论我国海事公约、惯例和外国法的适用制度——兼评《涉外民事关系法律适用法》第十条

依据我国《海商法》的规定,海事公约、惯例和外国法在我国海事审判中具有适用效力,但是我国海事审判机关适用它们进行实体审理的案件十分罕见。这种状况明显不符合我国海运业发展现状,有损我国作为海运大国的国际形象。本文运用比较研究和实证分析的方法,对完善海事公约、惯例和外国法在我国的适用制度,从立法和司法实践角度,给出了些许建议。     

藏族环境习惯法文化与环境保护

藏族环境习惯法文化是藏族人民在长期的生活中形成的关于人与自然关系的法文化形态,藏族环境习惯法具有很强的地域性和直接适应性。发展藏族环境习惯法、倡导藏族环境习惯法文化,将对藏族地区环境保护起到积极作用。     

联合国反恐规约在我国的贯彻实施

我国政府历来重视预防和惩治恐怖主义,并与相关国际组织和国家开展了广泛的反恐合作。到目前为止,我国已经加入了绝大部分国际反恐公约。我国反恐立法的范围及主要内容在实体法和程序法中均有体现。但我国现行的反恐立法存在缺陷。应依据联合国反恐规约完善我国的反恐立法。     

论死刑的立法限制--基于国际标准的分析

限制直至废除死刑的国际标准,已在世界范围内得到普遍认同和推广.限于我国实情,当前不能废除死刑.但应立足国际人权公约标准,严格限制我国死刑立法.死刑实体立法限制表现为科学削减死刑罪名,限缩死刑适用对象.死刑程序立法限制表现为完善面临死刑者的诉讼权利、死刑执行方式与死刑减刑制度,并增设死刑赦免制度.     

Bending conventions: agency and self-portrayals in Japanese translator commentary

Abstract: The recent surge of interest in the figure of the translator has brought translator-authored writing into the spotlight in Translation Studies. Investigations into translator commentaries (in-book paratexts such as prefaces and afterwords) have generally mined them for data about translation history and procedures. Yet translator commentary also offers a potential space where translators can stake positions as cultural agents through first-person writing. This article investigates how translators present themselves in such texts, using Japanese literary translators as an example. It takes a random sample of Japanese translator commentaries from books in various literary genres, establishes their textual conventions, and then performs close readings of five commentaries to explore how translators write themselves into their text. The translators show themselves to be concerned with how their writing is received. Some use devices such as pastiches and anecdotes to entertain and inform readers, asserting their voice as writers. Others frame their identity as members of literary communities or socially conscious individuals. In so doing, they project identities as cultural agents. Consequently, this study argues that translator commentary should be re-examined in translation studies as a potential site of subjective expression and positioning in the literary field.     

论反国际恐怖主义法

从客观基础、形成发展过程两个方面论述国际法将形成新的分支,即反国际恐怖主义法。目前反国际恐怖主义法已经初具规模,我国的国际法学界已经对反对“国际恐怖主义”斗争中涉及到的重大国际法问题进行了较为深入的探讨和研究,当然对这一领域的研究还有待加强。     

联合国国际人权两公约之背景,内容与意义

联合国国际人权两以约是国际社会在人权保护方面最重要的两个公约。两公约诉产生过程,内容和执行体系,都表明国际社会在人权保护领域既普遍的共识,也有尖锐的分歧。两公约本身即是求同存异的产物,它是尽可能地融合了东西方国家对人权的不同理解,充实和发展了《联合国宪章》中关于基本人权的内容和为人权领域的国际合作提供了国际法依据。但是,人权进行国际法领域,并不意味着可以把人权作为攻击或干涉他国内政的工具,借口不人     

论《刑法修正案（八）》中的拒不支付劳动报酬罪

将违反《公民权利与政治权利国际公约》第11条作为增设拒不支付劳动报酬罪的法理障碍的主张,曲解了公约的规定。外国刑法中也有不少将拒不支付劳动报酬的行为规定为犯罪的立法例。对拒不支付劳动报酬罪构成要件中的＂劳动报酬＂,应当根据劳动法律、法规、规章等进行认定。在司法认定中应当注意区分犯罪与一般违法行为的界限。拒不支付劳动报酬罪的立法在定罪和处刑两个层面都体现了刑事和解制度的精神。     

中国入世与国际劳工标准

随着中国的入世,中国政府和工会对国际劳工组织及国际劳工标准越来越关注,并加快批准国际劳工公约的步伐。目前,中国共批准了23个国际劳工公约。面对自20世纪90年代起西方国家提出的要将国际贸易与国际劳工标准挂钩的主张,中国应该有清醒的认识,对于加快批准国际劳工公约应有自己的原则和立场。     

A Leadership Selection Index for multi-ballot political party conventions in Canada

Eugene McGregor (Journal of Politics 35, 459–478, 1973) recognized a regularity in multi-ballot leadership conventions in the United States. He hypothesized that the change in absolute votes between the first and the second ballot could be used to forecast the eventual winner of a leadership race. When the McGregor model is applied to the Canadian multi-ballot conventions the prediction rate is only 57 per cent. This paper seeks first to discuss the qualitative similarities found between these Canadian conventions and then use this as a basis to develop and to apply a model that extends on McGregor's work. The developed model is called the Leadership Selection Index (LSI). We find that the winner of most Canadian multi-ballot conventions (86%) could be forecasted after the second ballot by using the LSI method of analysis. Based on the evidence from the literature and a survey of Canadian political conventions, we develop a hypothesis of ‘two critical conjunctures' for multi-ballot leadership conventions. This hypothesis provides a suitable theoretical framework to interpret the performance of our empirical model.
