State,Society and Markets in Argentina: The Political Economy of Neodesarrollismo under Néstor Kirchner, 2003–2007

The national Peronist social contract in Argentina has a long history rooted in syndicalism and populism. However, Menemismo in the 1990s, El Argentinazo in December 2001, and Kirchnerismo post crisis have all served to change the fundamental framework of the Argentine economy, the social underpinnings of that economy and how it intersects with global capital. This article is an attempt to identify the nature of Kirchner's administration through analysis of political economy, therefore seeking to facilitate a deeper understanding of the developmental nature and impact of the Kirchner administration of 2003–2007.     

Mediation and Culture: The Example of the ICC International Commercial Mediation Competition

The International Commercial Mediation Competition is organized by the International Chamber of Commerce (ICC) in Paris, which held the event for the eighth time in February 2013. As the competition has grown, participation has become more and more diverse and thus mediation and negotiation have become more and more cross‐cultural. This led the ICC to invite external research on culture at the competition in February 2011. In this article, I discuss this student competition, the external research project question, and the culture of the competition. I also identify some of the further cultural issues raised by referring to relevant research on conflict and mediation across cultures, and conclude with some thoughts on how better to conceptualize the field of cross‐cultural mediation in terms of a systems approach.     

Decision‐making during international crises: A reexamination

The purpose of this research note is to reexamine the methods and codings of crisis decision‐making processes performed by Herek, Janis, and Huth in 1987, and thereby to discuss the role of the case survey method as a means to build theory in the study of foreign policy. The research reported here uses a somewhat different measure of decision‐making process quality and a slightly expanded list of data sources than were used by Herek and his colleagues. It reevaluates a subset of the cases explored in the previous study. This research note largely confirms the analysis of crisis decision‐making processes presented in the previous study, though it notes and discusses some discrepancies. Furthermore, this reexamination seeks to contribute to our understanding of crisis decision‐making processes by using a different conceptualization of decision‐making process quality and thus a different coding procedure.     

见义勇为高风险的化解

由于见义勇为不是公民的法定义务,过多地从道德上谴责"见义"而不敢"勇为"的人并不能收到良好的效果。有人用《好撒玛利亚人法》作为见死不救入罪的根据,其实是一种误读。道德的高尚性可以用"真、善、美"三个字来概括,"真、善、美"这三个字所表达的内涵是一致的,为善求美也要实事求是、量力而行。倡导在见义勇为时防范、降低风险,保护自身安全,无论对社会、对见义勇为者都具有重要意义。政府应当学会多层次聚焦见义勇为的正能量,见义勇为者也应当尽可能地减少风险。     

文化视野下的中国犯罪论体系争鸣

近年来中国刑法理论界围绕传统四要件理论和德日三阶层体系孰优孰劣的争论,其实质是不同法文化的冲突,是文化冲突在刑法学领域的具体体现。这种文化冲突,既是我国刑法学理论自我反思的结果,也是自清末以来不同理论之间进行选择和论争过程的延续。围绕中国犯罪论体系的理论争鸣具有重要的文化现实意义,它有助于促进刑法学理论知识的发展,促成刑法学派在中国的早日形成,同时也有利于营造良好的学术生态环境。

商标权与商标权之间的权利冲突 ,源于权利产生过程的违法性或者权利人行使权利的违法性。在判断商标之间的权利冲突是否现实存在以及怎样解决权利冲突时 ,既要依法尊重解决权利冲突的一般原则 ,又要充分考虑商标的特点和作用 ,不能脱离市场经济秩序和消费者的合法权益去孤立地保护某种标识 ,也不能以商标注册申请是否在先作为判断商标权是否属于在先权利的唯一标准 ,此外还不应绝对地排除商标的并存。     

婚内强奸的宪法学思考

婚内强奸问题曾引起社会各界包括法学界的广泛关注和激烈争论。婚内强奸的实质是宪法中的性权利和民法中的配偶权之间的权利冲突。具体案件中，委任法官通过宪法利益衡量的方法来判断婚内强奸中的罪与非罪，是解决婚内强奸的有效路径。     

Kosovo: Where It All Began

Kosovo, a largely ethnically Albanian province of the Serbian republic, played an important role in Yugoslavia's troubles in the last two decades of the twentieth century. Shortly after Tito's death in 1980, disturbances in Kosovo set the Albanians and the Serbs on a collision course and also polarized the country politically. Ironically, when Yugoslavia began to disintegrate in 1991, and as it fell into four years of warfare, Kosovo remained relatively calm. Only after the Dayton peace, in late 1995, did Kosovo's Albanians opt for a militant policy toward the Serbs. Meanwhile Serbs escalated their oppression of the local population. International diplomatic intervention failed to defuse tensions, and ultimately, NATO initiated military action to stop Serbia. NATO prevailed in the seventy-eight day engagement in 1999, while Kosovo acquired greater autonomy and was put under UN protection.

中国女性在追求与男性的平等并自以为取得了显著绩效的同时,并未真正找到在两性社会中应有的位置。女性要获得真正的平等,必须修正长期依附于男性本位的价值标准,根据自己的能力倾向在家庭和社会的天平上摆正位置。     

普通高等院校办学理念的冲突与整合

普通高等院校办学中面临着事业与产业、象牙塔与中轴机构、自治与政府监控、教育者与服务者的两难困境。前者要求高校超然物外，后者要求高校积极入世，单纯强调其中任何一种取向都会影响高校的正常发展。化解这一困境的前提是要明确现代高等教育的定位，只有强调高等教育的文化定位，才能有效整合高等院校办学中面临的理念冲突。
