Environment and Energy: The Baltic Sea Gas Pipeline

Germany and Russia have agreed to build the Nord Stream gas pipeline. The 1,200 kilometers-long structure will run from Vyborg, Russia to Greifswald, Germany traversing the Baltic Sea. The Baltic countries, Finland, Poland and Sweden, have expressed concerns about the project. At issue is the environmental impact of the project as well as the energy, political, and socioeconomic implications.

Putting security governance to the test: conceptual,empirical, and normative challenges

Security governance has featured prominently in recent debates about fragmentation, informalization, and privatization in the increasingly diverse field of security policy. It has inspired much valuable research. Yet, there are not just very different conceptual understandings of security governance; there is also a lack of clarity regarding its empirical manifestations and normative connotations. After a decade of research, the special issue therefore puts security governance to the test and scrutinizes its analytical and political pitfalls and potentials. This editorial briefly reviews the rise of security governance, identifies central conceptual, empirical, and normative challenges that need to be addressed, and introduces the individual contributions to this special issue.     

物权的本质

物权的本质为何,千百年来吸引许多私法学者尝试提出一家之言。然而,大陆法系多数学者执着干物权乃人与物之关系,走入歧途;普通法主流学者把物权看成一束权利,同样是打迷糊仗。本文主张物权（或本文之名词“财产权”）有三种核心效力：对世、排他、追及。任何与物有关之权利若具备三种核心效力,就是物权。财产是人与人间关于物之法律关系之组合,而非人对物之关系。此种财产关系又可分成四种典型：人对国家、人对定限物权人、人对特定人如邻居、人对所有其他人。除了人面对国家徵收高权时外,财产关系都有或强或弱的排他本质;而此关系乃自动生成,此正是对世效力之本意。追及效力虽然有时隐而未显,但在财产权移转时会当然发挥作用。此外,所有权是财产权,但非后者之同义词。所有权（而非物权）才是一束权能。

Covenant of Mayors: Reasons for Being an Environmentally and Energy Friendly Municipality

The Covenant of Mayors (CM) is the mainstream European movement involving local authorities who voluntarily commit to increase energy efficiency and the use of renewable energy sources within their territories with the aim of reducing CO₂ emissions and meet the European Union objectives by 2020. One country that has a greater number of signatories of this agreement is Spain. This article analyzes which factors influence the decision of Spanish local authorities to join the ever‐growing movement. An empirical model is formulated to describe the behavior of Spanish local governments, this being a binary choice model which is a function of various political, economic, and technical factors. Among the prominent factors that influence this decision are population, availability of renewable energy, fiscal and environmental stress, citizens’ political preference, the contagion effect of neighboring municipalities, the existence of covenant coordinators, and finally, economic motivations.     

论违宪审查制度

因具体条件的差异 ,世界各国的违宪审查机构、审查方式、审查效力等不尽相同 ,我国的违宪审查制度被认为是宪法实施的监督制度 ,它坚持一切权力属于人民和民主集中制的原则 ,有广泛的全民性和民主性。在进一步完善违宪审查制度的基础上 ,应当制定违宪审查细则 ,允许宪法进入诉讼 ,设立主管宪法监督机构 ,倡导国家机关和人民群众共同关心宪法的实施。     

法典的建构与中国法治

在中国的法治现代化建设中 ,法典的建构具有重大的作用 ,但许多部门法典的建构所需要具备的条件还欠缺 ,时机也不成熟。法典的建构 ,只有建立在真正洞悉了中国社会的秩序之上 ,才会发挥巨大的作用 ,成为人们生活和行动中的法律 ,而不是纸面上的法律
