Relationships between foundations and the government in the United States have long been difficult with government attitudes ranging from hostile to at best indifferent in the past. American foundations have long claimed innovation as a distinctive function to perform in society in order to preserve their legitimacy. One hundred years after the rise of the large-scale American philanthropic foundation, however, the relationships between foundations and government have come into flux. Between demands from fiscally-strapped local governments and a new openness of state and federal governments to develop collaborative relationships, a variety of public-philanthropic partnerships have emerged that question the traditional roles and distribution of labor between philanthropy and the state. This article traces the historical development of the government/foundation relationship and discusses its changing nature using recession-induced ad hoc partnerships, the emergence of foundation liaison offices, and the Obama Administration’s Social Innovation Fund and Investing in Innovation program as examples.  相似文献

The Royal Project, established in 1969, has responded to His Majesty's initiative to help the hill tribes in growing useful crops which enable them to have a better standard of living. In 1992, the Royal Project was transformed into Royal Project Foundation in order to become the public organization that can be operated efficiently as a private company. After that, the Royal Project Foundation Retail Stores or "Doi Kham" were set up to help distribute products and produces from the project and its members. However, the Royal Project Foundation Retail Stores are currently lacking of adequate marketing information to help management make the right and more aggressive decision. Therefore, this research was conducted in order to explore the consumers' behaviors and their reasons towards the purchase from "Doi Kham". Furthermore, consumer clustering and characteristics of each group are discovered. A survey of 341 current customers from 2 most crowded branches--Don Muang International Airport and Farmer Market in Bangkok--was done using self-administered questionnaire. The data obtained was then analyzed by using factor analysis, chi-square test, ANOVA and cluster analysis. The results show that majority of customers are women aged between 24-50 and having income more than 20,000 baht (around $606) a month. Most of them bought the Royal Project Foundation products from "Doi Kham" directly instead of the private-owned stores. More than one third of samples shop more than twice a month and spend moderately around 100 to 499 baht. The most popular products are temperate-climate vegetables, followed by agricultural processed food and temperate-climate fruits consecutively. Main reasons that the consumers buy the products are the product quality, standard labeling, helping welfare of farmers and hill tribesmen and brand credibility respectively. For marketing factors, the most important factor influencing the purchase is product quality and safety, followed by convenience of shopping, pricing, store service, store layout/displays and promotion consecutively. Three groups of clusters are obtained--"traditional buyers", "service-oriented buyers" and "price-concerned buyers".  相似文献

在侦查过程中,犯罪嫌疑人以外的任何第三人都有可能是强制侦查措施的对象,但对第三人实施强制侦查措施应当受法律上严格的实体及程序限制。我国现行法律对侦查机关对第三人实施强制侦查措施未作任何有别于犯罪嫌疑人的特别规定,而且第三人没有充分有效的救济途径。因此,必须在法律上对侦查机关启动对第三人的强制侦查措施设置严格的实体及程序限制,包括对第三人启动强制侦查措施必须有合理根据、必须符合比例原则,在执行强制侦查措施过程中侦查机关必须按照批准的范围执行,第三人在事后要享有充分有效的救济手段。  相似文献

司法鉴定是指在诉讼过程中,由司法机关指派或当事人委托具有专门知识的人对诉讼中的专门性事实问题做出断定的一种活动。它具有法律性、科学性和主观性三个基本特征。人类认识能力的非至上性是司法鉴定的认识论基础;多元价值的冲突与平衡是司法鉴定的价值论基础;社会分工的精细是司法鉴定的社会学基础;科学技术的发展是司法鉴定的自然科学基础。司法鉴定既有保障案件真实发现的工具价值,又承载着实现公正和效率的程序价值。司法鉴定在延伸裁判者对专门事实的认识能力和补强其它证据的证明力上发挥着重要功能。司法鉴定的三个基本构成要素是:鉴定人、鉴定结论和鉴定程序,因此系统、科学、完善的司法鉴定制度应当围绕这三个方面进行构建。  相似文献

ABSTRACT

Good governance is a value-laden concept that is characteristically nebulous; it can mean different things to different people, depending on the context in which it is used. The same applies to leadership. Concepts, as Pauw (1999a, 465) puts it, are ‘tools of thinking’ and contexts are ‘the environments or frameworks in which they [concepts] operate’. Lucidity in the meanings of concepts is fundamentally important for shaping debate and enriching discourses. To maintain their power, concepts must be used in their proper contexts. This necessitates an understanding of the art of contextual discourse. Good governance is used in NEPAD as a principle and emphasised as a sine qua non for sustainable development in Africa. On the other hand, NEPAD premises Africa's re-birth or Renaissance on good governance and leadership, with a vision and commitment to repositioning the continent in global power balances. In this article good governance and leadership are considered as concepts. NEPAD is a textual context within which the two key concepts are used and should, consequently, be engaged. The article attempts a critical review of African scholarship engagement with good governance and leadership within the NEPAD context to determine the extent to which contextual discourse is practised. It further grapples with the immediate historical background to scholarship on Africa's development between the 1960s and early 1990s. The exercise reveals that much of the accumulated body of African scholarship and scholarship on Africa's development reviewed does not suffciently contextualise discourse on good governance and leadership within NEPAD, and its key assessment and monitoring device, the African Peer Review Mechanism (APRM), and offers an alternative framework.  相似文献
