谈学校与学生之间的法律关系

学校与学生之间的法律关系,从本质上说就是学校与学生之间的权利和义务的关系,其核心是学生权利范围及其法律保障问题。关于这一特定法律关系的理论主要有行政法律关系、民事合同法律关系、双重法律关系。在我国教育司法制度中,在学校和学生的法律关系至今尚无明确规定的情况下,文章通过对有关理论的探讨,试图找到一种思路,对研究问题提供借鉴。

Interpersonal Sensitivity, Romantic Stress, and the Prediction of Depression: A Study of Inner-City, Minority Adolescent Girls

The role of interpersonal sensitivity in the relation between romantic stress and depression was examined in 55 adolescent girls from an inner-city high school. Depression, interpersonal sensitivity, and chronic and episodic romantic stress were measured at two time points, 6 months apart. Interpersonal sensitivity was found to moderate the longitudinal relation between romantic stress (both chronic and episodic) and depression. In contrast, interpersonal sensitivity did not potentiate depressive responses to non-romantic interpersonal stress, suggesting particular importance of stress in the romantic domain for adolescent girls. Results indicate that girls' sensitivities to romantic relationship stress should be specifically addressed in depression prevention and intervention programs.Received her PhD from the University of Southern California. 列宁对农村干群关系问题的探索

列宁正确论述了人民内部矛盾的非对抗性;把反对官僚主义作为改善党群、干群关系的最主要的一环;把倾听农民呼声,尊重农民利益作为化解干群矛盾的重要前提;重视人民信访工作,加强干群之间的沟通。列宁在探索中也存在一些缺陷,但是他的探索为我们今天解决农村干群矛盾提供了借鉴和参考。     

Psychosocial Correlates of Intimacy Achievement Among Adolescent Fathers-to-Be

We investigated the relation between urban psychosocial stressors and intimacy achievement in a sample of 59 African American, Hispanic American, and White adolescent fathers-to-be. Participants received an intimacy score based on Orlofsky's Intimacy Status Rating Scale. Those with higher cumulative psychosocial stressors had lower levels of intimacy. One psychosocial risk factor, low interpersonal empathy, was significantly associated with intimacy levels. African Americans had lower levels of intimacy than Hispanic or White participants.     

Assessing Readiness to Change among Perpetrators of Intimate Partner Violence: Analysis of Two Self-report Measures

Recent interest in the construct of motivation to change among male perpetrators of intimate partner violence (IPV) has led to development of two self-report measures of this construct: the University of Rhode Island Change Assessment for Domestic Violence (URICA-DV; Levesque et al. 2000) and the Safe at Home Inventory (SAH; Begun et al. 2003). We examined the internal structure of these instruments using confirmatory and exploratory factor analyses in a sample of 199 male IPV perpetrators waiting to begin court-mandated batterer intervention programs. Results indicated that the scales had adequate internal consistency. However, using confirmatory factor analyses, the hypothesized structural models of each instrument fit the data poorly. Subsequent models suggested by a series of exploratory factor analyses failed to improve model fit substantially for both scales. For the URICA-DV, a 3-factor model including items from the Precontemplation, Contemplation, and Action subscales fit the data adequately. No acceptable model fit could be found for the SAH. Intercorrelations among similar subscales across the two inventories suggested only a modest degree of intercorrelation (r’s = 0.16–0.52), and a factor structure more dependent on scale of origin than item latent content, suggesting that the scales assess different facets of the readiness to change construct. These results suggest that before the stages of change construct can be fully applied to the IPV area, more research and evaluation are needed on how to accurately assess abuser readiness to change.     

Insecure Attachment Mediates Effects of Partners’ Emotional Abuse and Violence on Women’s Relationship Quality

Men’s emotional abuse and violence have a broad and pervasive impact on women that may include long-term effects on women’s attachment and relationship quality. In this longitudinal study, women’s Wave 6 ratings of their insecure attachment were hypothesized to mediate the relationship between partners’ Wave 5 abuse (emotional and physical) and Wave 6 relationship quality, with differences in associations by women’s Wave 5 self-classification as secure or insecure. Mediation was tested with data from a sample of 574 African American, Euro-American, and Mexican American community women who had completed at least three waves of a six wave study. Differences occurred in the final structural equation models by women’s Wave 5 attachment style, with direct paths from emotional abuse to insecure attachment and from violence to relationship quality for both groups, but direct effects of violence on relationship quality only for insecurely attached women.

传统行政法学是以行政活动的法律形式为核心建构的体系。但是,现代社会利益冲突的复杂化与行政活动方式的多元化发展趋势,导致行为形式理论在法律事实的认知与解释的功能上均明显弱化。而法律关系理论则能够提供有关法律现象的全方位观察视角,并适合不同的社会利益关系结构与私人权利基础之分析和论证。因此,法律关系理论可作为行政法学体系建构的另一主要支柱,以分担行为形式理论在法体系中的过重负载。     

Examining Factors Co-Existing with Interpersonal Violence in Lesbian Relationships

Interpersonal violence within lesbian relationships is a significant yet understudied problem. Women attending a gay pride festival in Atlanta, GA, were asked to complete a survey concerning same-sex interpersonal violence. Women who reported being in a current or previous same-sex partner relationship were included in the analyses (N = 226). Factors that occurred in the context of interpersonal violence were investigated: substance use, HIV/STI risk behaviors, barriers to reporting abuse, and attitudes inhibiting seeking of social support. In addition, the survey assessed relationship-related power dynamics. Results of multivariate analyses support the hypotheses that power imbalance and inequality when making sex-related decisions within women’s same-sex relationships are associated with interpersonal violence. Further findings suggested that a combination of factors must be considered when dealing with and reducing the risk for violence in same-sex relationships.
