Fragmentation of licensing right, bargaining and the tragedy of the anti-commons

This paper investigates how the fragmentation of licensing right and bargaining affect the occurrence of the “tragedy of anti-commons” in the procedure of enterprise licensing. As found in this paper, if no bargaining is allowed, then greater fragmentation of licensing right can cause greater tragedy of the anti-commons. However, the bargaining between the bureaucracies and enterprise can greatly ease or even eliminate the tragedy of the anti-common under public information, but the relative bargaining power and the extent of fragmentation will affect the distribution of total surplus between the enterprise and the bureaucracies. Yet in the case of private information, bargaining itself may not work efficiently, and interestingly, lower fragmentation of licensing right might enhance the efficiency loss of bargaining, instead of easing the tragedy of the anti-commons.

司法审级中的信息、组织与治理——从中国传统司法的“上控”与“审转”切入

尽管从表面上看,中国传统司法审级中的上控与审转违反了上诉审的经济学原理,但本文的分析表明,这两种制度的出现实际上来源于古典司法复审的政治治理功能,并且在事实上构成了一种有效率的信息机制与组织替代,回应了古代社会低成本地获取地方治理信息的难题。但这些理论上合理的制度在实际的运行中也产生了许多问题,并且一直存在于当下中国的审级制度之中,其根本的解决进路只能是在国家能力建设基础上超越科层化的制度分工与审级分工。     

论信息化对侦查的异化

信息化极大地推动了侦查变革与发展．但其也存在着导致了侦查主体、侦查客体、侦查手段、侦查价值、侦查信息环境异化的倾向。信息技术的支配性、负效应扩散、信息技术虚拟化、人文机制缺失及信息迷思是侦查异化的主要原因。因此突出以人为本、注重风险评估、加强传统侦查与信息侦查融合、加强人文社会机制建设是消弭侦查异化的有效对策。     

政府预算信息公开的必要性及其推进

预算信息公开作为政府重要事项是信息公开的一项重要内容,一直是社会公众关注的焦点,也是国家民主化和法治化进程的重要步骤。当前,我国政府预算信息公开尚处于起步阶段,在政府预算信息公开方面还存在不少问题,随着人民民主法治意识不断增强,我们必须进一步推进预算信息公开的进程、深度和广度。     

Out of Sight,Out of Mind? External Voting and the Political Representation of Portuguese Emigrants

Over recent decades, emigrants have gained expanded voting rights on a global scale. Despite the normative debates about this issue, there are few empirical studies on why states decide to implement external voting and how electoral systems perform. This article seeks to fill this gap by looking at the Portuguese case. Our study suggests that a combination of political and socio-economic factors explains the implementation of external voting. On the other hand, the interests of political parties and the low level of civil society engagement are key to determining the failure of electoral reforms and the attempts to overcome the shortcomings of external voting.     

Designing Heart‐Based Systems to Encourage Forgiveness and Reconciliation in Divorcing Families

Conflicts in intimate relationships are often accidental, occasional, and unique; yet they are also systemic, repetitive, and alike. For this reason, they are amenable to systemic analysis and resolution by altering them at their chronic sources and applying the preventative methodology of conflict resolution systems design. The central difficulties with using traditional forms of conflict resolution systems design in marriages, couples, and families are that they do not effectively address the emotional meaning or significance of the conflict within the relationship; are not grounded in the heart; and do not address the intimate, relational aspects of intimate, affective conflicts. Marriages and families are deeply sensitive, highly complex emotional relationships that require systems design methodologies that are profoundly informed by the heart. This article proposes a heart‐based systems design approach that includes forgiveness and reconciliation for use in marriages and families, including those that end in divorce.

National Transparency Regimes: Rules or Principles? A Comparative Analysis of the United States and The Netherlands

Technology development and democratization have been identified as the general drivers of the worldwide thrust in transparency. But what transparency regimes do these drivers generate in different countries? This mixed method study indicates that national regimes are different due to pre-existing institutional differences and critical junctures in the historical development of transparency regimes. Our analysis shows that the U.S. transparency regime can be characterized as a rules-based approach while a principles-based transparency regime prevails in the Netherlands. This article nuances the debate about the global character of transparency and highlights two different outcomes of the push for transparency.
