A 26plex Autosomal STR Assay to Aid Human Identity Testing*†

Abstract: A short tandem repeat multiplex assay has been successfully developed with 25 autosomal loci plus the sex‐typing locus amelogenin for a total of 26 amplified products in a single reaction. Primers for the loci were designed so that all of the amplicons present were distributed from 65 base pairs (bp) to less than 400 bp within a five‐dye chemistry design with the fifth dye reserved for the sizing standard. A multiplex design strategy was developed to overcome challenges encountered in creating this assay. The limits of the multiplex were tested, resulting in the successful amplification of a wide range of genomic DNA sample concentrations from 2 ng to as low as 100 pg with 30 cycles of PCR. The 26plex has the potential to benefit the forensic community for reference sample testing and complex relationship evaluation.

Blo?e Schadensverlagerung auf einen Dritten soll den Sch?diger von seiner Ersatzpflicht nicht befreien. Daher kommt es, soweit der Ersatzanspruch nicht ohnedies durch Legalzession auf den Dritten übergeht, zur Drittschadensliquidation durch den unmittelbar Gesch?digten. Der Beitrag untersucht dies für verschiedene Fallgruppen und hebt die Bedeutung der Schadensverlagerung für die Bemessung des Umfangs des Schadenersatzanspruchs sowie zur Abgrenzung von Drittschadensliquidation und Vertrag mit Schutzwirkung zugunsten Dritter hervor.     

Die Gemeinschaftsanlage

Seit 1982 erlangt die Frage, ob eine der gemeinsamen Benutzung dienende Anlage, wie eine zentrale W?rmeversorgungsanlage, ein Aufzug, eine mit Ger?ten ausgestattete Waschküche, eine Sauna, ein Schwimmbad aber auch eine technisch ausgestattete Garage denn doch keine Gemeinschaftsanlage sein kann, Bedeutung. Nur wenn es sich um eine Gemeinschaftsanlage handelt, hat der Liegenschaftseigentümer deren Erhaltungskosten zu tragen. Anderenfalls die Nutzer, wenn sie weiterhin nutzen wollen. Denn der Liegenschaftseigentümer kann zur Aufrechterhaltung des Betriebes, wenn es sich um keine Gemeinschaftsanlage handelt, seit 1982 gegen seinen Willen auch nicht verpflichtet werden. Ein Zinsminderungsanspruch bringt dem auf die Benutzung Angewiesenen wenig.     

Dienstleistungsrichtlinie und Immobilienwirtschaft

Die Dienstleistungsrichtlinie (RL 2006/123/EG des Europ?ischen Parlaments und des Rates, vom 12. 12. 2006, über Dienstleistungen im Binnenmarkt, ABl L 376/36), die bis 28. 12. 2009 von den Mitgliedsstaaten der EU umzusetzen ist, hat neben ihrem arbeitsrechtlichen Schwerpunkt auch Auswirkungen auf die Immobilienwirtschaft sowie deren rechtliche Rahmenbedingungen. ?sterreich hat durch eine Novelle der GewO 1994 einen der wichtigsten Punkte der DL-RL, n?mlich die obligatorische Berufshaftpflichtversicherung der Immobilientreuh?nder – Nachweis dieser Versicherung bis sp?testens 27. 8. 2008 – bereits umgesetzt. Angesichts verschiedener Vorbehalte bleibt allerdings die Integrationswirkung der DL-RL hin zu einer Europ?isierung des gesamten Wohn- und Immobilienrechts in absehbarer Zeit beschr?nkt.     

Factors Driving the Promotion of Hydroelectricity: A Qualitative Comparative Analysis

In the wake of the COP21 conference in Paris, the transition to a low‐carbon energy supply remains a central issue on the political agenda. The deployment of renewable energies is often challenged by multiple issues (e.g., public acceptance, landscape protection, and so forth). Political actors try to overcome such challenges with various measures; however, the policy instruments used vary greatly in their strength. This article questions what factors lead to the adoption of strong policy instruments promoting hydroelectricity. Explanatory factors are derived from Kingdon's multiple streams framework and are analyzed with fuzzy‐set qualitative comparative analysis within the Swiss cantons. The findings show that the strength of policy promoting hydroelectricity depends on the conjunction of mainly two factors: ambitious climate targets and an already well‐established hydroelectricity sector that generates large tax revenues for the cantons. Depending on the context, the strength of left‐wing and green parties as well as the current level of exploitation play an important role with the aforementioned factors.

Streitiges Verfahren für Rechte aus laesio enormis auch bei MRG-geschütztem Mietvertrag

Im Gegensatz zu Kondiktionsansprüchen, die durch den besonderen Bereicherungsanspruch des § 27 MRG ausgeschlossen werden, bleibt nach Ansicht des erkennenden Senats für vertragliche Ansprüche wie laesio enormis, aber auch Irrtumsanfechtung bzw Gew?hrleistungsansprüche aus einem Kaufvertrag über Einrichtungsgegenst?nde, dessen Eigenschaft als Schein- oder Umgehungsgesch?ft zur Verdeckung einer unzul?ssigen Abl?seforderung der Mieter gar nicht behauptet, der streitige Rechtsweg zul?ssig.     

Developing a Model Intervention to Prevent Abuse in Relationships Among Caribbean and Caribbean-American Youth by Partnering with Schools

SUMMARY

This paper proposes a model intervention to prevent relationship abuse among Caribbean and Caribbean-American adolescents. Specifically, the model partners with a high school with a strong Caribbean student population and incorporates education, prevention and intervention, as the three core components. This paper highlights the importance of working with young people in a school setting, working with young people before they have fully tackled the developmental task of defining norms of and values in relationships, utilizing culturally competent staff and specialized programming, and emphasizing the need for early intervention in the instances of adolescent relationship violence before its evolution into adult domestic violence. The model proposed serves as an outline for further development of culturally-specific and competent interventions to prevent and address relationship violence among adolescents.
