简论区域经济宏观调控的几个关系

协调区域经济发展是政府的重要职责 ,在缩小区域发展差距问题上 ,必须充分发挥政府的调控作用 ,通过市场调节与政府宏观调控结合 ,促使区域经济发展差距缩小和协调发展。在区域经济发展宏观调控中 ,中央政府调控与地方政府调控各自发挥着它们的作用 ,它们彼此是不能互相替代的     

论宪法规定公民权利宜用禁止性规则

虽然各国宪法对公民权利实际上有两种规定方式,一是采用禁止性规则,二是采用授权性规则,但从理论上分析,宜采用禁止性规则.从宪法学上来讲,禁止性规则符合宪法乃授权于国之法、权利先于宪法、宪法控制权力的观念;从立法学上来说,禁止性规则更能表达防范国家权力可能侵犯公民权利的目的;从解释学上来看,禁止性规则能够消除"宪赋人权"的误解.     

To block or not to block: European approaches to content regulation,and implications for freedom of expression

Based on the limited effectiveness of state laws, and lack of harmonization at international level a number of states started to introduce policies to block access to Internet content and websites deemed illegal which are situated outside their legal jurisdiction. However, blocking policies are not always subject to due process principles, decisions are not necessarily taken by the courts of law, and often administrative bodies or Internet hotlines run by the private sector decide which content or website should be subject to blocking. Therefore, increasingly, the compatibility of blocking action is questioned with regards to the fundamental right of freedom of expression. This article assesses significant developments at the pan-European level with regards to the development, and implementation of Internet content blocking policies. Adaptation of content blocking policies from certain member states of both the European Union and the Council of Europe will be used to assess the nature and implementation of access blocking policies. It will be argued that there could be a breach of Article 10 of the European Convention on Human Rights if blocking measures or filtering tools are used at state level to silence politically motivated speech on the Internet.     

法经济学视野下的金融监管法正义性分析

正义历来是法律所追求的价值目标之一,但其从来都不是空洞和抽象的,需要用具体的方法和标准对其进行诠释和分析。在金融全球化趋势日益加深的今天,从法经济学的视角,对金融监管法的正义性价值目标进行分析和诠释,对于进一步完善我国金融监管法体系,维护我国金融安全与稳定意义深远。运用法经济学的分析方法,从立法、执法和司法三个方面对我国现行的金融监管法进行分析,以促进我国金融监管法正义价值目标的最终实现。     

国家宏观调控对广西投资的影响与对策研究

投资已成为促进广西经济发展的主导性动力，但国家宏观调控对广西投资的影响日益显现，反映在土地审批、信贷政策、财政政策、产业政策、项目核准等五个方面。针对这些影响，文章提出了适应国家宏观调控，扩大广西投资规模的对策，包括正确引导资金投向，统筹重大项目建设，积极拓宽融资渠道，解决建设用地问题，加强投资运行监控，创造一流投资环境。     

加入WTO后发展我国外贸运输服务业的对策

随着我国加入WTO，对外贸易交往越来越频繁，我国的外贸运输服务业也随之发展起来。虽然我国外贸运输服务业取得了显著的改革成果，但是也存在一些问题，如市场秩序混乱等，这些因素阻碍了我国外贸运输与国际市场接轨，成为人们注目的焦点。作者在文中首先分析了我国外贸运输业发展现状，然后从三个层面比较其与国际惯例接轨的差距，最后就我国外贸运输如何适应WTO，从多个角度提出建议。     

试析我国反垄断立法的必要性及规制对象

反垄断法是经济法的核心,有“经济宪法”之称。但直到目前,我国仍无一部反垄断法。本文试根据垄断的含义、特征、正负用及其经济学理论依据,分析我国制定反垄断法的必要性和紧迫性,并指出我国反垄断立法的规制对象应是经济垄断中的垄断行为而不包括垄断结构,更不包括中国所特有的行政垄断。     

从网络性爱看未成年人性道德教育的紧迫性

随着互联网技术的更新换代,充斥网络的视频、音频聊天等方式的“网络性爱”成为引人关注的问题。由于目前未成年人性教育渠道不通畅,性信息的获取主要来源于网络。网络色情泛滥,各种成人网站的开放对身心正处于发展期的未成年人产生了性道德价值迷惘、自我迷失、网络色情强迫症等消极影响。从目前网络现状及相关法律法规来看,建立网络分级和身份认证制度是未成年人性道德教育的可行性途径。     

The Future of the British Post Office

Recent proposals of the U.K. government to privatize the British Post Office are considered in relation to broader European trends and in terms of economic efficiency. The proposals appear to open the possibility of moving away from a geographically uniform tariff that conflicts with proposals from the EU Commission for the EU, as well as reducing the postal monopoly. Uniform postal charges may or may not improve economic welfare, as there are clear-cut conditions under which their welfare effect can be positive or negative. A practical mechanism is suggested to allow the postal monopoly to be challenged by alternative suppliers without encouraging cream skimming.     

政府采购制度与体育产业化

政府采购是市场经济条件下国家实行经济管理的一种重要方式,建立和完善政府采购制度,是现代各国的共同作法,也是 WTO 的要求。体育产业化作为我国体育事业市场化改革的必然趋势客观要求实行政府采购制度,而政府采购制度的实施对促进我国体育产业化的健康发展具有相当重要的作用。目前我国关于体育设施和服务方面的政府采购制度还有待完善。
