我国现行宪法章节名称之由来及评析

＂名＂是一个极其重要的范畴。宪法章节名称是一个不可回避、不容轻视的问题。我国现行宪法的章节名称,主要是对1954年宪法章节名称的继承。1954年宪法的章节名称,在多方面借鉴了前苏联宪法,但也有创造,如＂国家机构＂的章名。现行宪法的章节名称,还有完善的空间。     

The effect of weight on the femur: a cross-sectional analysis

This study assessed whether obesity significantly affects femoral shape. Femora of 121 white men were divided into two weight classes based on body mass index (BMI) of the deceased. Five external anteroposterior (AP) and mediolateral (ML) measurements were taken at consistent percentages of diaphyseal length. These were then subject to statistical tests. After controlling for age, multivariate statistics show a significant (p<0.05) effect of BMI on the femur, with the greatest significance in ML measurements. T-tests confirm these dimensions are significantly larger in the overweight (p<0.05). The effect of BMI on size-transformed and shape-transformed variables was also evaluated, with ANOVA results showing a significant BMI effect on ML size (p<0.05), but not shape. Significant size-transformed ML variables were then subject to discriminate function analyses with a cross-validation correction. Results show a correct classification rate of 88% in normal weight and 77% in overweight individuals.     

Outcomes in a low secure unit: pre-admission and post-discharge comparisons

Empirical research seldom reports on clinical outcomes within low secure services. By comparing outcome measures prior to admission and following discharge this study aimed to investigate the care pathways of patients admitted to a low secure unit (LSU). The study was conducted in an LSU and consisted of 70 patients (54 male, 16 female). Data were collected retrospectively and analysed in relation to placement security (upon admission and discharge) and admissions to hospital. Results revealed that admissions to hospital and time spent in hospital decreased post-discharge in comparison with pre-admission. Forensic patients were found to have fewer admissions than civil patients prior to LSU admission. Some differences were also observed within gender and Mental Health Act (MHA) section status for placement security. The findings demonstrated that following treatment in a LSU, care pathways may be less restrictive than prior to admission. Further, more robust research on the outcomes of LSUs is required.     

软条款信用证浅析及风险防范

信用证主要分为不可撤销和可撤销信用证两大类。然而实践中却产生了另一类UCP5 0 0所无法调整的信用证 ,即软条款信用证。软条款信用证有两个特点 :(一 )受益人议付货款时 ,除提供贸易合同规定的单据外 ,还须提供信用证加列条款的结汇单据 ;(二 )某些结汇单据是受益人 /卖方无法通过自己履约行为来获得 ,其有效性也受到买方 /开证申请人或第三方行为意志的制约。对信用证软条款的处理应以预防为主 ,并时刻注意运用合同与相关法律的规定保护自己的合法权益。     

心传导系统取材及组织形态观察的实验研究

收集32例人体心脏标本，分为两组，每组16例，介绍并比较心传导系统的不同取材方法。一组采用与窦房结、房里结长轴相垂直切面取材（横切法）；另一组采用与窦房结、房室结相平行的水平切面取材（纵切法）。通过石蜡切片，HE染色后于光镜下观察其形态结构。结果显示：横切取材较易掌握，不需间断连续切片，16例心脏在显微镜下全部显示出窦房结、房室结结构；纵切面16例心脏有7例没有取中窦房结，9例没有取中房室结，操作方法较难掌握。提倡心传导系统取材采用横切法。     

Gesetzliches Vorzugspfandrecht der Eigentümergemeinschaft nach § 27 WEG 2002 – detaillierte Forderungsanmeldung für die Meistbotsverteilung im Exekutionsverfahren

Wenn Mindest-/Miteigentumsanteile eines s?umigen Wohnungseigentümers zwangsversteigert worden sind, müssen die entsprechenden gesetzlichen Vorzugspfandrechte nach § 27 WEG 2002 sp?testens in der Verteilungstagsatzung gem § 210 EO angemeldet werden, da diese von Amts wegen nicht zu berücksichtigen sind. Die Anmeldung hat alle anspruchsbegründenden Tatsachen, n?mlich Zeitpunkt der "rückst?ndigen", f?lligen Forderungen, H?he der angemeldeten Forderungen samt Rechtsgründen sowie Bestehen der gesetzlichen Vorzugspfandrechte und deren Deckung in den Meistboten, detailliert zu enthalten. Deshalb ist eine blo? "globale" Forderungsanmeldung unzul?ssig; sie muss vielmehr so aufgeschlüsselt werden, dass die Forderungen den einzelnen WE-Objekten und den die entsprechenden Mindestanteile sichernden gesetzlichen Vorzugspfandrechten zugeordnet werden k?nnen. Sollten einzelne in Exekution gezogene Mindestanteile samt den damit verbundenen WE-Objekten keinen Erwerber finden, dürfen die durch die gesetzlichen Vorzugspfandrechte gesicherten Forderungen nicht durch jene Meistbote befriedigt werden, die für die anderen, erfolgreich zwangsversteigerten WE-Objekte erzielt worden sind.

Section 994 of the Companies Act 2006 and the Primacy of Contract

The Court of Appeal's decision in Fulham Football Club (1987) Ltd v Richards & Anor is both of interest and significance. By embracing the idea of the parties’ ability to ‘contract out’ of their statutory right to petition the court for relief under section 994 of the Companies Act 2006 (the so‐called ‘unfair prejudice’ remedy), their Lordships have not only contrived to stunt the future development of unfair prejudice as a minority shareholder remedy but, and more importantly for the purposes of this case note, their decision has reasserted and extended the contractual analogy in modern UK company law.     

论后危机时代的中美贸易摩擦及应对措施
