浅探我国法律援助制度的科学发展

法律援助制度是我国保护“弱势群体”的最后也是最有力的救济手段,它的内涵以及它制定的最终目标都体现出“以人为本”、实现“可持续发展”这一主题。它在我国取得了迅速的发展,也在为“弱势群体”提供法律服务方面取得了显著成绩。但是目前,我国的法律援助工作仍面临着许多困难,存在着许多不足,本文主要探讨如何去加以科学的发展和完善。

由于铁路在社会生产生活中特殊的地位,形成了我国“火车站多是该城市最繁华地段”这一特殊的格局,也形成了全国各地火车站及周边地区治安较为复杂的治安局面。过去株洲站治安突出问题主要有:(一)劳务性扛包进出站;(二)抢夺、抢劫;(三)站台扒窃;(四)违法拉客、捡拾乞讨;(五)盗窃铁路运输物资。对此,株洲站采取了查、堵、防、打、建等一系列立体防控措施,改变了辖区治安面貌。     

论民法解释之依据与解释方法之运用

法律解释不仅包括法律规范内容含义不明确、不清楚时的解释,还包括对法律规范的有无进行的判断、在没有法律规定时进行的漏洞补充和价值补充。依解释法律的主体及效力的不同,民法的解释一般分为立法解释、司法解释和学理解释。而法律解释的方法包括文义、体系、目的、历史、比较等方法。法律漏洞的补充与法律条文的解释有时并不能截然区分而有所交叉,因此有必要加以分析。     

The Future of the British Post Office

Recent proposals of the U.K. government to privatize the British Post Office are considered in relation to broader European trends and in terms of economic efficiency. The proposals appear to open the possibility of moving away from a geographically uniform tariff that conflicts with proposals from the EU Commission for the EU, as well as reducing the postal monopoly. Uniform postal charges may or may not improve economic welfare, as there are clear-cut conditions under which their welfare effect can be positive or negative. A practical mechanism is suggested to allow the postal monopoly to be challenged by alternative suppliers without encouraging cream skimming.

以“代位执法”解决警种分工过细问题

警种分工过细问题长期困扰着公安工作,它制约了公安机关整体合力的形成和发挥,加剧了警力不足,限制了民警的业务素质。实践中可以尝试实行“代位执法”,即在一定程度上允许跨职权处理一些事宜,同时设立相应的法规来规范这种跨职权处理行为。     

浅析办理治安案件中存在的问题及对策

《治安管理处罚法》和《公安机关办理行政案件程序规定》施行以来,公安机关在办理治安案件中存在鱼龙混杂、画蛇添足、张冠李戴、因循守旧、玩忽职守和虎头蛇尾等问题。要进行"矫治",就必须加强学习,端正态度,更新观念,强化指导并细化制度。

公安高等院校的师资队伍是公安人才队伍的重要组成部分,因此,全面加强公安大学的师资队伍建设具有特别重要的现实意义.总体来看,公安大学师资队伍的政治素质较高,职务结构、学历结构、年龄结构、知识结构基本合理,能够适应当前学校教学工作的基本要求,但也还存在着一些不容忽视的问题.要全面加强公安大学的师资队伍建设,必须围绕能力建设这个核心,以科学的发展观、人才观为指导,突出重点,统筹安排,采取积极有效的措施.

Australia's Political Institutions and the Corruption of Public Opinion1

This article explores structural causes for the decline in the quality of Australia's political and policy conversations. Three are nominated. The first concerns the changing role of the major party organisations. These no longer contribute to agenda setting; they are no longer forums for activist and interest mobilisation; they no longer mobilise and cue a mass base. The second structural change concerns the rise in the role of the media. This is now the primary bridge between the formal political system and the surrounding society, a role for which it is singularly ill‐equipped. The third change concerns the misalignment between the formal political system and Australian society. The formal system was formed in the early twentieth century when Australian society was broadly divided by class allegiance. Those days are long gone. Class has decomposed. A variety of new concerns differentiate and pluralise social attitudes. Possible remedies are then discussed.
