公安信息网安全保障技术建设分析

公安信息网的安全保障体系是实现公安系统信息共享、快速反应和高效运行的重要保证。安信息网安全保障技术重点工作是“三建”、“三防”、“一保障”技术的建设。“三建”即建立涉密信息安全保障系统、公安身份认证与访问授权控制系统、公安信息网安全监控系统。“三防”要建设防火墙、防病毒系统、灾备系统。“一保障”进行保障公安信息网无线接人安全、公安信息网卫星通信接人安全、公安信息网的拨号接人安全、严格控制与公网的互联的建设。

企业的目标是多元化的,随着社会经济的发展,企业社会责任观念渐入人心.作为"企业公民",企业履行社会责任是其各项活动中的一个重要方面.会计作为经济活动计量与监督的工具,理应担负起对企业社会责任计量与监督的使命.梳理了社会责任会计的起源及发展,分析了社会责任会计信息披露的现实意义,并对社会责任会计的披露内容及方式选择和社会责任会计信息披露的监管提出了建设性的建议.     

Balancing data protection and privacy – The case of information security sensor systems

This article analyses government deployment of information security sensor systems from primarily a European human rights perspective. Sensor systems are designed to detect attacks against information networks by analysing network traffic and comparing this traffic to known attack-vectors, suspicious traffic profiles or content, while also recording attacks and providing information for the prevention of future attacks. The article examines how these sensor systems may be one way of ensuring the necessary protection of personal data stored in government IT-systems, helping governments fulfil positive obligations with regards to data protection under the European Convention on Human Rights (ECHR), the EU Charter of Fundamental Rights (The Charter), as well as data protection and IT-security requirements established in EU-secondary law. It concludes that the implementation of sensor systems illustrates the need to balance data protection against the negative privacy obligations of the state under the ECHR and the Charter and the accompanying need to ensure that surveillance of communications and associated metadata reach established principles of legality and proportionality. The article highlights the difficulty in balancing these positive and negative obligations, makes recommendations on the scope of such sensor systems and the legal safeguards surrounding them to ensure compliance with European human rights law and concludes that there is a risk of privatised policymaking in this field barring further guidance in EU-secondary law or case law.

Legal aspects of cloud security

Enterprise (large organisation) computing workloads are moving from ‘on-prem’ to ‘in-cloud’ increasingly quickly, and the cloud is forecast to account for almost half of enterprise IT by 2026, up from 10% today. But the benefits of the enterprise cloud need to be weighed against increasingly burdensome duties around cloud and data security. This comment piece provides a checklist of the sources of enterprise cloud security duties and a checklist of best practices to manage them.     

User review portability: Why and how?

User reviews of products on the e-commerce platforms are a critical determinant of inter-platform competition, as a large number of consumers base their purchasing choices on the related reviews written by other users. The network effects between the number of reviews and new users give a sustainable competitive advantage to incumbent platforms. While business literature has recognised the commercial value of the user reviews, legal scholarship has paid little attention to levelling the playing field between incumbents and new e-commerce platforms by exploring the portability of user reviews. This paper bridges this gap. We explore the possibility of porting user reviews through two legal mechanisms—first, traditional Intellectual Property law; second, the new Right to Data Portability (RtDP) as enshrined in the GDPR. After recognising the limitations of these mechanisms in enabling the portability of reviews, we suggest that pure data aggregators, such as Personal Information Management Services (PIMS), are best placed to make user reviews available to multiple platforms.

本文是对现行中国著作权法中,邻接权人"通过信息网络向公众传播"的权利的规范分析。主要有以下观点:第一,《著作权法》中的"信息网络传播权"是著作权人的权利,与邻接权人无涉;第二,表演者只能授权他人通过信息网络向公众传播其表演的权利,而不可能单独享有"自己通过信息网络向公众传播表演"的权利;第三,《著作权法》在录音录像制作者"通过信息网络向公众传播"的权利的规定中,出现了漏洞;第四,区分通过信息网络"传播"与"发行"的关键在于理解音像制品与载体、有形载体和无形载体的区别;第五,广播组织不应该享有类似权利。     

对巴基斯坦等国人员持用"F"和"L"签证情况及违法活动的调查

外国人在沪违法犯罪现象逐年增多,巴基斯坦、伊朗、孟加拉等国家人员持用"F"和"L"在沪犯罪人数的比例占居来沪外国人犯罪人数的首位,弄虚作假,诈骗他人钱财;持用假护照或无有效签证,在沪非法居留.公安机关出入境管理部门应严格把好签发签证的关口,加强情报信息的收集工作,加强法制宣传,严厉打击外国人犯罪活动.
