全程同步录音录像制度研究——以刑诉法《草案》第120条为引子

全程同步录音录像在检察院职务犯罪案件侦查中已得到广泛应用,并取得了一定效果,但公安机关在"双录"的应用情况存在着明显差距。为了在公安机关侦查讯问中推行"双录",应完善法律对"双录"的规定,引导公众正确区分正常讯问和非法讯问,提高侦查人员的审讯素质,改变侦查讯问人员对"双录"的错误观念,对重点案件实施"双录"。     

思想政治教育的社会向度与文化意义

社会转型、社会生态、社会控制、社会认同等揭示了思想政治教育的社会性。文化与思想政治教育亦存在紧密的联系。社会关系结构和文化关系结构为思想政治教育创设了叙事情境,且从社会和文化上规约着思想政治教育的行为主体;互动进程则从实践和变化上诠释了思想政治教育动态,并可能重塑社会关系与文化关系,使思想政治教育系统得以维系。     

当代中国公共服务实践反思:公共服务全程评估的意义

本文首先概括了当代中国公共服务实践中存在的诸多“怪相”,并把“怪相”归为公共服务需求、供给和结果三类问题,而问题的根源在于公共服务体制缺陷。然后,从公共服务过程的角度,提出公共服务全程评估的概念,即对公共服务需求一供给一结果整个过程的评估,并认为公共服务全程评估,是既定公共服务体制下的一种可行的公共服务改革策略,也是改善公共服务的一种机制保障。     

转型时期的农民工住房问题——一种政策过程的视角

从政策过程的视角论述农民工住房问题纳入国家政策层面的可行性,可为解决农民工住房问题提供政策方向。本文从杜布林冲突的系统分析模型出发,建构“黑匣子”公共政策过程分析模型,并运用成本-收益分析、政府分权理论等,从政策执行的角度来检验政策方案。通过政策输入过程分析,识别形成农民工住房问题的实质因素,并分析农民工住房问题转变为政策问题的实践约束条件。通过对政策执行约束条件的分析得出：农民工住房政策的逻辑起点不是农民工住房质量,而是附加在户籍制上的城乡二元体制结构。研究认为农民工住房问题本身无法作为良好的政策问题纳入中央政府决策范围。建立农民工住房保障体系并允许农民工有条件地享受城市住房保障政策,或直接取消城乡二元结构,都不是解决农民工住房问题的最优政策,但前者作为渐进的决策途径,还是有助于缓解社会转型矛盾的;政府应当制定改革户籍制的长远目标,并在此框架下坚持改革和创新,逐步实现住房保障的城乡一体化。

行政过程中相对人程序性权利的价值

行政相对人的概念已逐步被人们所接受,对其进行更深入的研究是行政法学进一步发展的需要。现代社会对人权的普遍重视反映到行政法中就要求我们尊重和保护行政相对人权利。而现在对行政相对人权利的研究大多是在立法领域与司法领域中,时行政过程中相对人权利的研究却不多,因此,有必要对行政过程进行界定,在此基础上,对行政相对人程序性权利的价值进行分析,目的在于明确其在行政法学理论与实践中不可缺少的地位。程序性权利作为一项没有引起人们足够关注的权利,必将随着人权观念和公民权利观念的发展而日益深入人心。     

抗日战争与中国共产党的现代化进程

抗日战争时期,中国共产党及其领导的抗日军民是全民族抗战的中流砥柱。中国共产党在根据地的局部执政与领导抗日战争胜利的实践过程中,得到了多方面发展,推进政治民主化,政治上逐渐走向成熟;党的指导思想的确立和整风运动统一了全党的思想和意志;提出持久战的战略方针与制定人民战争的路线使得组织上取得了有效地发展和壮大。这对中国共产党的现代化进程具有深远的历史影响,中国共产党在抗日战争时期的成熟、壮大,是中国共产党现代化进程中的很重要的转折点。     

Why Nations Fail: The Origins of Power,Prosperity and Poverty

This study addresses compliance and business practices at the local level subsequent to the international adoption of the Kimberley Process Certification Scheme by states and the adoption of the voluntary System of Warranties by the diamond industry. This paper also explores the distance between norm creation, norm sustainability and norm expansion. Interests of various stakeholders led to the creation of international norms, and evidence supports widespread compliance at the state level. Data gathered at the local level of retailer suggests, however, that the regulatory system is not leading to the education of consumers that potentially transforms beliefs. Central to understanding the challenge of deepening and broadening new global norms is exploring the distance between compliance within the regulatory regime and the awareness or change of beliefs of stakeholders. Recommendations include steps to make the process of bringing diamonds to market transparent and available to public scrutiny.     

Process Management as a Contagious Idea: A Contribution to Røvik's Virus-Inspired Theory

‘Travelling ideas’ denotes the fact that virtually identical management ideas crop up more or less simultaneously in similar organizations. Røvik, who recently launched his ‘virus-inspired theory’ approach, seeks to pinpoint the possibility that the encounter between idea and practice may be lasting, ideas may affect practice, and leaders in organisations may play a more active role than the one often depicted in management fashion theory. This article is a contribution to his virus-inspired theory. It focuses on processes in their pragmatic form, as value-creating flows in organisations. We have studied Process Management (PM) as an idea, and how it has penetrated and flourished in the Swedish Customs Service. We argue that the empirical test in this article supports Røvik's belief that a virus-inspired theory gives a richer picture than the fashion theory. Through our analysis we show that four of our six hypotheses, derived from the virus-inspired theory, are strengthened by the empirical story from the Customs Service.     

Mediterranean Security Revisited

At the dawn of the last century, the European and Mediterranean countries failed to reach a consensus on building a cooperative security system. This article is an attempt at revisiting the concept of the Mediterranean security system and assessing the conditions for restarting security dialogue in the region. Upon recognition of the need for taking into account the new dimension of risks along with the traditional dimension of threats, the article reviews the insecurity factors of the Mediterranean region and the lesson learned in the security dialogue of the Barcelona Process. Some proposals about rehearsing that dialogue are advanced in the concluding section.
