在《行政诉讼法》、《行政复议法》和《国家赔偿法》中,关于权利人死亡时作为权利资格继受体的亲属范围的规定不尽一致,立法上的混乱造成了三大救济方式在权利人主体资格上的不衔接。为弥补这一缺陷,更好地保护有关当事人的权益,应当采扶养的广义概念使扶养、抚养和赡养三个概念显示出通用性和一致性,使《行政复议法》上亲属概念的界定与《行政诉讼法》保持一致,扩大行政赔偿请求人的范围。  相似文献

The position of children in the family economy changed fundamentally from the 19th century onward. In the Netherlands, the first child labor act was introduced in 1874; compulsory schooling was established in 1901. Since then, the economic contribution to the family income by children has gradually disappeared. Until the 1960s, in working-class families, the financial contribution of adolescents to the family income remained of great importance. Young workers gave their whole wage to the family in exchange for housing, food, clothes, and some pocket money. This article describes how the economic role of teenagers has changed since then. Nowadays, children and adolescents do not contribute to the family purse any longer.  相似文献

The contemporary practice of family law demands that lawyers know far more than the law. Results of a recent survey of professionals and law students suggest that today's family lawyer needs knowledge and skills that are often missing from law school curricula. Survey respondents emphasized the importance of strong interpersonal skills like listening, negotiation, and working with clients in emotional crisis, as well as keen understanding of financial issues in family law, the impact of separation and divorce on children, and the ethical dimensions of family law practice. Law students held contrasting views to law faculty and to practicing attorneys on a number of measures, ranking adversarial courtroom skills as more important and placing less emphasis on skills, knowledge, and attributes related to ethics.  相似文献

Childhood experiences of physical punishment were examined as related to perceptions of family environment during childhood and affective and personality outcomes of college students. From the 274 respondents who participated, scores were compared for the participants with the 75 highest and 75 lowest physical discipline scores based on the Conflict Tactics Scale (CTSPC-CA). Respondents who experienced the highest level of physical punishment in their families of origin reported higher family conflict, more negative parental relationships, greater family worries, more depressive symptoms, more perceived nonsupport, greater identity problems, and more negative social relationships. Respondents in the low physical punishment group reported higher positive family affect. Results suggest that experiencing physical discipline as a child may be related to one’s family environment and psychological well-being in young adulthood.  相似文献

By examining the operation of poverty alleviation projects in Z County, this paper defines the “last one kilometer” dilemma of these projects to be both process oriented and result oriented. To be specific, the distribution of these projects lacks precision; project resources have tremendous difficulty in long term effective integration; farmers in poverty stricken areas have not yet established adequate organizations; compatibility of project benefit sharing calls for further improvement. As to the reason behind these problems, the inequality among various subjects in different positions has shaped their differentiated objective demands and logic of doing things, and informal power connection has further strengthened the “monopolistic” position of the grassroots governments and village elites. This deprives impoverished farmers of the strong intention and capability to participate in such projects. Finally, with the weakening of the project correlation, the sustainability of project benefits can hardly be guaranteed. Based on all the above discussion, this paper puts forward feasible measures to cope with the “last one kilometer” dilemma from the perspective of improving the village project integrated planning, adjusting the project management power distribution, and forging subjectivity of impoverished farmers in project participation.  相似文献

Utilising the Lithuanian case, this article analyses what determines a country’s position on the transfer of national competency over banking policy to the EU level. In contrast to dominant explanations in scholarly literature, this article argues that Lithuania’s support for the banking union can be explained by the general pro-European orientation of the political system in the context of ambiguous aggregate economic costs and the benefits of the new institutional framework. In 2013, the EU Presidency also positively affected Lithuania’s stance. Finally, the decision about when to join the banking union was subordinated to the process of euro accession.  相似文献

Upgrading skill formation has become an increasingly urgent task for societies facing the challenges of rapid technological change and globalization. However, reform of systems of vocational education and training (VET) poses severe challenges for aligning the interests of schools, firms, households, and governments, even in societies with relatively efficient markets for labor and education. Where market institutions are poorly developed, these challenges are particularly acute, resulting in endemic mismatches between the supply and demand of skill. Currently governments in many countries, including the United States, Russia, and China, are seeking to adopt elements of the German dual education model. The Russian federal government has undertaken several initiatives designed to upgrade VET by encouraging closer cooperation of vocational schools and firms at the regional level, including the adoption of dual education programs. This paper focuses on one such project: a 2013 pilot program administered by the Russian Agency for Strategic Initiatives, to foster the development of new models of dual education. The paper compares the 13 pilot regions with regions that submitted proposals but were not selected and with all other regions along multiple economic, social, demographic, and institutional dimensions. The findings suggest hypotheses about the conditions that enabled the pilot regions to take advantage of federal policies encouraging the adoption of dual education. More generally, the paper sheds light on institutional solutions to collective action dilemmas in skill formation in transitional and developing societies.  相似文献

This article focuses on the contested, and frequently postponed, construction of a new parliament house in postcolonial Myanmar. Since the late colonial period, the country’s legislative bodies have convened in four different buildings, three located in the former capital Yangon and the latest one in Naypyitaw. Drawing on legislative proceedings and media reports, this study interrogates the relationship between decolonisation, national identity, state-building, and public architecture in post-independence Myanmar. It suggests that the commissioning and construction of a new legislative house has always served a dual objective: projecting state power and national pride in both Myanmar’s early postcolonial and later post-junta political contexts, whilst symbolising a sense of nationhood grounded on the representational ideals of the dominant and ruling ethnic Bamar elites.  相似文献
