企业刑事合规的程序应对

在刑事合规的制度设计中,程序法承载了治理犯罪、保护权利、提升经济效率等多项重要职能。当前,全球范围内企业合规的刑事程序运行呈现出如下发展态势:立案管辖范围扩张,侦(调)查措施更加灵活多样,检察官主导实现多样化的诉讼激励,刑事合规的司法审查逐步加强,律师充分参与刑事合规得到保障。我国刑事合规的理论研究逐步兴起,实践中企业合规试点单位进行了相应的刑事程序改革与探索。随着刑事合规的全面深入发展,我国刑事诉讼程序应从立案、侦查、起诉、审判、辩护等多个环节进行系统、科学改造,以满足企业合规对刑事程序的实质需求。     

To be or not to be Charlie Hebdo: ritual patterns of opinion formation in the social networks

The social sciences have mostly focused on the formation of social opinions from a semantic point of view: given a certain semantic field, interviews, statistics, and other analytical instruments are commonly deployed in order to map the distribution of views, their evolution, their conflicts and their agreements. Socio-semiotics, social semiotics, and the other semiotic branches that bear on social inquiry have contributed to the effort by providing semiotic grids of categorization. These grids too, however, have been mostly related to semantic contents circulating through societies and their cultures. The present article pursues a different hypothesis. After briefly recalling the events of 7–9 January 2015 in the Parisian area, the article seeks to survey and map the syntax of progressive differentiation of opinions circulating in the social networks about such events. Some patterns are identified and semiotically described: (1) cleavage; (2) comparative relativizing; (3) blurring sarcasm; (4) anonymity; (5) unfocused responsibility; (6) conspiracy thought. A new semiotic square is created to visually display these patterns, their positions, their relations, and their evolution.     

Cross-Regional Trends in Female Terrorism

Worldwide, women have historically participated in terrorist groups but their low numbers and seemingly passive roles have undermined their credibility as terrorist actors for many observers. This analysis contends that female involvement with terrorist activity is widening ideologically, logistically, and regionally for several reasons: increasing contextual pressures (e.g., domestic/international enforcement, conflict, social dislocation) creates a mutually reinforcing process driving terrorist organizations to recruit women at the same time women's motivations to join these groups increases; contextual pressures impact societal controls over women that may facilitate, if not necessitate, more overt political participation up to, and including, political violence; and operational imperatives often make female members highly effective actors for their organizations, inducing leaders toward "actor innovation" to gain strategic advantage against their adversary.     

Spaced cognitive interviewing: Facilitating therapeutic and forensic narration of traumatic memories

Abstract

The evolution of the cognitive interview (CI) is reviewed from the original package of memory-enhancing techniques through to the revised (or enhanced) CI, and the cognitive approach now taught to police officers in UK. Many officers are reluctant to apply CI, particularly to traumatised victims. The traumatising effects of crime are examined in terms of immediate response and the potential for an acute stress response and post-traumatic stress disorder, with subsequent re-experiencing of dissociated traumatic memories in the form of intrusive, unwanted imagery. Traumatic memories are described, particularly their accuracy, detail and persistence. The therapeutic potential of prolonged experience of distress while narrating the content of traumatic imagery is explained. An approach to maximising the disclosure of dissociated detail - spaced cognitive interviewing (SCI) - is described and case material presented illustrating its forensic and therapeutic application. The practice and practical implications of SCI are summarised.

人格因素作为应激过程的心理中介因素,通过认知因素和应对因素的作用在一定程度上影响应激反应类型、强度和对应激的耐受能力,调节着刺激与应激反应之间、心理应激与疾病之间的关系。因此,在使用艾森克人格问卷对在押人员人格特征进行测查基础上,分析了在押人员人格特征与其在羁押环境下心理适应之间的关系,并提出了完善人格特征,提高心理适应性的相关举措。     

OpenLV: Empowering investigators and first-responders in the digital forensics process

The continuing decline in the cost-per-megabyte of hard disk storage has inevitably led to a ballooning volume of data that needs to be reviewed in digital investigations. The result: case backlogs that commonly stretch for months at forensic labs, and per-case processing that occupies days or weeks of analytical effort. Yet speed is critical in situations where delay may render the evidence useless or endanger personal safety, such as when a suspect may flee, a victim is at risk, criminal tactics or control infrastructure may change, etc. In these and other cases, investigators need tools to enable quick triage of computer evidence in order to answer urgent questions, maintain the pace of an investigation and assess the likelihood of acquiring pertinent information from the device.This paper details the design and application of a tool, OpenLV, that not only meets the needs for speedy initial triage, but also can facilitate the review of digital evidence at later stages of investigation. With OpenLV, an investigator can quickly and safely interact with collected evidence, much as if they had sat down at the computer at the time the evidence was collected. Since OpenLV works without modifying the evidence, its use in triage does not preclude subsequent, in-depth forensic analysis. Unlike many popular forensics tools, OpenLV requires little training and facilitates a unprecedented level of interaction with the evidence.

从南宁市严峻的社会治安形势、群众对公安工作的要求与期盼,以及公安机关自身建设等方面来看,建立公安机关快速响应机制十分必要。根据国外警务快速响应模式的经验,结合南宁公安机关快速响应方面存在的问题,应从资源整合、技术革新、警务站建设、情报信息引领警务和运用民间保安力量等多个层面构建南宁市公安机关快速响应机制。     

行政回应的哲学解读

行政回应是现代政府的重要制度及理念,从哲学层面上解读,它具有主体性、公共性、约束性和相融性的内涵。行政回应的哲学特性决定政府应该以扮演表现性角色、反映公民诉求、对公民负责和为公民服务为价值目标。行政回应的哲学认知与制度建构的结合有利于发挥行政回应的制度功能。     

全球化语境与行政法国际化

在全球化的深入发展中,传统上属于国内公法的行政法也呈现向域外扩张的趋势,行政法国际化已经不再仅仅流于纯粹理论上的探讨,而是在实践中已经有某些迹象可循。行政法国际化分为两种实现方式,其最终结果就是作为相对独立意义上的国际行政法体系的产生。因为私人主体一方的参与,新兴的国际行政法体系是对传统国际、国内二元对立结构的颠覆。中国应该积极参与到行政法国际化的进程中去,避免在其中话语权的旁落。新兴的国际行政法必然会催生我国的国际行政法学科产生,至少首先会在行政法学领域产生相对独立的研究领域,我国学界应当对此引起重视。
