打击黑社会性质组织犯罪中的证人保护问题研究

在当前打击黑社会性质组织犯罪的过程中,证人起着十分重要的作用。然而,无论我国的立法还是司法实践都缺乏对证人应有的保护和处遇,导致目前刑事证人作证率偏低。为了改变这种状况,国家应该提供经费,建立起专门、统一的司法机构,保障证人及其近亲属的安全。     

The Australian Republic Referendum, 1999

The 1999 Australian republic referendum was intended to finalise the nation-building process begun in the mid-nineteenth century and to exploit growing national consciousness in the wake of post-World War II cosmopolitan immigration and the 1988 bicentenary. Despite strong republican support recorded by opinion polls and a broadly favourable media climate the proposal to institute a republic was defeated. The article summarises the campaign and explores some of the reasons that have been advanced, including the part played by the prime minister, for its outcome; it concludes that 'the model' might have been a contributory factor, but probably not the sole explanation. A re-run is unlikely before the election of a sympathetic, probably Labor, government. The episode illustrates the immensity of the difficulty facing republicans in Britain where similarly favourable conditions are inconceivable in the foreseeable future.     

The Impact of Timing of Exposure to Violence on Violent Behavior in a High Poverty Sample of Inner City African American Youth

A growing body of research has linked exposure to violence to violent behavior, but few studies have examined the impact of the timing of exposure to violence on violent behavior among inner city, minority youth. Theoretical insights derived from developmental psychology and psychopathology (DPP) and Agnew’s general strain theory (GST) give contrasting accounts of whether exposure to violence has a short term or long term impact on violent behavior. Five waves of data collected from African American youth living in twelve high poverty inner city neighborhoods was used to examine how the timing of exposure to violence over a four year time period impacts year five violent behavior. Multivariate results support GST’s contention that more proximal exposure to violence has a larger impact on violent behavior. The theoretical and practical implications of the findings for adolescent development in high poverty settings are discussed.

民法典草案是原封不动地将现行法编入 ,是彻底的松散式和汇编式的 ,与人民所期望的民法典差距甚大。中国应当制定一部具有逻辑性和体系性的民法典 ,1 0 0年前 ,前人已经替我们作出了选择 ,在历经百年所形成的法律传统面前 ,任何立法者和学者都是渺小的。取消“债权”概念和“债权总则编”的理由站不住脚。人格权不应单独设编 ,基本理由在于人格权的特殊本质。
