The transition from 2D imaging to 3D scanning in the discipline of firearms and toolmark analysis is likely to provide examiners an unprecedented view of microscopic surface topography. The digital examination of measured 3D surface topographies has been referred to as virtual microscopy (VM). The approach offers several potential advantages over traditional comparison microscopy. Like any new analytic method, VM must be validated prior to its use in a crime laboratory. This paper describes one of the first validation studies of virtual microscopy. Fifty‐six participants at fifteen laboratories used virtual microscopic tools to complete two proficiency‐style tests for cartridge case identification. All participating trained examiners correctly reported 100% of the identifications (known matches) while reporting no false positives. The VM tools also allowed examiners to annotate compared surfaces. These annotations provide insight into the types of marked utilized in comparative analysis. Overall, the results of the study demonstrate that trained examiners can successfully use virtual microscopy to conduct firearms toolmark examination and support the use of the technology in the crime laboratory.  相似文献

混合斑组成复杂,长期以来是法医物证研究的难题之一。混合斑主要分为两类:一是性侵害案件中大量女性阴道上皮细胞混合少量精子;二是普通来源的生物检材之间的混合,如血-血、唾液-血液混合等。近些年来,对混合斑的研究日渐深入,技术层面或理论分析都更加客观和多元化。针对第一类混合斑,出现了荧光/磁性激活、显微操纵、声波差异分离法等分离精子的新技术;第二类混合斑是研究的难点,近年来大规模平行测序、液滴微流控技术、乳液PCR(e PCR)、全基因组扩增等技术的出现,提高了次要成分的检出机率。此外,遗传标记也有相应的发展,传统遗传标记常染色体STR、Y-STR、SNP等检测位点越来越丰富,新兴遗传标记DIP、DIP-STR、SNPSTR、mt DNA-SNP、微单倍型等在混合斑研究中发挥的作用初步显露出来。文章最后涉及混合斑分析理论和计算软件的最新发展。  相似文献

混合斑是性侵案件中常见生物检材,对其分析结果的解释是法医学检验中的难点之一。混合斑的种类较多,多个个体或多种体液、分泌液形成混合斑的提取、分离方法比较复杂。目前,法医学用于对混合斑量化评估主要应用杂合型均衡比和混合比例两个参数,而其分析受多种因素的影响。分析常用的遗传标记包括:常染色体和Y染色体STR,SNP,mt DNA,INDEls等。统计分析方法主要有似然率法(LR)以及随机男子不能被排除率法(RMNE)。混合斑分析软件的出现,有助于对检验结果的分析和判断。本文对相关文献进行综述,意在为混合斑的研究和鉴定提供参考和借鉴。  相似文献

Abstract

Participants in today's financial markets confront a sea of data. While the availability of market data has benefits it also creates problems, notably those relating to questions of meaning, judgement and intervention: how to make sense of these flows – how to see the ‘market’, its futures, and thus act pre-emptively. Over more recent years financial organizations have been turning to new technologies of representation, in particular the design and application of visualization software in an effort to enable better visual imagination of and interaction with markets as they unfold in real time. ‘What you see is what you risk’ in many respects captures the thinking or at least the desire underlying the employment of the latest visualization software. The more powerful one's vision the better able one is to participate in increasingly complex financial markets, at least in theory.

Based on recent interviews with those involved in developing and using the latest visualization software within some of the key markets of global finance, and developing the influential work of Daniel Beunza and David Stark, and Karin Knorr Cetina, in particular, this paper adopts a cultural-economy-of-finance perspective to examine the implications of these new techniques of representation. The paper argues that the latest visual turn within finance should be afforded a more central position in the study of contemporary financial market practices.  相似文献

Forensic science laboratories perform analyses on a variety of materials using gas chromatography/mass spectrometry (GC/MS). Instruments from different vendors may be used, requiring analysts to be proficient in the use of multiple proprietary software packages for collecting and processing data. There is no standardized GC/MS software available that can acquire data from different vendors' instruments. However, there are third‐party processing software products that can import data files in different formats. The Centre of Forensic Sciences compared the data processing performance of one such product, ACD/MS Manager Suite, with three instrument vendors' software used for casework analysis. This product was tested for its compatibility with the existing software, its capability to load and present data, and to initiate searches of commercial libraries. The study shows that the MS Manager module provides a means for the forensic analyst to view, process, and report on data from different sources in one software package.  相似文献

Although the framework for protection of computer programs has been established in the European Union more than two decades ago, it has not undergone any major changes. Opinions of Advocate General Yves Bot have convinced the Court to advance the concept of the plurality of copyright regimes applicable to software: source code, object code and documentation would be protected under the Software Directive, whereas interfaces, programming languages, data formats and software manuals are dealt with as literary works under the InfoSoc Directive. In SAS Institute v WPL, the Court also ruled that copyright in a computer program cannot be infringed where the lawful acquirer of the license neither decompiled the object code nor copied the source code of the computer program, but merely studied, observed and tested that program in order to reproduce its functionality in a second program. This ruling paves the way and acknowledges the reverse engineering efforts on the Old Continent.  相似文献

交通事故再现是确定交通事故责任和事故成因的方法之一。在利用事故再现仿真软件进行交通事故再现过程中,应以交通事故现场痕迹的客观事实为依据。结合一起汽车与两轮车碰撞的交通事故案例,通过交通事故现场痕迹检验,分析交通事故形态,确定相关仿真再现参数。利用PC-crash软件,建立汽车、两轮车和人体模型,进行事故重建,并利用路面痕迹、车体痕迹、人体痕迹等对再现结果进行了验证。在鉴定中将事故过程再现与现场痕迹鉴定结合起来,提高了交通事故鉴定的客观性和科学性。  相似文献

This paper contributes to research seeking to understand if and how legislation can effectively counter cybercrimes that compromise personal data. These ‘data crimes’, which are the ‘dark side’ of big data and the data economy enabled by cloud computing, display cascading effects, in that they empower disparate criminals to commit further crimes and victimise a broad range of individuals or data subjects. The paper addresses the under-researched area of sentencing, which, as the last step of the judicial process, plays a crucial role in how the law is interpreted and implemented.This paper investigates courts’ approach to the evolving technological environment of cybercrime captured by data crime and the cascade effect and whether the cascade effect can assist courts in dealing with data-driven cybercrime. The paper examines original data collected from UK courts, namely 17 sentencing remarks relating to cybercrime court cases decided in England & Wales between 2012 and 2019. The analysis shows that courts appreciate the impact of data crime and their cascading effects, but that the complexity of the offences is lost at sentencing, arguably due to the negative impact of systemic factors, such as technology neutral law and the lack of legal authorities.After examining such systemic factors, the paper suggests how the cascade effect could aid sentencing by adding specificity and context to data crime. The paper ends with avenues for further research relating to debates on fair cybercrime sentencing and open justice.  相似文献
