The shared concern expressed in the two quotes below is that modern technologies provide criminals with a capability to evade investigation. This comment piece examines some of the policy and legal options available to governments and law enforcement agencies to try to address this concern. While accepting the claim that this phenomenon represents a real challenge to law enforcement agencies, we currently have insufficient evidence to show the true extent of the problem. What this piece does not accept is the implication contained in the quotes, and often made explicit by others, that the use of encryption represents a fundamental and irreversible shift in the balance of power between criminals and their investigators from what previously prevailed. Such claims tend to lack historical perspective, which is one of the themes of this 200th issue of Computer Law and Security Review. 相似文献

Access by law enforcement authorities to personal data initially collected by private parties for commercial or operational purposes is very common, as shown by the transparency reports of new technology companies on law enforcement requests. From a data protection perspective, the scenario of law enforcement access is not necessarily well taken into account. The adoption of the new data protection framework offers the opportunity to assess whether the new ‘police’ Directive, which regulates the processing of personal data for law enforcement purposes, offers sufficient safeguards to individuals. To make this assessment, provisions contained in Directive 2016/680 are tested against the standards established by the ECJ in Digital Rights Ireland and Tele2 Sverige on the retention of data and their further access and use by police authorities. The analysis reveals that Directive 2016/680 does not contain the safeguards identified in the case law. The paper further assesses the role and efficiency of the principle of purpose limitation as a safeguard against repurposing in a law enforcement context. Last, solutions to overcome the shortcomings of Directive 2016/680 are examined in conclusion. 相似文献

Footwear impressions are one of the most common forms of evidence to be found at a crime scene, and can potentially offer the investigator a wealth of intelligence. Our aim is to highlight a new and improved technique for the recovery of footwear impressions, using three-dimensional structured light scanning. Results from this preliminary study demonstrate that this new approach is non-destructive, safe to use and is fast, reliable and accurate. Further, since this is a digital method, there is also the option of digital comparison between items of footwear and footwear impressions, and an increased ability to share recovered footwear impressions between forensic staff thus speeding up the investigation. 相似文献

This article investigates brand architecture by analyzing stakeholder perceptions of brand images when a new joint brand is created for the existing brands of three arts organizations. The theoretical framework is based on previous literature on brand architecture and brand image. The empirical study is based on a quantitative, 418-respondent survey among stakeholders of these three arts organizations. The study makes two major theoretical contributions. First, the results show that the new joint brand can be endorsed by the existing sub-brands, contrary to brand-architecture literature. Advertorials are a form of outside lobbying that organized interests use to influence policymakers and attentive publics. It is apparent from their popularity that organized interests consider them to be an effective form of political communication. This article analyzes 2,805 organized interest advertorials that appeared on the lower right quadrant of The New York Times op-ed page from 1985 to 1998. Advertorials take two broad forms: (a) image advertorials, which are paid messages by organized interests designed to create a favorable climate of opinion, and (b) advocacy advertorials, which are sponsored messages intended to win support for an interest's viewpoints on controversial issues. Typologies of advertorials (11 categories), organized interests (21 categories), corporate and noncorporate economic interests (29 categories), and policy content (28 categories) are used to document annually and over time who is sponsoring advertorials, what types of advertorials are being used, what interests avail themselves of advertorial campaigns, which issue areas are receiving attention, what images and policy messages are being communicated, which organizations sponsor the most advertorials, and the timing of such political advertising campaigns. We find over time an increasing number of advertorials, an increasing number and diversity of sponsoring interest organizations, an increasing trend toward advocacy advertorials, a continuing but declining sponsorship dominance by corporate interests, a shifting policy issue emphasis that corresponds to events in the political environment, and evidence that organized interests employ a variety of sponsorship strategies. 相似文献

Development of digital image‐editing programs has enabled us to be widely exposed to forged digital images surrounding us. Such forged images have been dispersed through the Internet, newspaper articles, and magazines, and in particular, the information contained in these unverified images happened to be regarded as true. As a result, the forged images provided wrong information for individuals and society, thus sometimes creating social issues. In order to solve such problems, this study was aimed to suggest the methods of identifying the veracity of forged images. In this way, it suggested re‐interpolation algorithm. Namely, the study re‐interpolated in identical arbitrary values both the interpolated and un‐interpolated regions based on the interpolation used a lot in forged, confirmed discrete fourier transform (DFT) characteristics of these two regions, and embodied a detection map for the final forged images, using the subtraction value between two regions in DFT characteristics. 相似文献

The extent to which the electorate uses issue information to update their candidate evaluations over the course of political campaigns has often raised questions about citizen competence. Using a ten-week panel experiment designed to capture the low-information context of most congressional races this study contributes to our understanding of when and by what processes issue information produces enduring effects. Findings reveal that when voters need to assess an ideologically moderate candidate, they rely less on partisan cues but instead of storing issue information in long-term memory – either via a memory-based or on-line process – considerations in short-term memory remained one of the most powerful predictors of candidate evaluation, particularly when new issue information deviated from partisan norms. 相似文献

It is only by historically contextualizing Baudrillard's concept of the simulacrum that we can understand its form and effects – its historical efficacy,its nihilistic ungrounding of certain epistemological foundations, its subsequent demonization in the West, and the latter's attempt to domesticate its power. Baudrillard opposes the contemporary simulacrum with the Durkheimian symbolic but, as a privileged critical site functioning as the 'real', this only repeats the Western domestication. Ultimately, however, the diabolical power of the simulacrum is too great for the symbolic, and its success today overwhelms Baudrillard himself. The pact with its demon is a dangerous one. 相似文献

The Baku European Games, the first multi-sport mega-event held at a European level, was a major public relations undertaking by Azerbaijan. The games were framed by a trend involving large-scale sports events promoted by the Ilham Aliyev government, based on the profits of the second oil boom in the twenty-first century. The sports event served to internationally portray Azerbaijan as a rapidly developing country and in this way to increase national consciousness within the society, which was lacking a collective narrative in the post-Soviet era. Nonetheless, the downturn due to the fall of international oil prices negatively affected the impact of the sports mega-event. Moreover, the sports competition symbolized the government’s commitment to impose reasons of state and nation-building over social needs and political freedoms in Azerbaijan.
