1926年,中华全国总工会在广州创建劳动学院,其在办学理念、办学宗旨、办学目标、办学主体、课程设置、学员管理等方面与中国劳动关系学院及其前身有着明显的校史关联。加之刘少奇在劳动学院、延安工人学校以及全总干部学校之间的传承因素,劳动学院可以被视为中国劳动关系学院办学历史的最早发端,也是全总举办工人干部高等教育的开端。本研究探讨劳动学院与中国劳动关系学院的校史渊源,有助于推动中国劳动关系学院当前的学校建设,推进学校课程思政“立德树人”的建设,呈现出中华全国总工会干部培训事业的发展历程,增进理解中国共产党领导下劳动教育的历史传承,具有强烈的现实意义。 相似文献

Despite the maturity of the software industry, empirical research demonstrates that average software quality, when measured through the presence of software defects, is low. Such defects cause a wide array of issues, not least in the form of vulnerabilities, which support a multi-billion pound a year industry of fraud in cyber crime. This paper suggests that this is the result of market failure stemming from two factors: the first is that information asymmetry prevents the establishment of software quality prior to purchase; whilst the second is that the legal provisions available under private law are unable in their current form to adequately address software liability issues. On that basis this paper proposes the use of standardisation as a tool to address both of these shortcomings by providing an industry benchmark against which software quality can be ascertained, as well as forming a legal tool for determining causation for the purposes of establishing legal liability. 相似文献

This paper discusses the Scottish Law Commission (SLC)'s Report on Similar Fact Evidence and the Moorov Doctrine, which proposes revolutionary changes to the way in which Scots law deals with evidence of the accused's bad character, including his previous convictions. The article sets these proposals in context by explaining the existing Scots law, and comparing it to the English provisions on bad character evidence contained in the Criminal Justice Act 2003. This comparison reveals similarities between the responses of the two jurisdictions. It is remarkable that the SLC did not consider English law to be a viable model for reform, choosing instead to propose legislation which would simply deem certain pieces of bad character evidence relevant in criminal trials. If a party to an employment contract commits a repudiatory dismissal or resignation, it has long been unclear whether the other party has the option either to terminate or affirm the contract (the elective theory) or whether the former's breach operates to bring the contract of employment to an end (the automatic theory). The recent decision of the Supreme Court in Société Générale (London Branch) v Geys has finally resolved this question. By a majority, the Supreme Court held that the elective theory also applies in the context of a wrongful repudiation of the employment contract by express dismissal or resignation. This note examines the significance of Geys in the context of the common law of the contract of employment and evaluates whether a number of related issues surrounding the breach and termination of the employment contract have been resolved. 相似文献

This article addresses the termination of employment because of the conduct of the employee in her leisure time, in the light of the right to private life. It explores the impact on the retention of employment of activities taking place outside the workplace and outside working hours, and argues that the approach of UK courts and tribunals, which is based on a primarily spatial conceptualisation of privacy, is flawed. A fresh approach to privacy, resting on the idea of domination, is proposed, which is sensitive to the particularities of the employment relationship. Considering the fairness enquiry in dismissal, it argues that off‐duty conduct may lead to lawful termination of employment only if there is a clear and present impact or a high likelihood of such impact on business interests; a speculative and marginal danger does not suffice. It further proposes that a particularly meticulous test is appropriate when certain suspect categories, such as the employees' sexual preferences, are at stake. 相似文献

最低生活保障制度改革一直是我国社会与学界关注的重点,而由于微观数据和建模技术的匮乏.对于该问题的研究往往限于定性理解和总量分析。本文以计算机微观模拟技术为突破口,将微观主体的异质特征和行为决策机制纳入模拟的实验范畴,建立相应的模拟模型,对我国城镇居民最低生活保障制度改革进行深入的量化研究。结合区域经济现实,分别从历史特定的制度改革和政策参数的灵敏度实验两方面进行了微观模拟,实验结果量化了制度改革所引发的劳动供给与收入分配效应。同时揭示了制度潜在的低效率及其本质原因,并提出应对策略;为最低生活保障制度改革的评价与设计提供了建设性依据。 相似文献
