司法谦抑：司法权威的道德基础

树立司法权威对于法治国家具有重要意义,司法权威不仅需要司法独立的外部制度保障,而且需要司法谦抑作为内在的道德支撑。司法谦抑的品性源于司法机关的特殊地位、司法权的行使方式和法官的职业特点。司法谦抑能够弥补司法权民主性的不足,增强司法裁判的说服力,消减公众对司法骄横的疑虑,从而为树立司法权威提供道德基础。     

Shooting the fox? UKIP’s populism in the post-Brexit era

Abstract

The UK Independence Party (UKIP) has moved from being a single-issue party par excellence to a broader party of protest, taking advantage of wider feelings of discontent and disconnection. However, the 2016 referendum on UK membership of the EU fundamentally challenged its development and operation, by removing a core part of the party’s rationale and identity, and radically shifting the overall political landscape. This paper considers the re-positioning through the referendum period, both rhetorically and organisationally. Drawing on party press releases and media coverage, the paper argues that UKIP has become caught in a set of multiple transformations, pushing it in the longer term towards a more conventionally populist position in a way that carries important resonances for other Eurosceptic parties across the continent.     

Achievements of the British Colonial Service: A Retrospective View

This article looks back on the record of the British Colonial Service in Africa, with a particular focus on how it ran Zambia immediately prior to its independence in 1964. The author, a member of that service, argues that, for all their faults, British colonial administrators discharged their duties with dedication, skill and the welfare of the general population in mind. There is, he notes, a need for a better understanding of the positive effects of contact between cultures that British colonial rule engendered in societies such as Zambia.     

Are “We” More Punitive than “Me”? Self-Construal Styles,Justice-Related Attitudes,and Punitive Judgments

Cross-cultural as well as procedural justice research suggests that an interdependent self-construal is connected to more justice-related concerns, more moral outrage following observed unethical behavior, and a preference for effective but constructive sanctions. Independent self-construal, on the other hand, is expected to be connected to weaker moral reactions toward injustice, but also to preferring punitive over constructive forms of sanctions. Two studies were conducted in which dispositional self-construal was measured. In Study 2, self-construal was also manipulated with a priming procedure. Results show that interdependent self-construal is connected to stronger emotional reactions toward injustice, to social and moral concerns, to preferences for constructive forms, but also to retribution-oriented goals of punitive sanctions. Independent self-construal, on the other hand, goes along with fewer moral concerns, lower punitiveness, but more draconic attitudes.

检察独立与检察一体,是现代检察制度创设的关键。检察独立既包括检察机关独立,也包括检察官独立,欧陆国家大多数采用检察一体下的检察独立,我国因国家组织体制的不同,检察独立制度尚未确立,面对司法独立的紧迫性,改革并确立检察独立的现代检察制度,是我国检察机构改革的关键。     

The canary in the data mine

The present article aims at portraying the type of profile best required to fulfil the function of a Data Protection Officer (DPO) within the EU public sector. The article proposes the idiom of the “canary in a coal mine” as best positioned to describe the multidisciplinary role of DPOs. Due to the particularity and sensitivity of their function, Data Protection Officers act as early indicators of data protection incompliance within their respective area of expertise. Only when being functionally independent, Data Protection Officers could master the role of “canaries in the data mine” thus preventing possible data protection breaches and violations.     

维稳压力对基层法院组织形态的形塑

维稳压力是形塑中国法院组织形态的重要因素。在维稳工作中,基层法院与地方党政系统形成紧密的互需关系。一方面,基层法院通过行使审判职能和延伸审判职能的方式参与地方维稳工作;另一方面,在案件审理执行以及涉诉信访工作中,基层法院也需要地方党政系统的支持。在维稳压力的影响下,基层法院的组织形态进行了调适,形成以案件属性转化、责任体系再造、组织运行重构为主要内容的运作机制。经过调适的组织形态在很大程度上提升了基层法院应对维稳问题的能力,不过法官独立行权空间受到一定程度的限缩。在基础性社会矛盾突出的转型期,基层法院组织形态的建构与运行依然会建立在对维稳压力审慎考量的基础之上。     

Britain's Oddest Election?

Fringe political parties did well in the European Parliament elections in June 2005. The British National party won their first seats; altogether, four in ten British voters supported a party not represented in the House of Commons at Westminster. YouGov questioned more than 32,000 electors at the time of the election, in order to find out who voted for each party and why: the sample was big enough to enable robust analysis to be done on the BNP, UKIP and Green vote, as well as the supporters of Labour, the Conservatives and the Liberal Democrats. YouGov's findings show that there was disillusionment with the traditional main parties, and fears for the future, that were felt by voters across the political spectrum, and not just the supporters of the fringe parties.
