社区基金会：社区自治发展的新思路

伴随着我国社区民主建设和社区自治改革的宏观趋势,适度地借鉴国外社区基金会的营运理念和发展经验,对处于探索阶段的我国城市社区自治事业的开展无疑具有积极的开拓意义。     

论中国村民自治制度的完善

村民自治是宪法赋予广大农民的一项神圣权利，是依宪治政的必然要求，是社会主义新农村建设的重要内容，是构建社会主义和谐社会的需要。但现行村民自治制度运行存在诸多弊端：自治权的界限不清楚，行使自治权的程序不规范，解决争议的方法不明确，权利保障不得力，村民自治与乡镇政府间的关系不明确，乱用权利的情况时有发生．这些问题要想得到根本解决，必须在立法上明确村民自治机构、自治权的范围和行使自治权的程序，强化监督工作，理顺各种关系，打击妨害村民行使自治权的黑恶势力。本文试图从法治的角度，探讨村民自治制度的完善，并就此提出自己的一些看法。     

民族团结进步事业的成功实践——桂林兴安县华江瑶族乡和谐发展模式探析

广西兴安华江瑶族乡60年来，从民族团结进步事业初创时零的突破，至经济上“量的跨越”，再到发展观“质”的飞跃，成为广西乃至全国“民族团结进步”典型，展现了民族区域自治的丰硕成果，体现了我国民族团结进步事业的成功实践。     

国际私法中意思自治原则的新发展及其价值分析

现代国际私法中的意思自治原则呈现出许多新的发展趋势：意思自治原则的适用领域不断扩张;意思自治原则和最密切联系原则趋于一种融合;弱者保护在意思自治原则中得以体现。意思自治原则的扩张符合私法自治的精神并有助于实现传统冲突法所追求的价值目标;最密切联系与意思自治原则的融合有助于确定性与灵活性的和谐统一,从而实现冲突规范的价值平衡;弱者保护在意思自治原则中的体现与现代国际私法追求实质正义的价值目标相一致,并有助于实现国际私法的人文精神。     

涉外产品责任法律适用规则探究

产品责任作为一种特殊的侵权责任,在传统上适用"侵权行为地法作为准据法"这一国际私法原则。随着国际经济往来密切,产品跨国流通频繁,使涉外产品责任冲突因各国法律所适用的准据法规则不同而日益涌现,而我国在此方面规定较为薄弱,使我国在处理类似争端时陷入被动和僵局。结合当前国际通行规范和发展趋势加以研究,力求得出实用性建议。     

社会中间层与第三部门的经济法学辨析

社会中间层和第三部门都是社会学领域的概念。在这两个概念中提出的同一社会背景下 ,经济法范畴内的调整对象也发生了一定的变化。目前 ,经济法学者也注意到一类新兴的主体可能给原有的经济法律关系带来变革 ,但是由于在借用社会学研究成果时认识的不同 ,存在概念使用上的混乱和模糊。本文提出“协会”自治团体的概念 ,试图从经济法主体的角度明确这类主体的内涵与外延。     

Managing Autonomy: Analyzing Arts Management and Artistic Autonomy through the Theory of Justification

Arts management has commonly been analyzed as a microcosm of the art field, in which struggles between artistic, economic, administrative, and societal considerations are constantly being fought. Using the field theory of Bourdieu, scholars have attempted to uncover levels of functional differentiation within arts organizations, and interpreted differentiation between artistic considerations and economic and administrative considerations as a core element in defining the artistic autonomy of such organizations. In this article, I present an alternative approach to the interpretation of artistic autonomy in arts management. Through the stories of three artistic directors and the way in which they run their theatres, I aim to show the theory of justification (developed by Boltanski and Thévenot) and shed new light on the interpretation of arts management, as well as on the understanding of artistic autonomy more generally.     

北京四区县农民部分法律权益实现情况调研报告

根据调查所掌握的基本情况,本调研报告针对进一步实现和维护农民法律权益提出五项建议。选择农民最需要、与农民生产生活联系最密切的法律知识和观念作为宣传重点,以法制宣传、集中培训、现场教育等为主要形式,搞好普法工作,真正让法律进乡(村)。依法进行调解,充分发挥调解在我国新农村建设中的积极作用。切实推行《婚姻法》、《妇女权益保障法》,真正实现男女平等。推行《老年人权益保障法》和《农村五保供养工作条例,》保证老有所养。进一步健全村民自治组织,确立和保障农民的自治权利。     

关于我国农村村民自治的若干理论问题

本文对"村民自治"这一概念尝试性地下了定义,揭示了村民自治的特点,基于村民自治的实践将村民自治发展历程划分为四个阶段,对村民自治的基本内容--民主选举、民主决策、民主管理、民主监督及其作用给予了准确定位,并分析了村民自治对于我国基层社会管理,基层农村民主、经济、文化发展,社会主义民主政治建设的重大实践价值和理论价值。     

A Structural Model of Autonomy in Middle and Late Adolescence: Connectedness,Separation, Detachment,and Agency

This study presents a comprehensive 4-factor model of autonomy in middle and late adolescence. Partially overlapping sets of scales on adolescent individuation and family functioning were correlated with each other in 2 independent studies. Data for the first study were taken from a sample of high school students in Grades 9–12 (N = 601), whereas the data for the second study were derived from a sample of 1st-year university students (N = 374). Confirmatory factor analysis on all of the scales and derivative subscales in both studies revealed a model that comprised 4 different but related factors, that is, Connectedness, Separation, Detachment, and Agency, all of which occupy a central place in different theories of adolescent autonomy. Connectedness and Detachment, and to a lesser extent Connectedness and Separation, were inversely related to one another. Correlations between Agency and the 3 other factors were much lower. Results are discussed with respect to the different views on autonomy that exist in the literature, and with respect to the term autonomy, which should be used as an umbrella term only. Implications for the conceptual basis of the Emotional Autonomy Scale are also outlined.
