BritCrits: Subversion and submission,past, present and future

This article explores some of the intellectual influences which have shaped the development of Critical Legal Studies in Britain and the contexts in which these influences made themselves felt. It then considers which influences might or should steer Critical Legal Studies in the future. In terms of the past, specific attention is given to the influence of Marxism, Freud and Lacan, feminism, Foucault and Derrida, and recent genres of history-writing. As to the future, the question is asked whether Critical Legal Studies will engage constructively with recent developments in the life sciences and the philosophy of science, and, more generally, whether it will be able to surpass its established mooring in the philosophy of history. 美国第三人引入诉讼制度的历史、价值与结构

美国第三人引入诉讼制度通过第三人引入诉讼的程序机制,实现相关联纠纷的一次解决,可以避免裁判之间的矛盾,节约诉讼资源和成本,并且保障诉讼当事人的实体权利。第三人引入诉讼之后,在已开始的诉讼中便存在原诉和第三人之诉两个独立的诉,这样当事人可以相互之间或向案外人再提出相关联的其他请求。研究考察美国第三人引入诉讼制度,对于完善和重构我国的民事诉讼第三人制度具有重要的理论意义和制度借鉴价值。     

关于中国古代监察制度的思考

中国古代监察制度是中国古代政治制度的重要组成部分，它的发展经历了先秦时期、秦汉时期、魏晋南北朝时期、隋唐五代时期、宋元时期及明清时期。由于古代监察制度本身的缺陷加之受“人治”的影响，尽管它在加强中央集权、维护封建统治方面起了很重要的作用，但其历史局限性在所难免。借鉴古代监察制度的经验，当今我国监察制度建设，必须保证监察机构的相对独立性和较高的权威性；重视监察立法，健全监察的法律法规；严格选拔和考核监察官，不断完善监察职能。     

流动儿童与城市儿童成绩差异研究

目前虽然一些流动儿童进入了城市学校和城市儿童一起学习,接受同样的教育,他们受教育的效果却不相同。笔者利用随机调查资料,分析了小学阶段流动儿童与城市儿童语文成绩的基本情况,结果显示,1)流动儿童语文平均成绩比城市儿童要低;2)一年级学生的成绩差异最大;3)随着年级的增高,流动儿童和城市儿童的成绩差异在逐步减小。

马克思恩格斯世界历史理论所包涵的第一重生态意蕴在于:研究世界历史既要承认自然的先在性,也要看到人对自然的改造是不可避免的,从而引起普遍交往的建立,进而促进历史向世界历史转变。第二重生态意蕴在于:资本的扩张本性、资本主义生产方式的普遍化以及发达国家向发展中国家的殖民侵略造成了严重的生态问题。这些生态意蕴对我国生态文明建设有诸多启示。     

The New Zealand Model of Family Group Conferencing

The Family Group Conference (FGC) originated in New Zealand where it is the foundation stone of the Youth Justice system introduced in 1989. A significant feature of that system is the way in which it enables restorative justice principles to be implemented in an integrated manner in a statutory framework supervised by the courts and applicable to all young offenders throughout New Zealand. FGCs are used both as a diversionary technique (pre-adjudication) and at a (post-adjudication) pre-sentencing stage. In addition this type of model is now being applied in a voluntary way but on a small scale with adults. A significant feature of the FGC model is its greater use of community-based solutions with a consequent reduction in the number of young persons in state institutions.

在人类婚姻制度的发展历程中,印度的婚姻制度的发展是比较独特的,它随着印度社会的变化而演化,先后经历了从古代的种姓婚姻到中世纪的伊斯兰教婚姻,从近代英国统治下的婚姻变革到独立后的婚姻制度现代化,其发展道路坎坷曲折,其转变的过程既反映了印度时代的变迁,也明示着人类社会的进步.
