药家鑫案件的反思

药家鑫案件已渐渐地淡出了人们的视野,然而该案所折射出的教育机制的缺失、人性道德的缺失、法制环境的缺失、社会氛围的缺失,值得我们进行深刻地反思,以促使我们深挖社会的病根,检讨教育的病源,治理滋生幽暗心理的土壤,改良传染病毒的气候。非但如此,不足以保护更多的张妙,也不足以挽救更多的药家鑫。

Technics over life: risk,ethics and the existential condition in high-tech antenatal care

The subject of this paper is the problem of selective abortion brought about by advanced techniques of foetal diagnosis. The issue of abortion today is analysed as an outcome and illustration of the emerging ‘vital politics’. The paper explores the technicality of this new form of bio-power, and the ethical practice and forms of subjectivity it imposes. Two main points are raised. First, it is argued that the implementation of state-of-the-art foetal diagnosis in clinical practice and maternity care is underlain by the rationales of control and experimentation. The ideas of risk and the dividual are introduced as the epistemic cornerstones of this practice of high-tech reproductive medicine according to the above rationales. Second, the paper argues that foetal diagnosis in antenatal care is characterised by an ethical split. This emerges when the machinery of reproductive health care withdraws into a position of technical responsibility and leaves the choice, and the ethical responsibility, concerning medical operations (selective abortion, in particular) to the pregnant woman. This suggests that high-tech biomedicine tends to individualise risks and to impose a form of ethical individuality characterised by the demand for reflexivity through personal risk assessment, producing the anxiety generated by existential responsibility.     

军事法与军事伦理关系初探

军事伦理和军事法作为上层建筑的成分,都是对军事行为加以规范、控制,并通过规范、控制军事行为来调整军事社会关系。虽然二者之间存在诸多区别,但并非各自属于相互排斥的独立系统,而是客观地存在着一种相互依存、互相渗透的关系。军事法对军事伦理道德起着保护的作用,并促进其发展;军事伦理规范对军事法律制度则是一种重要的补充力量,对军事法的实施起着辅助的作用,对培养和影响军事主体对其现行军事法律制度采取什么态度有着重要的意义。     

道德进步是社会和谐的重要精神基础

构建和谐社会,不仅是一个社会的政治使命,同时也是道德建设的目标和任务。在我国社会转型阶段,现代社会生活价值取向的多样性对和谐社会建设和道德进步提出了全新要求。道德的进步,必须为构建和谐社会创立伦理规范。道德冲突的消解和转化,必然为社会和谐奠定精神基础。     

Troubling frames: Zapiro’s iconography on Oscar Pistorius as traumics

ABSTRACT

This study aims to examine the comics form in relation to its representation of perpetrator trauma. Specifically, the study considers a selection of Jonathan Shapiro’s iconography on Oscar Pistorius as biograph(y)ics, since the artist ‘commixes’ Pistorius’s life from his rise to athletic fame – through the court trials for his alleged murder of Reeva Steenkamp on 14 February 2013 – to his conviction followed by a thirteen-year jail sentence on 24th November 2017. In my reading of the panels, I draw on Hilary Chute’s notion of the ethics of testimony in illustrative art and Jacques Derrida’s theorising on hauntology and the revenant to argue that wrongdoers can also experience their crimes as trauma. This critical engagement enables me to read Shapiro’s panels as not merely reinforcing dominant interpretations of the fallen hero, but also as a means by which the cartoonist destabilises and reconfigures socially accepted notions of the villain.
