后农业税时代农地权利体系与运行机理研究论纲——以对我国十省农地问题立法调查为基础

农地权利体系是以集体土地所有权为基础,派生出土地承包经营权,集体建设用地使用权,宅基地使用权,地役权,自留地、自留山使用权和债权性农地使用权的权利体系。同时,由集体土地所有权衍生出征收征用补偿权、农民的社会保障权和成员权、土地发展权等保障农地权利实现的权利。各项农地权利的运行机理以及法律救济有其内在的特点和规律。     

析《规划环境影响评价条例》

《规划环境影响评价条例》的颁布是我国环境立法的重大进展。它对进一步规范和促进规划环境影响评价工作,切实保障在规划源头预防环境污染和生态破坏,健全环境影响评价制度具有重要意义。与环境影响评价法相比,该务例有很多亮点,但仍存在一些缺陷。针对其存在的问题,如何强化公众参与、完善规划审查、强化法律责任、增加替代方案等,将是今后条例完善应重点探讨的问题。     

论警察执法作战指挥效能评估

警察执法作战指挥效能评估,就是对警察执法作战指挥活动所产生的有利作用进行的评估。这种评估可分为“综合效能评估”和“单项效能评估”两种类型,评估主要有“定性评估、定量评估、定性与定量相结合的综合评估”三种方法,评估的步骤可分为“评估准备、评估实施”两个阶段,评估的要求是“客观、全面、可行”。掌握科学的评估方法并按要求对警察执法作战指挥效能进行评估,对于检验和评价指挥实践活动,合理地组织指挥机构和指挥自动化系统,正确地运用指挥手段和指挥方式,总结经验教训,科学地规范指挥者的指挥活动,大幅度提高作战指挥效能都具有十分重要的作用。     

The family state: a non-realist approach to understanding Indonesia’s foreign policy

ABSTRACT

The existing literature on Indonesia’s foreign policy has excluded the state from the category of an agent which shapes the country’s external affairs. This trend certainly ignores the notion that foreign policy is a unique state activity taking place in the interface between domestic and international politics. To fill the gap, this article explores the idea about the family state and looks at its influence on the conduct of Indonesia’s international relations. The argument is that the family state pursues order in international society in which sovereignty can be maintained. Indonesia plays the role of an order-maker in Southeast Asia through the Association of South East Asian Nations (ASEAN). The order-oriented actions are displayed by Jakarta’s diplomacy to resolve border disputes with neighbouring countries in the region.     

涉烟非法经营罪的司法认定初探

因非法经营罪的刑法条款规定不甚明确具体,在认定该罪时存在不同的理解和适用。本文通过分析涉烟非法经营罪认定中的三个关键问题,即"违反国家规定"的含义、非法经营行为的类型和"情节严重"的界定,对如何在司法实践中适用非法经营罪提出自己的观点,并在分析现有司法解释的基础上,提出应完善上海实践中的涉烟案件适用法律指南。     

Strategic planning on promoting Macau cultural heritage tourism

The Macau economy has developed rapidly after the handover to China in 1999; the gambling industry made a great contribution to this development and continues today. However, overdependence of the unitary industry structure is risky; hence, diversity in economic development is essential to sustainable development in Macau. After Macau was listed in the ＂world heritage list＂ in 2005, Macau cultural heritage tourism as a new concept has been promoted by the Macau Government. This paper uses SWOT analysis to evaluate the strengths, weaknesses, opportunities and threats of Macau cultural heritage tourism. The excellent guidance of promotion from the government is needed in order to successfully create a positive image of cultural heritage tourism. Suggestions to promote Macau cultural heritage tourism are given in the last part of the paper.

The Resource Center for Separating and Divorcing Families: Interdisciplinary Perspectives on A Collaborative and Child‐Focused Approach to Alternative Dispute Resolution

The Resource Center for Separating and Divorcing Families (RCSDF) is a teaching model for providing interdisciplinary services to separating and divorcing families. The model was developed by the Honoring Families Initiative at the Institute for the Advancement of the American Legal System at the University of Denver. Services are provided by graduate and law students at the University of Denver, working side‐by‐side with a supervising licensed attorney, psychologist, and social worker. The experiential and interdisciplinary model of teaching and providing direct client services is the first of its kind in the United States. RCSDF students and staff seek to empower parents to make positive decisions about their family's future in a supportive and educational environment.

Key Points for the Family Court Community
• The current system of preparing graduate and law students for careers in family law is in need of improvement. This article provides information for educators and the family law community about the impact of interdisciplinary and experiential learning for students.
• Parents going through the transition of separation or divorce experience psychological and financial stressors that can create serious behavioral and adjustment issues for their children. The RCSDF works in a holistic manner with parents and children to minimize the levels of stress and anxiety during the transition.
