文化与法律结合下的农村养老保障

在依法治国的时代背景下，中国的农村养老保障制度不仅要坚持传统“孝”文化的渗透，还应当加强“孝”文化与法律治理相结合，建立新型农村养老保障制度，以共同营造社会的和谐秩序，促进社会主义社会的进步与发展。     

RECONNECTING CHILDREN WITH ABSENT PARENTS

Reconnecting a child with an absent parent is a complex process. This article describes variables influencing the reconnection and proposes a seven-stage model for supporting successful reconnections. Case examples illustrate the discussion. Ethical dilemmas for practitioners and courts involved in reconnections are outlined. Guidelines for working with reconnections and directions for future work are proposed. Experience with the model underscores the importance of maintaining a child-centered focus and timeline, understanding safety and risk issues and implementing an appropriate safety plan, the critical role of assessment and support services, and the value of consultation and teamwork.     

Physical Violence Between Young Adults and Their Parents: Associations with a History of Child Maltreatment

This study investigated the relationship between maltreatment during childhood, parental conflict tactics and the tactics employed by young adults during a disagreement with their parents. Four hundred and sixty nine university students completed the Conflict Tactic Scale and a Childhood History Questionnaire giving details on tactics employed during the previous year and information about their childhood respectively. Overall, 14.5% of students reported using violent tactics with their mother and/or father and 3.8% of them admitted to being severely violent to one or both of their parents. The conflict tactics used by the respondent were found to be significantly related to the reported tactics of their parents and the experience of being maltreated by parents in earlier years.     

Freedom in the German School System

This article describes `freedom' as a constitutional category in the German School Law. If the responsibility for schooling by the German Federal Constitution is given to the ``Bundesländer' a common frame is set by the Basic Rights of the German Federal Constitution; this constitutional frame limits the rights of the ``Bundesländer' in supervising, organising, planning and managing the schools. Basic rights of a single pupil in a school are limited by the same rights of other pupils; this is done by following the ``principle of practical concordance' and thus the freedom of the single pupil always becomes a relative one; how this principle works in a concrete conflict will be shown in this article by describing single cases. Parental Rights are also guaranteed by the German Federal Constitution in direction of the state-runned schools. The rights of the parents are equal to the state rights; so a solution of a conflict has to be found between these two actors. Rights of teachers in Germany are limited by their special status as civil servants. And if the pedagogical freedom of teachers is recognised by the school acts this does not describe a real kind of freedom for the single teacher.

This article discusses reasonable chastisement of children as a defense by parents to assault charges. It suggests that its continued retention contravenes the rights of children and the United Nations Convention on the Rights of the Child. It compares developments in various countries, such as the Scandinavian countries and New Zealand, where the defense has been abolished, as compared with the United States, United Kingdom, Canada, and Australia, where it has been retained. It suggests that its continued retention encourages bullying and violence in schools and in later adult life.

International documents like the Declaration of the Rights of the Child (1959) and the Convention on the Rights of the Child (1989) propose that in mediating on children issues, the best interests of the child should be the primary consideration. In China, the Constitution and the Law on the Protection of Minors have already set out the terms in principle for the protection of minors, however, it has not been defined in the Marriage Law (2001). In order to enforce the commitment of respecting and safeguarding human rights, the child’s best interest principle should be established in marriage and family law, along with amending related provisions. Chen Wei is a professor of law, and director of the Research Center for Foreign Family Law and Women Theories in the China Southwest University of Political Science and Law. She is in the teachings of civil law, family law, law of succession, the history of civil law and comparative family law for years. During 2003–2004, Prof. Chen, being a visiting scholar, studied foreign family laws in the Faculty of Law, Sydney University. In academic field, she has published over 50 research articles in China and abroad; and her monograph is Research on the Legislations of Marriage and Family Law of China (2000). Further, she has taken charge of editing over 10 books, for instance, A Comparative Study of Family Laws between the Mainland and Hong Kong, Macao and Taiwan of China (2002), A Comparative Study of Foreign Marriage and Family Law (2006) and A Comparative Study of Succession Laws among the Mainland, Hong Kong, Macao and Taiwan of China (2007).     

家长认知与意愿：流动人口子女融入城市公立学校视角

流动人口的子女能否真正进入城市公立学校并融入其中，与对“身为流动人口的家长”的认识、态度和意愿是分开的。本次调查发现，“身为流动人口的家长”送他们的子女进入城市公立学校的愿望十分强烈，但对相关政策的了解不多，他们普遍认为子女进入城市公立学校不太容易，公立学校收费超过自己的经济承受能力。文章最后提出了加大资源投入、加强政策宣传、放宽入学条件三条建议。

High-conflict divorce involving children: parents’ meaning-making and agency

Most research, policy discussion and intervention is based on outsider-expert understandings that categorise divorces as well as parents enmeshed in ‘high-conflict’ disputes in polarised and individualised terms. Little, however, is known about parents’ experiences of these disputes, or how they fare in the longer term. This article draws on in-depth semi-structured interviews with 25 mothers and fathers in British Columbia, Canada, who experienced a high-conflict divorce and later came to see the experience as having been transformative despite the many difficulties they faced. Overall, the research found that positive change occurs over time when parents are supported with resources that address their particular needs and challenges. Parents change, make meaning and respond to their circumstances across the life course, thereby exercising agency. This process also occurs in a social, political and legal context that changes over time and across generations.
