康德的法权哲学思路是和他的三个《批判》所述一致的,“科学知识”要发现“自然(关系)”中的“必然性”,而“法权学”则是要在“人”的“关系”中发现“必然性”,也就是关于“法权”的“先天综合”何以可能的问题.“法权”问题又和《实践理性批判》里所论述的“自由”密切相关.“自由”的“限制”“关系”就《实践理性批判》所涉及的“道德”来说,“根据”在于一个“形式”的“应该”,而就现实的“国家-法律”来说,则是“自由者”之间的“法权”关系.“法权”“本体的所有”既“悬搁”又“范导”“现象的所有”.“自由者”在“人格-格位”“平等”基础上“限制”着各自的自由,由此而形成的“共同体”乃是“自由的共在”.  相似文献

Section 12 of the Matrimonial Causes Act 1973 as amended by the Gender Recognition Act 2004 requires transgender people to disclose their ‘gender history’ to the other party to a marriage prior to the marriage ceremony. Failure to do so enables the other party to exit the relationship through nullity proceedings. This article argues that this provision is discriminatory and encroaches on the right to privacy, breaching Articles 14 and 8 of the European Convention on Human Rights. It challenges the idea, implicit in the provision, that non‐disclosure of gender history is unethical or fraudulent. Crucially, the article considers and rejects the claim that discrimination against and encroachments on the privacy of transgender people are justified because inadvertent sexual congress with a transgender person is potentially harmful. Finally, if a consent‐based right to know exists, it argues that it ought to be trumped by considerations of justice, legal consistency and public policy.  相似文献

It has been suggested that the nature of marriage could be varied by private contract. In France a similar effect has been achieved by allowing couples to enter into an institution delimited by law but regulated by contract. Thousands of cohabiting couples have chosen to register a Pacte Civil de Solidarité . This suggests a strong desire for a real alternative to marriage and raises important issues about commitment in modern relationships. It is speculated that PaCS is likely to rank below marriage but above cohabitation in terms of relationship quality, stability and protection of the weaker party.  相似文献

This paper deals with the home-leaving of young adults in Gothenburg, Sweden, in the period 1915–1943. We used individual-level panel data from population registers and poll-tax records, taking a competing risk design for the analysis of the determinants of leaving home to marry, or for non-familial living. We found a transitional, marriage-driven pattern of leaving home that neither fits the old context of life cycle service, nor the alternative modern routes out of the parental home into unmarried householdship. Young adults typically stayed at home until they married, although some moved out to temporary non-familial living first. Non-familial living consisted mainly of lodging in another household, but working outside it, which in a way was a forerunner of the modern pattern, in sharp contrast with the remnant of preindustrial times: the flow from rural areas into Gothenburg of teenage women immigrants to become residential domestic servants. Interestingly, we found that the main determinants of home-leaving in studies of modern-day populations were equally important in the population of Gothenburg in 1915–1943. For both young men and young women, having their own resources (employment, earnings) was positively associated with the likelihood of leaving the parental home. We also found clear gender differences. A higher level of human capital of the father was associated with later home-leaving to marry for sons, and earlier leaving for non-familial living for daughters. Lower levels of household income, or the presence of minor siblings or a widowed parent were push factors for non-familial living for daughters. We found no similar push factors for sons.  相似文献

民法学界通说认为,婚姻家庭法是私法,是民法的组成部分。但是,从法律体系架构的角度考察,婚姻家庭法并非只是私法。法律体系公法与私法的划分并非绝对,二者互为关联、互相影响。以我国现行《婚姻法》文本为分析对象,可知强制性婚姻家庭法律规范占绝大部分;国家公权力介入婚姻家庭,维护弱者的权益相当必要。因此,有必要转换思路,突破传统思维定势,确认婚姻家庭法是公私混合法的性质,以求符合婚姻家庭的基本价值与功能。  相似文献
