Article 26.1 of the Cartagena Protocol on Biosafety left open the possibility for member countries to include in their biosafety regulatory processes the assessment of socio‐economic considerations. Countries may also decide to include such assessments as part of their national legislation or regulations for the approval and deliberate release into the environment of genetically engineered technologies. Countries are debating if and how to implement assessment of socio‐economic considerations. This paper contributes to the ongoing policy dialogue by discussing issues related to socio‐economic assessment including scope, timing, inclusion modalities, methods, decision‐making rules and standards, and the integration of socio‐economic assessments in biosafety and/or biotechnology approval processes. This paper also discusses the implications of such inclusion for technology flows and public and private sector R&D. If inclusion is not done properly, it may negatively impact technology flows especially from the public sector and render an unworkable biosafety system.  相似文献

Mental health professionals frequently respond to requests for clinical information on parents in child protection cases; however, little data exist on the issues precipitating requests or on the controversial practice of offering “ultimate issue” recommendations in forensic clinical reports. We investigated 243 requests for clinical information on parents and 204 clinician reports submitted for use in child abuse and neglect proceedings in a large, urban juvenile court system. We coded 56 objective and qualitative characteristics regarding referral questions, pending legal issues, and four levels of recommendations. We found that the most common referral questions related to service planning, parenting ability, and/or parents' mental health functioning, and the most common pending legal issues were selection or change of a permanency goal and visitation arrangements. Levels of recommendations varied with type of legal decision, in that clinicians always offered direct recommendations for narrow, statute‐based issues (e.g., termination of rights, adoption) and less so for other issues. Community‐based evaluators were more likely to offer direct recommendations than court‐based clinicians. Based on the findings, we offer practice recommendations and directions for further research in forensic parenting assessment.  相似文献

环境影响评价(Environmental Impact Assessment,英文缩写为EIA)是实现可持续发展的重要工具,多数国家都要求时建设项目进行环境影响评价.我国法律要求对国家的政策、计划和规划项目进行的环境影响进行评价,目的是通过该制度把环境保护目标和措施纳入经济和社会发展的规划中,使环境因素与经济、社会因素一起,在规划形成的早期阶段得到重视.鉴于环评制度的重要意义,从环境影响评价的基本问题出发,分析环境影响评价效用以及存在的现实问题,最终提出环境影响评价制度的完善措施.  相似文献

目的引入、修订具有评估暴力危险及危险变化的暴力危险量表(Violence Risk Scale,VRS),对修订后的暴力危险量表中文版(VRS-C)进行信度检验。方法通过标准的翻译程序形成VRS-C,3位评估者独立评估14个案例以检验评分者信度,以125例来自成都安康医院监管病区、四川华西法医学鉴定中心法医精神病学教研室及华西心理卫生中心的精神疾病患者为被试,对VRS-C的信度进行检验。结果初步修订的VRS-C具有较好的评分者信度(ICC=0.80)、同质性信度(克朗巴赫α系数=0.921)、分半信度(0.906)及题总相关性(0.246~0.849)。结论初步修订的VRS-C具有较好的信度。  相似文献

The precautionary principle – which implies that where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing protective measures – has been adopted as a standard of environmental and health protection in international and European legislation. This article offers an overview of the precautionary principle as a legal standard applicable to European privacy and data protection legislation. For this reason, it takes particularly into account the guidelines of this legislation as well as the privacy impact assessment framework, raised by the European Commission through the Recommendation on Radio-Frequency Identification applications. In brief, the article stresses the role of the precautionary principle in improving privacy protection through liability, prudence and transparency.  相似文献

Privacy by Design (PbD) is a kind of precautionary legal technology design. It takes opportunities for fundamental rights without creating risks for them. Now the EU Commission “promised” to implement PbD with Art. 23(4) of its proposal of a General Data Protection Regulation. It suggests setting up a committee that can define technical standards for PbD. However the Commission did not keep its promise. Should it be left to the IT security experts who sit in the committee but do not have the legal expertise, to decide on our privacy or, by using overly detailed specifications, to prevent businesses from marketing innovative products? This paper asserts that the Commission's implementation of PbD is not acceptable as it stands and makes positive contributions for the work of a future PbD committee so that the Commission can keep its promise to introduce precautionary legal technology design.  相似文献

This study assesses the impact of a juvenile detention risk assessment instrument (RAI) on decision-making in five New Jersey counties. It uses a pretest–posttest design, drawing on a sample of decisions matched across time periods using propensity scores (N = 1,432). It suggests that the RAI, supported by other reforms, lowers overall rates of detention. Though evidence is not strong, findings suggest the RAI may have reduced reliance on “perceptual shorthand” variables reflected in the juvenile’s age and the time of day of the decision. There is stronger evidence that the RAI increased reliance on the specific factors contained within its risk score. There is also evidence that RAI reduced disparities in detention rates across counties, perhaps by diminishing the importance of “going rates” for detention, rooted in local courtroom workgroups.  相似文献
