印度尼西亚伊斯兰法律制度改革试析

印度尼西亚是世界上穆斯林人口最多的国家,独立后对伊斯兰教法进行改革,制定1974年婚姻法,编纂《伊斯兰教法汇编》,完善伊斯兰法庭,加强了伊斯兰教法的规范化、制度化、专业化,使之适应现代社会,同时加强了国家对伊斯兰的控制。     

Perceptions of Time and Their Impact on Negotiations in the Arabic-Speaking Islamic World

This article examines how perceptions of time affect Arabic-speaking Islamic negotiators and how their attitudes about time, and their corresponding behaviors, may differ from those of their Western counterparts. We begin by identifying cultural differences in the conceptualization of time and then comment on the role of time in negotiations, discussing how time influences bargaining, trust, and negotiation tactics. In the section on tactics, we discuss stall-and-delay tactics, the use of the past as an objective standard, and limits on negotiating the future. Our purpose is to encourage negotiators from the West to be knowledgeable about the way they, as well as negotiators from Arabic-speaking Islamic cultures, conceive of and use time in negotiations. We believe that understanding that the very concept of time is often quite different in these two cultures is an important step in facilitating negotiations that cross these cultural boundaries.

Partnership in Love and in Business

This article ponders the influences ofthe dichotomous nature of our understanding law andto questions that starting point on different levels oflegal thinking.The purpose of law is to make rules for our socialbehaviour but there are no specific images of humanbeings behind law. When there are no defined images,subconscious cultural images shape our thinkingsometimes even without our realizing it, and withoutserious discussion. The division between family andthe market has to do with gender divisions as well aswith the division between family and contract law. Thelogic and human image behind these two branches of lawis different.Even if we may behave differently in differentsituations we do not become altogether differentkinds of human beings with different values when wechange surroundings. Thus, we might instead develop asa starting point human co-operation law where familyand business partnerships are seen as specialbranches. The starting point of this co-operation lawwould be many-sided and pluralistic human beings, who would be atthe same time loving and egotistic, communal andindividual, feminine and masculine. Such human beingsmay be regarded as multicoloured instead of white orblack.     

我国婚姻无效与撤销损害赔偿制度探析

当事人一方的违法行为导致婚姻无效或撤销,过错方侵权责任的配置,直接关系到无过错方权利的保护和 救济。文章借鉴国外立法经验,结合我国实际,提出我国婚姻立法应确立婚姻无效与撤销损害赔偿制度,并就该制 度的适用进行了探讨。     

Understanding the War in Syria and the Roles of External Players: Way Out of the Quagmire?

With Western commentators, media and think tanks still being the predominant determinant of the global international relations discourse and therefore also of the discourse relating to Syria, discerning actual realities coherently from the fog of a very biased narrative presents great challenges. Deciphering the complexities of West Asia has never been easy and the situation in Syria is particularly complicated. This article argues inter alia that the Commonwealth as an entity needs to add its efforts, voice and prestige to the global effort to prioritize the restoration of peace in West Asia in general and Syria in particular.     

涉外婚姻家庭关系法律适用法的人本化

《涉外民事关系法律适用法》婚姻家庭一章的规定体现着人本主义的趋向。文章从对比我国涉外婚姻家庭关系法律适用立法变化的角度,分析了我国在涉外婚姻家庭关系法律适用立法上的人本化趋向。     

妇女和婚姻从此就失去保护了吗？——评婚姻法解释三第七、第十一条

媒体和学界对《婚姻法解释三》第七条、第十一条等条文的诟病甚多，认为它们弱化了对妇女的保护，违反甚至冲击、摧毁我国传统婚姻家庭文化、婚姻家庭伦理和婚姻家庭价值取向；另外还认为婚姻家庭领域与物权、合同领域殊有不同，这两条司法解释是将后者的原理粗暴地适用于前者，甚为谬误。笔者认为，这些抨击是对婚姻法解释三的误读。本文试图从对这些抨击作出辩驳的角度论证婚姻法解释三第七条、第十一条的正当性。     

青年农民工思想现状的实证调查

基于山东省四地市210个有效样本，从政治观、价值观、婚姻观三个层面分析了青年农民工群体的思想道德状况，发现部分青年农民工政治理论素养不高，但对国家的发展持乐观态度；热爱祖国，但对“爱国主义”有所质疑；信仰多元化，部分人信仰缺失；追求物质利益同时看重家庭；为人处世能够考虑他人感受，以道德良心为行为准则；择偶时看重对方的人品、性格、才华等内在条件；大龄青年的性观念比较传统，低龄青年农民工性观念比较开放；对待离婚的态度比较宽容。
