Las funciones de los consejeros independientes de las sociedades en México: Recomendaciones para el cambio a partir de las asimetrías existentes entre la práctica y la ley

The legal notion of an independent board member was introduced to the Mexican legislation in 2005. The goal was to improve the corporate governance of the corporations listed on the stock exchange. It was thought that including the independent board members would help to better represent the interest of the minority holders, as well as to increase the level of accountability. This article challenges these ideas based on 10 interviews carried out with independent board members. It finds that what the law says is far from what actuatly occurs: they lack of an adequate level of knowledge to perform their tasks, their degree of independence is severely limited by the criteria used to appoint them and they usually ignore essential corporate information, which impede them from participating effectively in the board sessions. The article suggests the creation of an independent board member’s association, a mechanism that, along with a mandatory certification system, would improve the way in which they perform their duties.     

Politics,Science, and Termination: A Case Study of Water Fluoridation Policy in Calgary in 2011

Policy termination is identified as a rare occurrence and thus difficult to study. However, one policy area, community water fluoridation, has seen an apparent increase in termination in recent years. We examine the specific case of termination in Calgary, Alberta in 2011 with a specific goal to apply Kingdon's Multiple Streams Approach to the policy termination framework. Our findings suggest that of key importance for the termination of water fluoridation was the impending need for an upgrade to the fluoridation infrastructure, the effectiveness of the local anti‐fluoridation activists, the speed of decision making, and a prominent framing of the issue in ethical terms. The opening of a policy window made possible by the 2010 Calgary municipal election, one that introduced a number of new members to council, as well as the presence of a policy entrepreneur who took advantage of the window's opening, were of specific importance to the success of policy termination.     

Migración,lucha por la vivienda y transnacionalismo socio-político: El caso de Movimiento por Justicia del Barrio

Transnationalism is, within Mexican migration studies, the predominant perspective to explain collective action undertaken by Mexicans in the United States. It takes into account the Mexican “diaspora's” interest and political participation in their hometowns. This article challenges transnationalism's basic tenet and proposes, instead, the notion of socio-political transnationalism. Nevertheless, the article emphasizes on how migrants fist act collectively to improve their living conditions in the host societies, rather than organizing around their ties with their homeland. This kind of organizing does not imply indifference towards the situation in their country of origin. It does mean, however, that the transnational perspective falls into a second plane. To illustrate, we will depict the history of Movimiento por Justicia del Barrio, an immigrants' organization in the City of New York, principally Mexican based, and their struggle against the gentrifying attempts taking place in East Harlem. We will also look at their political vision and the links they have created with organizations in Mexico.

Following the onset of the Asian Financial Crisis the world has witnessed a re-accommodation of the global financial system. In the particular case of middle-income countries they have disentangled themselves from the conditionality of the IMF and grown into more assertive actors in international forums, proposing new alternative mechanisms to become more financially independent and for the provision of development assistance. This article critically reviews the new reality by assessing the strategies deployed by developing countries to reduce the IMF’s influence, and explores the potential consequences of the rise of middle-income nations for Law and Development.
