Criminologists seldom have attempted to measure the severity of physical injury to victims of aggravated assault and homicide, even though it is significant to many of their research efforts. Previous attempts have been neither medically accurate nor medically acceptable. In this paper the author discusses the shortcomings of these efforts and introduces an alternative method which is valid, reliable, and medically acceptable. In addition, the author discusses its applicability to research the impact of medical intervention on violent criminal assault, on factors which contribute to the severity of assaultive injury and the lethal outcome of violent assault, on specific questions regarding the patterns of offending and victimization, and on the administration of criminal justice. 相似文献

While restorative justice has been the topic of much research, a specific type of program included in restorative justice, Impact of Crime (IOC) on Victims programs, has not been widely studied or assessed for effectiveness. This study examines IOC on Victims Curriculum Development Programs. Offenders from programs in California, Ohio, Tennessee, and Virginia were participants in this research. A four-state evaluation methodology was developed in order to assess the effectiveness of these programs in educating offenders about victims’ right and victim facts, as well as increasing their sensitivity to victims’ difficulties. The findings in this evaluation lend support to previous studies, indicating efficacy for IOC programs. Suggestions for future research are briefly discussed. 相似文献

Stalking primarily concerns the actions of individuals. However, some victims report stalking by organised groups, this being known as ‘group-’ or ‘gang-stalking’. This phenomenon has not been subject to systematic study. An anonymous questionnaire was completed online by self-defined victims of stalking. One thousand and forty respondents met research definitions for stalking, of which 128 (12.3%) reported group-stalking. One hundred and twenty-eight individually stalked cases were randomly selected as a comparison group. All cases of reported group-stalking were found likely to be delusional, compared with 3.9% of individually stalked cases. There were highly significant differences between the two groups on most parameters examined. The group-stalked scored more highly on depressive symptoms, post-traumatic symptomatology and adverse impact on social and occupational functioning. Group-stalking appears to be delusional in basis, but complainants suffer marked psychological and practical sequelae. This is important in assessment of risk in stalking cases, early referral to psychiatric services and allocation of police resources. 相似文献

我国《刑事诉讼法》将被害人确立为公诉案件当事人,被害人与人民检察院作为“共同原告”履行控诉职能,这在理论和实践中都暴露出许多问题。德国附带诉讼制度允许被害人作为附带诉讼的原告人而非公诉案件本身的当事人参加公诉,具有合理性。借鉴德国的做法,我国应增设刑事第三人制度,让被害人作为刑事第三人参加诉讼,并赋予其相应的诉讼权利,从而有效解决被害人在公诉案件中参诉问题。 相似文献
