The diffusion of e-government innovations in Turkey： A conceptual framework

This paper aims to draw a conceptual framework about combining the diffusion of innovations literature with the use of e-government applications that are being used newly in Turkey. In recent years, their development still continues to grow rapidly. Thus, these applications can be accepted as innovations. In order to understand the patterns of diffusion that depend on a time process, we argue that the characteristics of e-government applications have effects on diffusion and rate of diffusion itself. With the combining efforts of literature and characteristics of e-government applications, some propositions are suggested with the help of diffusions of innovations literature and the validity of the conceptual framework that is drawn by the study that is aimed to be tested empirically for Turkey in further studies.     

《侵权责任法》确立医疗损害责任制度的意义

我国《侵权责任法》第七章确立的医疗损害责任制度全面体现了平等保护医患双方合法权益的立法精神;该法使用“医疗损害责任”的概念充分体现了民事权利保护法和救济法的性质;医疗损害责任制度的确立构建了一元化的医疗损害责任体系,彻底改变了对医疗纠纷案件法律适用“二元化”的现象;医疗损害责任归责原则体系的确立,有利于公正、合理的裁判各种医疗损害纠纷案件;医疗损害责任制度的确立推动我国最高司法机关修订了《民事案件案由规定》,从而明确了医疗纠纷案件的案由;对有效解决医疗损害责任的赔偿范围和标准的法律适用等问题产生了积极的意义。     

Reforming campaign finance in the nineties: a case study of Spain

This paper analyzes the reforms of the Spanish electoral finance regulatory system during the nineties. We present a number of indexes to measure the impact of the reforms on parties and campaign spending. We also suggest a game theoretical model to explain why the two main parties agreed to support the legal changes in the nineties. A principal outcome of the reforms was to establish an effective limit to campaign expenses. In our view this would have not been feasible in the late seventies or eighties. Then the parties were trapped in a prisoner’s dilemma in which each party had to spend more in order to prevent other parties from gaining electoral advantage. But in the nineties the main parties, ridden with problems of soaring electoral debts and disgruntled voters, used the reform of political finance as a coordination device to achieve a Pareto efficient equilibrium.

The regulation of civilian drones' impacts on public safety

Because they are airborne artefacts, drones embody threats to people and property, even in normal operation, but especially when malfunctions occur in equipment or in the data communications on which they are heavily dependent. Some natural controls exist over inappropriate drone behaviour. General liability laws provide remedies for harm that arises from drones, and act as a deterrent against irresponsible behaviour. Specific air safety laws do, or may, apply to drones. Co-regulatory mechanisms provide protections, as may industry and organisational self-regulation. However, a review of current and emergent regulatory arrangements identifies a considerable range of gaps and uncertainties that need to be addressed, particularly in relation to small drones, including micro-drones.     

The Big (Data) Bang: Policy,Prospects, and Challenges

Big data is increasingly the cornerstone on which policy making is based. However, with potential benefits and applications come challenges and dilemmas. In this set of symposium articles, authors examine the promise and problems of big data, exploring associated prospects, risks, parameters, and payoffs from a variety of perspectives. The articles address myriad challenges in the handling of big data sets, such as collection, validation, integrity, and security; ontological issues attending data analytics and conceptual transformations; the foundations of big data collection for social science research; the gap between the acquisition of data and its use to advance discovery and innovation; the costs and benefits of using big data in decision making and analysis; and, finally, related problems of privacy, security, and ethics. Issues such as these will continue to arise with increased use of big data as fundamental to policy making and governance in today's growing information society.     

论转化型抢劫罪的适用条件

转化型抢劫罪是一种常见的多发性犯罪,是一种严重侵犯公民人身权利和财产权利的暴力型犯罪。但是,转化型抢劫罪在刑法理论界尚有一定的争论和分歧,在司法实践中,由于刑法条款的规定比较原则和笼统,造成执法过程中对该罪名的理解存在一定的伸缩空间,使得对转化型抢劫罪适用条件存在争议。转化型抢劫罪有三个适用条件:前提条件、主观条件、客观条件。     

论赏识教育在高校学风建设中的应用

Unmanned aerial vehicles: A preliminary analysis of forensic challenges

As unmanned aerial vehicles have become more affordable, their popularity with the general public and commercial organisations has seen significant growth in recent years. Whilst remaining a device for both the hobbyist and aircraft-enthusiast to enjoy, they are now also used for carrying out activities such as law enforcement surveillance, agricultural maintenance, acquiring specialist movie and sports event footage along with search and seizure activities. Conversely, despite maintaining many legitimate uses, there are also increasing media reports of unmanned aerial vehicle technology being abused, ranging from physical assaults due to negligent flights to breaches of Civil Aviation Authority Air Navigation Regulations, requiring a forensic analysis of these devices in order to establish the chain of events. This article presents an introductory discussion of unmanned aerial vehicle analysis and provides the results of a digital forensic investigation of a test Parrot Bebop unmanned aerial vehicle. Directions for the acquisition and analysis of the device's internal storage are provided along with an interpretation of on-board flight data, captured media and operating system. Further, as the device can be controlled via Android and iOS devices using the application FreeFlight3, forensic analysis of these devices is also presented. Results showed the ability to recover flight data from both the unmanned aerial vehicle and controller handsets along with captured media, however problems exist with establishing the definitive owner of the device, particularly if a user had abandoned it at the scene of a crime.
