家庭暴力与青少年犯罪的因果关系研究

家庭暴力和青少年犯罪存在着一定的因果关系,家庭暴力容易导致青少年形成犯罪心理,在一定程度上提高了青少年犯罪的几率.家庭暴力给青少年造成的心理创伤、家庭教育缺陷和提供的不良示范促进了青少年不良心理意识的产生,家庭暴力对青少年造成的认知偏离、情感障碍和人格障碍妨碍青少年良好个性的形成.

Crossover Cases of High‐Conflict Families Involving Child Protection Services: Ontario Research Findings and Suggestions for Good Practices

Child protection services (CPS) are increasingly becoming involved in high‐conflict separations and the related custody and access proceedings. CPS involvement is often necessary to respond to abuse or neglect allegations or protect children from emotional harm. However, these crossover cases are very challenging for family justice professionals. This article reports on research on crossover cases in Ontario, including an analysis of reported court decisions, a survey of CPS staff, and interviews with family justice professionals. We suggest clearer CPS policies; improved understanding of respective professional roles; CPS summary reports for family courts; increased interagency coordination, communication, and training; and use of judicial case management.     

Orthodontic Treatment: Real Risk for Dental Age Estimation in Adults?

Dental age estimation becomes a challenge once the root formation is concluded. In living adults, one dental age indicator is the formation of secondary dentine, also associated with orthodontic treatment as well as root shortening. The aim of this study was to establish whether these secondary effects of orthodontic treatment could generate a statistically significant difference in dental age estimations when using Kvaal's method. The study sample included 34 pairs of pre‐ and postorthodontic panoramic radiographs, from different individuals with exactly the same age and sex distribution. Females 65%, median age 17.5 years, and males 35%, median age 22.5 years, were included. After data collection, dental age was estimated per tooth using formulae previously published. The risk of obtaining over‐estimation of age was calculated. (RR = 1.007). The changes caused by orthodontic treatment do not have any significant effect on age estimation when Kvaal et al.'s method is applied on panoramic radiographs.     

“杨天庆涉黑案”的特点、成因与防控类似违法犯罪的对策

“杨天庆涉黑案”是重庆2009年“打黑大审判”第一案。该案既有我国黑社会性质组织的一般特点,也有其个别化特点,前者使本案成立黑社会性质组织犯罪,后者使该犯罪具有残暴性、隐蔽性和迷惑性。该黑社会性质犯罪组织的滋生和形成,主要源于溺爱型的家庭教育、基层行政执法不力、重庆的“袍哥文化”、刑满释放人员等的社会化不足问题等因素。为防控类似违法犯罪的滋生和蔓延,应针对这些因素采取相应对策。     

双溶剂提取法判定印泥印文形成时间的初探

目的通过双溶剂提取法判定印泥印文的形成时间,为判定文件的真伪提供重要依据。方法选用6种不同品牌的印泥和4种纸张分别制作印泥印文的历时性样本,通过实验确定适用于双溶剂提取法判定印泥印文形成时间的弱提取剂和强提取剂;确定薄层扫描时狭缝的大小和扫描波长;绘制盖印时间与提取率的关系曲线。结果弱提取剂为50％的甲酸溶液,强提取剂为N,N-二甲基甲酰胺,狭缝大小为12．00mm×0．60mm,扫描波长为485nm,得到了盖印印文形成后半年内印泥提取率随印文形成时间变化的关系曲线。结论双溶剂提取法是判定印泥印文形成时间的一种有效方法。     

The Reliability of Chronological Age Determination by Means of Mandibular Third Molar Development in Subjects in Croatia*

Abstract: The aim of this study was to determine the development of the mandibular third molar and its relation to chronological age. The evaluated material consisted of 979 orthopantomograms of patients of Croatian Caucasian origin aged between 5.7 and 14.6 years. Third molar developmental stages were evaluated according to the stages proposed by Nolla. The frequencies of different stages of mineralization and the mean value of the mineralization of the mandibular third molars with regard to age, gender, and size of the mandible were determined and the coefficient of correlation determined between the age of the subject and the stage of development of the mandibular molars. Statistically significant correlation was determined between mineralization of the mandibular third molar and chronological age of the subjects (boys, mandibular left third molar r = 0.779, right third molar r = 0.793; girls, mandibular left third molar r = 0.746, right third molar r = 0.725). It can be concluded that the accuracy of age estimation based on Nolla’s method is applicable for Croatian children.     

农村房屋买卖合同效力问题研究

随着市场经济的发展和城乡人口流动加强,农村房屋买卖活动日益增多。现行法律、法规对此类农村房屋买卖合同的效力耒作出明确规定,使该问题在民法理论和司法实务中引发诸多争议。我国土地资源稀缺和地少人多的矛盾,决定了现阶段必须实行严格的土地法律制度,一户农村村民只能占用一处宅基地。为在资源有限的前提下确保农民生产和生活的稳定性,要求严格限制农村宅基地流转,不允许农村宅基地进入市场自由买卖。基于不动产房地一体的关联性,农村房屋流转亦应属于法律禁止之列。建议有关机关尽快研究并出台相应立法,这是社会主义法制统一的必然要求,也是维护社会稳定、和谐的重要途径。     

Animal Abuse, Family Violence, and Child Wellbeing: A Review

Animal abuse and family violence appear to be “linked” and tend to co-occur in the same households. Companion animals are often regarded as family members, if not by the abuser, then by others within the family. Consequently, in families where any given form of violence exists, animal abuse is also more likely to exist. This paper examines animal abuse in the context of abusive home environments, and the relationship between an abusive home in childhood and the range of behavioral problems that may extend into adulthood. Existing investigations are reviewed with reference to prevalence, epidemiology, and child development theory. It appears that holistic interventions to counter abusive home environments may represent the most effective way to break the association between animal cruelty and interpersonal violence, by addressing the shared situational characteristics common to a range of violent behaviors.

Reading for Law and the State: Theaters of Problematization and Authority

Constructing a particular nation, that of early modern England, is seen here as a series of theatrical performances. Shakespeare’s work is taken as a series of thought experiments. Some, like The Merchant of Venice, are reassuring that threatening circumstances and innovatory social practices are capable of being overcome or assimilated from the unknown to the known. Some, like King Lear and Hamlet, ponder the consequences of a failure to discover a resolution. Some writers have argued that England was historically quite early in beginning to conceive of itself as a nation, rather than as a population of possibly heterogeneous regions subject to a dynasty, a state of affairs summarized in the by now clichéd remark attributed to the Sun King, “L’Etat, c’est moi”. For Shakespeare, if not for all of his contemporaries, the Englishman is a bit slow-witted, owing to his fondness for beef and red wine, but he is distinguishable from others and provides material for the second pieces of theater I look at. If there could be an Englishman, his experience with the absolutist pretensions of the Stuart monarchy allowed there to be a free-born Englishman (and, actually, Englishwoman). The two crucial battles of the English civil war, Marston Moor and Naseby, followed by the Army Debates of 1647–1649 form the stage for an at least aspiring egalitarianism we now know as the rights of man, or the rights of the civic person.
