新《刑事诉讼法》视野下看守所的职能

新《刑事诉讼法》的颁布实施,使看守所的职能发生了一些变化。看守所应当严格履行法律赋予的职责,积极探索新的工作方式、方法,完善监管制度,从而保障刑事诉讼活动的顺利进行。     

看守所在押人员的心理解读

看守所是公安基层基础建设的重点基层，其监管工作是公安工作的基础工作。分析在押人员的心理特征，有的放矢地进行教育改造，不仅是配合保障审讯审判工作顺利进行的需要，也为保障看守所安全羁押看管工作所必需；同时也是看守所监管人员的重要基本功。在押人员心理特征的影响因素有犯罪的法律事实，监管的人文环境和物质环境以及其本身的个性特点。在押人员的心理特征主要有挫折因素导致的认知失调，幻想侥幸心理，自相矛盾心理，趋利避害心理。     

论毒品犯罪对未成年人的危害及控制方略

当前，毒品犯罪日益猖獗，因毒品犯罪而产生的未成年人吸毒等问题也越来越严重，给未成年人的健康成长带来了极为不利的影响。因此，控制和减少毒品犯罪是我们面临的一个极为迫切的任务。毒品犯罪有其自身的特点。应针对其特点采取合适的防控措施。具体说，在治理毒品犯罪时，不仅要切断毒品的供应，还应设法减少对毒品的需求；不仅要制定针对制毒、贩毒等毒品犯罪行为的严厉惩治措施，还要建立完善的预防制度。     

人民法院实施未成年人轻罪犯罪记录封存制度的实践探索

新《刑事诉讼法》正式以法律形式确立了未成年人轻罪犯罪记录封存制度，这是我国未成年人刑事司法制度的重大发展，对未成年犯的复学、升学、就业以及顺利回归社会具有重要意义。但是，具体操作规则和司法实践经验的缺乏，不利于该制度的科学、规范实施。对未成年人权益进行全面保护，使其成为一个普通的社会人，是该制度的价值追求，必须贯穿于该制度实施的整个过程中。由人民法院制作并发送《未成年人轻罪犯罪记录封存决定书》，表面上看是一道法律规定之外的额外程序，但在制度建立之初，有利于制度的全面、正确实施。     

中韩第三方市场合作:进展、阻力与对策

第三方市场合作是中韩两国参与国际分工协作的新型合作模式,也是两国发展战略对接与比较优势互补的重要经济实践。中韩第三方市场合作在产品服务、工程建设、投资合作、产融结合和战略合作五个领域打造了一系列重要工程,不仅加深中韩两国的合作基础,还为第三方市场的经济发展注入新动力。但其中存在诸多挑战,产业结构的竞争、复杂的营商环境、域外大国因素的介入以及中韩经济波动等都对中韩第三方市场合作造成了阻力。因此,开拓战略新兴产业、打造示范工程、创新金融合作和完善协调机制,是实现中韩第三方市场合作可持续发展的重要保障。     

Minilateral security's relevance to US strategy in the Indo-Pacific: challenges and prospects

The Indo-Pacific region's security landscape is unfolding in highly uncertain and potentially explosive ways. The postwar American-led network of bilateral alliances – underpinned by concrete guarantees of extended deterrence and containment – is now yielding to a more diverse set of alignments and coalitions to manage an increasingly complex array of regional security issues. Multilateralism and minilateralism have emerged as two increasingly prominent forms of such cooperation. Minilateralism's informality and flexibility appeals to those who are sceptical about multilateralism's traditional focus on norm adherence and community-building even as great power competition in the Indo-Pacific is sharply intensifying. However, minilateralism's track record in the region is underdeveloped. The potential for this policy approach to be applied by the United States and its regional security partners as an enduring and credible means of diplomatic and security collaboration in the region will remain unfulfilled as long as the Trump administration's own geopolitical orientation remains uncertain.     

An Action Research on Delinquency Prevention of Migrant Juvenile in the Perspective of Social Work——A case study of Kunming F Community

Taking as a case the community services of F community where the biggest number of migrant people congregate in Kunming , this paper explores how to improve migrant teenagers' resilience to improve their positive growth, active social inclusion into city life and reduce the risks of delinquency. Within the action research, this study finds out that migrant juveniles suffer the shortage of public community service, poor quality of school education, insufficient family supports, adverse parenthood and interpersonal relationships, deficient peer supports and low self esteem and confidence. Fortunately, through conducting a series of life educations, career counseling and community services including school social work, family social work and cultural construction activities, with the core of resilience construction, can effectively improve the cognition and behavior of migrant teenagers can be improved and the risks of their delinquency can be reduced effectively. Moreover, this study believes that the social work station established in the migrant population's community can provide professional services to facilitate the positive interactions between juveniles and the environment which are regarded as the premise of delinquency prevention, to activate teenagers' subjectivity and initiative which is the emphasis, and to arouse the feelings of shame of teenagers with deviation behaviors that is the key point of crime prevention.     

Under construction: Brain formation, culpability, and the criminal justice system

Should adolescents be held as culpable for their behavior as adults? Adolescence is a tumultuous time, full of change and transformation. This paper examines the development of brain functions and cognitive capabilities of teenagers. It explores the effect of alcohol use on brain development and the fundamental cognitive differences between adolescents and adults. This knowledge, coupled with the assessment of developmental perspective, suggests that the adultification of youth (or waiver to adult court) is unduly harsh for youth whose brains have not fully formed.     

我国城市公交服务治理模式与运营效率研究——以长三角城市群公交服务为例

城市公交服务运营效率评价是政府选择治理模式的前提与依据,而明晰运营效率与其影响因素间的关系则是政府深化公交治理模式的理论依据。在比较政府经营模式和市场主导模式差异及探讨效率影响因素的基础上,以长三角城市群公交服务为研究样本,应用DEA方法测算城市间服务效率的差异,发现市场主导模式效率要优于政府经营模式,但各自的综合效率、技术效率和规模效率均值都不高。为剖析造成这种现象的原因,对公交服务效率的影响因素进行Tobit回归,结果表明市场竞争、企业规模与运营效率显著正相关,且市场竞争与运营效率间存在"倒U型"关系。因此,我国城市公交服务的改革应坚持市场化为导向,引入民营资本构建公有有限公司形式的国有民营模式,扩大企业规模和充分利用竞争手段,以提高企业运营效率。
