In this paper, we will investigate the popularity of marriage migration between Turkish communities in Western Europe and emigration regions in Turkey. Our focus here is specifically on the Belgian case, namely the ‘Emirdag connection’. In Belgium, the majority of immigrants with a Turkish background come from the region of Emirdag, in the province of Afyon. On the basis of quantitative research methodologies, we first consider the magnitude of the phenomenon and the socio-economic situation of those involved. Using the qualitative research techniques of participant observation and in-depth interviews, we analyze the mechanisms in an attempt to explain marriage migration between these regions. Why do so many young people, born and raised in Western Europe, opt for an unknown partner from a region that is largely unknown to them but which proves to be their parents', or even grandparents', region of origin? Why does migration remain such a valuable life project for many young people in these regions of origin, despite the real danger of many negative side effects? The popularity of marriage migration is often explained by its role in making migration possible. However, migration theories alone cannot explain this phenomenon. Here we will argue that the existence of a ‘culture of migration’ that binds the region of origin with the region of destination and in which ‘the family’ as an institution is capable of building a bridge between traditional praxis, as well as the challenges linked to international migration, are crucial for understanding the enduring popularity of marriage migration.  相似文献

Over the last two decades, research examining desistance from crime in adulthood has steadily increased. The evidence from this body of research consistently demonstrates that salient life events—in particular, marriage—are associated with a reduction of offending across the life course. However, previous studies have been largely limited to male samples in the United States. As a result, questions regarding the universal effect of these relationships remain. Specifically, research is needed to assess whether the desistance effect of life events like marriage varies by gender and/or socio-historical context in countries other than the U.S. The present research addresses these gaps by examining the relationship between marriage and criminal offending using data from the Criminal Career and Life Course Study (CCLS). The CCLS includes criminal conviction histories spanning a large portion of the life course for nearly 5,000 men and women convicted in the Netherlands in 1977. Because we assess change over multiple observations within and between individuals, we utilize hierarchical models to estimate gender and contextual effects of marriage on criminal offending (i.e., any, violent, and property convictions). Overall, we find consistent support for the idea that marriage reduces offending across gender and socio-historical context. Notably, we find that the reduction in the odds of offending due to marriage is significantly greater for individuals in the most contemporary context. The implications of these findings are discussed.

Over the past two decades, the definition of “family” has expanded drastically. To address these changing family dynamics, many states have adopted de facto parent laws, which recognize a nonbiological or adoptive parent's right to petition for custody or visitation in strict circumstances. These laws differ drastically from state to state, leaving no common understanding of the requirements to be a de facto parent. Until recently, New York law refused to recognize de facto parents within the Domestic Relations Law, leaving New York as one of the only states without this important distinction. However, this year the Court of Appeals crafted a narrow exception to the rule and allowed for a de facto parent to petition for custody or visitation in extremely limited circumstances. This article proposes that the Court of Appeals’ decision was too restrictive and that New York should adopt a legal framework that reflects this new type of parent, while still recognizing public policy concerns.  相似文献

修订后的《婚姻法》增加了关于禁止家庭暴力方面的规定,是我国规范家庭成员间行为的又一重大进步。婚姻暴力是最主要的家庭暴力,它已成为一个社会性的问题,是社会、经济、传统观念等多种因素综合作用的结果。预防和制止婚姻暴力要从立法、执法方面加大力度,加强法制宣传,树立男女平等的法律意识,形成以政府、司法、妇联各机构相结合的社会救助服务、保障、预防、制裁等为构架的网络体系。  相似文献

社会救助的制度供给是针对“强”竞争社会中的“弱”势群体,是基于平等原则的要求,给予弱势群体的合理性差别对待。而平等原则之所以能够成为现代国家所标榜的社会规则,究其原因在于平等原则所具有的社会正义性特质。从形式平等到实质平等的正义性矫正,从禁止不合理分类到合理差别待遇的正义性追求,平等原则透视出制度正义的原理并为当前社会救助制度提供了正当性的说理。  相似文献
