The effect on juror verdicts of judicial instructions to disregard inadmissible evidence was evaluated using meta-analysis. One hundred seventy-five hypothesis tests from 48 studies with a combined 8,474 participants were examined. Results revealed that inadmissible evidence (IE) has a reliable effect on verdicts consistent with the content of the IE. Judicial instruction to ignore the inadmissible evidence does not effectively eliminate IE impact. However, if judges provide a rationale for a ruling of inadmissibility, juror compliance may be increased. Contested evidence ruled admissible accentuates that information, resulting in a significant impact on verdicts. Suggestions for how the courts may mitigate the impact of inadmissible evidence more effectively are discussed.  相似文献

A widespread presumption in the law is that giving jurors nullification instructions would result in "chaos"-jurors guided not by law but by their emotions and personal biases. We propose a model of juror nullification that posits an interaction between the nature of the trial (viz. whether the fairness of the law is at issue), nullification instructions, and emotional biases on juror decision-making. Mock jurors considered a trial online which varied the presence a nullification instructions, whether the trial raised issues of the law's fairness (murder for profit vs. euthanasia), and emotionally biasing information (that affected jurors' liking for the victim). Only when jurors were in receipt of nullification instructions in a nullification-relevant trial were they sensitive to emotionally biasing information. Emotional biases did not affect evidence processing but did affect emotional reactions and verdicts, providing the strongest support to date for the chaos theory.  相似文献

Consultation of scientific evidence by policy actors has been the foci of attention of knowledge utilization scholars for decades. The present study questioned the extent to which randomized controlled trials (RCTs)—generally seen as the gold standard of scientific research—are known and consulted by policy analysts in ministerial settings. Using cross‐sectional data collected in 17 ministries in Québec (Canada), our study showed that fairly high levels of policy analysts report never having heard of RCTs, thus possibly hindering effective communication of scientific results to relevant policy makers. Statistical analyses reveal the importance of cognitive factors in explaining both phenomena.  相似文献

在物权法文本中,存在着诸多与物权法定原则的要求相冲突的缺口和裂缝,从而为物权法定原则的缓和的可能性留下了空间。中国语境中的物权法定原则具有很强的政治原则面貌,政治决策的灵活性和多变性增加了物权法定原则缓和的可能性。而通过对物权法定原则的维护交易安全功能的解读,可以限缩其适用范围。《物权法》第117条关于用益物权的抽象规定对于缓和物权法定原则有着积极的意义。  相似文献

应急管理的决策指挥机制分为先期处置、应急响应和应急结束三大流程加以规范。目前,北京已经建立起了独具特色的"三加二"应急管理模式,建立了较为完善的突发事件信息报送制。然而,北京目前的集中式应急指挥体系与分散化部门权责之间存在着冲突,决策指挥机构间的权限划分不够清晰;在应急信息管理中尚存在着制度导向的误区,在应急决策过程中缺乏专家参与制度。北京城市应急决策指挥机制应当强化应急决策指挥机构的权威性,建立统一的应急信息平台系统;重构应急管理中信息公开的理念、范围和方式;建立和完善应急决策指挥过程中的监督机制和专家顾问的参与机制。  相似文献

The Individuals with Disabilities Education Improvement Act (IDEIA) protects foster children's rights to have a special education decision maker. For foster children who do not have a natural or adoptive parent or a responsible adult in their life to take on this role, IDEIA requires that a special education surrogate parent be appointed by appropriate procedures. Under IDEIA, these procedures are delegated to the states. Each state must ensure that local education agencies (LEAs) delineate methods for recruiting and maintaining a pool of available special education surrogate parents. Due to differing state laws and LEA procedures, there are many discrepancies in the quality and availability of special education surrogate parents. To combat these problems, this Note proposes principles for administrative regulations establishing statewide special education surrogate parent programs by examining existing statewide programs. Administered through a state's Department of Education in collaboration with child welfare agencies, statewide special education surrogate parent programs guarantee well‐qualified decision makers who will advocate for all children eligible for special education services.  相似文献

Prior research into the effects of racial diversity on workplace relationships has demonstrated that white workers prefer to work in and with groups which are also composed of white workers. Using structural equation models, we tested whether higher levels of racial diversity, measured as social distance from coworkers and inmates, were associated with lower evaluations of organizational commitment, teamwork among coworkers, and efficacy in dealing with inmates. We found the expected negative effects of racial diversity on white male correctional workers for organizational commitment, but not for teamwork and efficacy. For minority male correctional workers, racial diversity did not affect organizational commitment, teamwork, or efficacy.  相似文献
