是政府服务的基本方式。服务与执法目标和本质一致,二者相互依存、互为条件、相辅相成。服务与执法统一的基础是公民本位或人民本位的行政价值观。     

Objective evaluation of similarity scores derived by Evofinder® system for marks on bullets fired from Chinese Norinco QSZ-92 pistols

In recent years, many studies have been conducted in the field of firearm identification with the objective of providing an objective method of evaluating the comparison of cartridge cases. However, less attention has been paid to the objective evaluation of bullet comparisons. In this study, 1 000 registered Chinese Norinco QSZ-92 pistols were used, and a database of 2 996 bullets was constructed. Both the receiver operating characteristic (ROC) curve and the score-based likelihood ratio method were used to objectively evaluate the similarity scores derived by the Evofinder^® system. The results indicate that this system has excellent ability to discriminate between the selected pistols. This paper proposes an objective evaluation method, which serves as a response to the ongoing debates regarding the foundation of the discipline.     

广西中越跨境经济合作区的前景、问题和对策

广西与越南山水相连,在边境地区建设跨境经济合作区不仅可以加强中越两国的经贸合作、造福两国人民,而且对中国—东盟自由贸易区建设具有积极的促进作用。但跨境经济合作区是一个全新的国际经济合作模式,本文深入分析了广西＂中越跨境经济合作区＂的前景、存在的问题,并提出加快建设的对策和建议。     

我国八大经济区利用外资的经济效果分析

将我国划分为八大经济区是对原有东中西部区域划分的细分,这一划分更多地考虑到区域GDP总量、经济发展水平等方面的相似性,更具有合理性.本文在分析了八大经济区实际利用国外直接投资(FDI)的水平和特点的基础上,计算了八大经济区在1993-1998年和1999-2004年两个阶段中FDI与GDP、外商投资企业进出口、进出口商品总值的关联度,探讨了关联度变化的原因及趋势,并由此对各经济区今后引资提出了相关的政策建议.     

我国破产程序域外效力的实例分析——评香港高等法院对“广信”破产程序的承认

破产域外效力的最终实现必须依赖于外国法院的承认与执行。近来香港特别行政区高等法院作出的一个判决承认了广信破产程序在香港的效力。本案是我国法院开始的破产程序第一次正式得到境外法院的承认 ,对于管辖权、程序的透明度等问题无疑具有一定的指导作用     

Measuring the frequency occurrence of handwritten numeral characteristics—An expanded list

In the third of a series of studies and reports, the authors expand on the frequency occurrence proportions of various handwritten features. The first study culminated in the publication of “Measuring the Frequency Occurrence of Handwriting and Handprinting Characteristics.” That study was followed by “Measuring the Frequency Occurrence of Handwritten Numeral Characteristics.” The premise of this current and future follow‐up studies is to expand on the initial lists of information incrementally by expanding the number of features and the number of writers. This study expands on the list of numeral features. A total of 34 numeral features was selected by the authors as candidates for this study and tested through an attribute agreement analysis. Based on the results of the testing, 17 new features have been added to the list of proportions. The original 1410 handwritten numeral specimen forms were utilized and pared to 1024 to obtain a proper population sampling for the United States. Interdependency testing was conducted on 783 pairs of inter‐character numerals. A coefficient of correlation between ?0.2 and +0.2 was found in 534 (68.20%) of these pairs. As of this report, there are now a total of 42 numerals with measured frequencies of occurrence. This material has already borne fruit as the combined frequency of occurrence studies were explained during an unsuccessful exclusion hearing in court with an explanation as to how these studies support the reliability of forensic document examination.     

让步关系句的使用与英语写作成绩间的相关性研究

在语言教学领域，句法结构对语篇学习的作用一直是研究的薄弱环节。通过实证方法能具体验证某句法结构与语篇学习间的相关性。以让步关系句为例，通过比较学生在两次测试中的让步结构使用情况和作文成绩，可以得知两者间确实存在正相关关系，即让步结构作用值越高，作文均分就越高。但让步结构的使用在促进学生提高写作水平方面的作用是有限的。     

从市民社会视角看“红十字会危机”的解决之道

我国红十字会长期的官办官化,缺乏应有的社会性是导致红十字会出现信任危机的根本原因。借鉴香港红十字会的经验,运用市民社会理论,得出红十字会危机的根本解决之道在于实现国家与社会关系良性发展,国家对社会的干预要有一定的界限,同时,红十字会要去官办性,回归其民间性。
