公共危险形成之前,可能构成公共危险犯的预备.公共危险形成后,严重后果产生之前,可以看成只是产生了一种作为未遂的危险.因此,行为人及时采取措施防止危险避免实害的,成立犯罪中止.对于放火罪,形成独立燃烧状态,只是表明未遂危险的形成,在严重灾害发生之前,仍有成立犯罪中止的可能.     

Investigation on the genetic-inconsistent paternity cases using the MiSeq FGx system

Mutations might challenge the paternity index calculation in forensic identification. While many studies have focussed on the autosomal short tandem repeats (A-STR), the mutation status of sex chromosomes and single nucleotide polymorphism (SNP) remain blank. Next generation sequencing (NGS), known as high throughput and large sequence polymorphism, is a promising tool for forensic genetics. To describe the mutation landscapes in the paternity cases with genetic inconsistencies, a total of 63 parentage confirmed paternity cases contained at least one mismatched locus have been collected. The mutations were subsequently evaluated using Verogen’s MPS ForenSeq^TM DNA Signature Kit and a microsatellite instability (MSI) detection kit. The result showed 98.41% (62/63) of the cases had no additional autosomal mutations even when the number of A-STRs increased to 27. As for the sex chromosomes, about 11.11% (7/63) of the cases exhibited either X-STR or Y-STR mutations. D2S1338, FGA and Penta E were the most frequent altered STRs, which suggested they might be the mutation hotspots. In addition, a male with sex chromosome abnormality was observed accidently, whose genotype might be 47, XXY, rather than MSI. Nearly 56.90% of the STR loci possessed isoalleles, which might result in higher STR polymorphisms. No Mendelian incompatibility was detected among the SNP markers, which indicated that SNP was a more reliable genetic marker in the genetic-inconsistent paternity cases.Supplemental data for this article is available online at https://doi.org/10.1080/20961790.2021.2009631 .     

Histological examination of carotid artery tissue in cases of ligature strangulation and hanging

Violence against the neck can result in a range of macromorphological and micromorphological findings. However, the forensic relevance of the carotid sinus in cases of violence against the neck remains controversial. In this follow-up study of 22 cases of suicidal and accidental strangulations, carotid bifurcations were examined histologically for morphological changes implying direct trauma, including haemorrhage and immunohistochemical expression of heat-shock proteins 27, 60, and 70 and aquaporin-3. These cases were compared with a control group (82 cases) without neck compression or head trauma and with variable causes of death. No relevant histopathological findings implying direct trauma of the carotid bifurcation were found. No cases showed positive aquaporin-3 staining and only five cases showed positive heat-shock protein-27 staining, all of which were hangings. Without massive trauma of the carotid bifurcation, histological alterations cannot be expected. Without signs of rapid death, findings of acute circulatory failure, macromorphological and micromorphological findings of neck compression, and reliable markers indicating relevant impact on the carotid bifurcation the diagnosis of a lethal reflex cannot be verified.

• Among 22 cases of strangulation causing death, there were 16 cases of hanging and 6 cases of ligature strangulation
• Few cases showed small haemorrhages located predominantly in the surrounding fat and connective tissues; however, the haemorrhages did not have any effects on the tissues
• Neck compression had minimal effects on heat shock protein 27 expression in carotid artery tissue
• Aquaporin-3 staining suggested it is not a useful marker for relevant neck pressure, or that there had not been any relevant neck impact
• Our findings suggested no direct evidence for reflex cardiac death resulting from a brief force against the neck

     

法医学二代测序STR分型准确度与测序深度的关联性评估

目的利用实验数据对法医学二代测序STR分型测序深度与分型结果准确度的关联性进行评估。方法使用商业化基因组DNA制备单一来源和混合的DNA样本,以Thermo Fisher公司的25重早期测试试剂盒进行目的STR片段扩增,每种扩增产物分别使用4种不同的序列标签平行建库,并控制标记每一种序列标签的文库上机量依次占一张Ion 318芯片的1/4、1/8、1/16、1/32。经Ion PGMTM基因测序仪测序,以及Ion Torrent SuiteTM软件进行数据分析;同时对庞敬博等人发表的基于相同试剂盒和测序仪检测的95名中国汉族无关个体的6928条等位基因、影子峰和噪音序列进行测序深度统计分析,寻找测序深度与STR分型准确度的关联性。结果各基因座测序深度随文库上样量减少而呈明显下降趋势。对于单一来源样本,每张芯片上样不超过8个均一化文库可实现全部基因座的完整分型;对于1∶20比例的混合DNA,每张芯片上样不超过4个均一化文库时,未发现微量组分的等位基因丢失。人群数据测序深度统计显示,该体系基因座间存在不均衡性,有必要针对各基因座分别设定分析阈值参数。结论测序深度与法医学STR分型结果的准确性密切相关,各基因座最低测序深度与平均测序深度的比值可作为设定分析阈值的重要参考指标。本研究确定的单张芯片上样数量仅适用于本实验体系,但相关实验设计和方案可供其他实验体系开展类似工作参考。     

论纳税人诚实推定权的入法途径

诚实推定权由纳税人财产权与人格尊严权衍生而来,在立法中加以确认有助于落实税收法定、践行量能课税和提高纳税人遵从度。诚实推定权借鉴了刑法上的无罪推定和民法上的善意推定,其基本内涵是税务机关认为纳税人有少缴税款嫌疑时,应由该机关承担举证责任,证明强度应达到优势证据标准。我国应在修改《税收征收管理法》时,明确表达纳税人享有诚实推定权,同时准确界分纳税人的协力义务和税务机关的举证责任,强调逃税行为必须具备主观故意的要件,合理限定税收检查权。诚实推定权入法将对税收征纳实践产生影响,提高现有“计税依据明显偏低”的认定标准,使纳税人的正当理由诉求更有可能被认可,对逃税行为的界定也将更为精确。

Ephemeral ‘communities’: spatiality and politics in rangeland interventions in Mongolia

In recent years, the number of community-based natural resource management projects for rangeland conservation and development has grown rapidly in Mongolia. Such projects seek to develop social capital through the formation of herder groups and pasture user groups, in order to enable the coordination of complex, collective tasks needed for sustainability. Through analysis of social networks, interviews and ethnographic data from two places where such projects have been implemented, Bayanjargalan, Dundgovi, and Tariat, Arkhangai, the paper demonstrates that the spatiality of pastoral social relations is much more extensive than assumed by these projects. Furthermore, rather than being neutral technical interventions, such projects are embedded in and proliferate politics. They often bolster the informal power of wealthy herders who gain more access to pasture, while at the same time leading to tensions between different levels of government and becoming objects of struggle between Mongolia’s two dominant political parties. For all of these reasons, these efforts have tended not to build trust, and the ‘communities’ they create, in the form of herder groups and pasture user groups, have tended to be ephemeral.
