20年中国法理学的嬗变及其时代课题

要克服中国法理学在嬗变中存在的缺陷，重塑科学精神，必须处理好本土化与国际化、制度研究与过程研究、现实主义与理想主义、核心问题的拓深与边缘领域的拓展等四大关系。     

Intimate Partner Violence,Psychological Distress,and Suicidality: A Path Model Using Data from African American Women Seeking Care in an Urban Emergency Department

Intimate partner violence (IPV) and suicidal behavior are major public health problems in the African American community. This study investigated whether or not IPV and suicidal ideation are correlated in urban African American women, and if the IPV–suicidal ideation link is explained by symptoms of depression and posttraumatic stress disorder (PTSD). With 323 abused African American females, path analysis revealed that: (1) IPV → depressive symptoms → suicidal ideation, and (2) IPV → PTSD symptoms → depressive symptoms → suicidal ideation. When evaluating abused women, depressive and PTSD symptoms and suicidal thoughts must be assessed. Interventions for reducing suicidal behavior in abused, low income African American women should reduce symptoms of depression and PTSD.     

Supervisor Relationships,Teamwork, Role Ambiguity and Discretionary Power: Nurses in Australia and the United Kingdom

This paper reports comparative research comparing the relationship between supervisor-subordinate relationships, teamwork, role ambiguity and discretionary power for nurses working in public and private sector hospitals in Australia and the UK. The findings indicate that the four factors accounted for approximately a quarter of the variance for nurses in the UK and almost a fifth of the variance for nurses working in public sector hospitals. Moreover, the findings identify a significant difference across all variables for nurses working in public sector hospitals compared with private sector with nurses in the private sector having higher satisfaction levels and perceiving lower levels of role ambiguity. There were fewer differences for nurses working in Australian hospitals compared with UK hospitals with nurses in Australia perceiving a better supervisor-subordinate relationship and nurses in the UK perceiving greater satisfaction with teamwork.

East Asians’ Social Heterogeneity: Differences in Norms among Chinese,Japanese, and Korean Negotiators

East Asian cultures are widely held to be fairly homogeneous in that they highly value harmonious social relationships. We propose, however, that the focus (dyadic versus group) and the nature (emotional versus instrumental) of social relations vary among the Chinese, Japanese, and Korean cultures in ways that have important implications for the negotiation tactics typically employed by managers from these three cultures. Our data are from a web survey administered to three hundred eighty‐eight managers from China, Japan, and South Korea. In this article, we discuss how the differences in the focus and the nature of business relationships in China, Japan, and Korea are manifested in the different norms for negotiation tactics endorsed by managers from these three countries.

公平是具体的,而不是抽象的,它是在人类社会历史发展中产生的。它作为一种主观价值评判,是对现存经济关系的反映。因此,要实现真正意义上的公平,必须从根本上消灭阶级和阶级差别。同时,公平的实现需要发挥社会调剂功能。在当今中国,公平观应该而且必须与我国现实生产力、生产关系的发展相适应,它的科学性合理性依赖于制度的建设和法规的完善,我们要学会运用马克思主义历史唯物主义的方法论和原则去研究分析公平问题。     

The Relationship of Acculturation and Social Integration to Assaults on Intimate Partners Among Mexican American and Non-Mexican White Students

This study examined the role that Mexican ethnicity, acculturation into Anglo American society, and social integration play in intimate partner violence among a sample of 348 college students. The results indicated that Mexican American ethnicity and acculturation into Anglo American society by Mexican American college students had no relation to intimate partner violence. However, integration into society was associated with a decreased probability of severely assaulting a partner among both Mexican Americans and Non-Mexican Whites. The results support a control theory perspective (social integration) on intimate partner violence.     

THE PREVENTIVE EFFECTS OF ARREST ON INTIMATE PARTNER VIOLENCE: RESEARCH,POLICY AND THEORY*

Research Summary: This research addresses the limitations of prior analyses and reviews of five experiments testing for the specific deterrent effect of arrest on intimate partner violence by applying to individual level data consistent eligibility criteria, common independent and outcome measures, and appropriate statistical tests. Based on 4,032 cases involving adult males who assaulted their female intimate partners, multivariate regression analyses show consistent but modest reductions in subsequent offenses targeting the original victim that is attributable to arresting the suspect. Although the reductions attributable to arrest are similar across all five studies, other factors, such as the suspect's prior arrest record, are stronger predictors of subsequent offenses. The effect of arrest is also modest compared with the general decline in offenses toward the same victim during the follow‐up period. Policy Implications: These results lend limited support for policies favoring arrest over informal police responses to intimate partner violence. However, the analyses also show that despite police intervention, a minority of suspects repeatedly victimize their partners and that factors other than formal sanctions play larger roles in explaining the cessation or continuation of aggressive behavior between intimates. These findings suggest that new policies replacing or enhancing arrest that target potential repeat offenders might produce larger reductions in intimate partner violence.
