现代版权法的权利穷竭原则意味着一旦作品的原件或是复制件经权利人同意而进入市场后 ,该作品作为商品的进一步销售 ,著作权人均无权控制。随着我国《著作权法》的修改 ,中国著作权制度虽都已符合了TRIPS规定和国际公约的保护标准 ,但仍然存在因科技进步所带来的法律难题。我国应在版权立法中借鉴欧盟和美国等国家的版权立法 ,明确权利穷竭不能适应于国际著作权作品贸易 ;同时也规定网络传输作品不适应于权利穷竭原则。 相似文献

High‐throughput sequencing (HTS) of large panels of single nucleotide polymorphisms (SNPs) provides an alternative or complimentary approach to short tandem repeats (STRs) panels for the analysis of complex DNA mixture forensic samples. For STRs, methods to estimate individual contribution concentrations compare capillary electrophoresis peak heights, peak areas, or HTS allele read counts within a mixture. This article introduces three approaches (mean, median, and slope methods) for estimating individual DNA contributions to forensic mixtures for HTS/massively parallel sequencing (MPS) SNP panels. For SNPs, the major:minor allele ratios or counts, unique to each contributor, were compared to estimate contributor proportion within the mixture using the mean, median, and slope intercept for these alleles. The estimates for these three methods were typically within 5% of planned experimental contributions for defined mixtures. 相似文献

This article investigates the dynamics of support for income redistribution in Europe. With European Social Survey data spanning 2006 to 2012, it assesses whether the Great Recession resulted in substantial parallelism or increasing polarisation in preference change across various sub‐publics. After introducing hypotheses based on claims that social groups are affected differently by economic insecurity, the article proceeds in two empirical sections. First, whereas prior research suggests that hard times fuel diverging attitudinal patterns, it is found that income groups, ideological groups and educational groups did not shift differently over time during the first years of the crisis, thus providing strong evidence for the ‘parallel publics’ hypothesis in the European context and in times of economic turmoil. Next, the article addresses the extent to which change in aggregate support for redistribution came from changes in small minorities of the population, supposed to be more responsive to their economic environment. Using multilevel analysis, it is shown that the most educated significantly contributed to the overall change more than the others. As a result, they may have been partly driving the economic mood during the first years of the Great Recession. 相似文献

Under what conditions does foreign aid in the aftermath of war foster state-building? This article argues that institutional legacy and continuity and the politics of aid may matter. In the aftermath of war, for an aid regime to reinforce state-building, it may need to ensure continuity in the strength of the state and to use recipient mechanisms and finance policies that generate a greater state capacity. The existence and continuity of a Weberian state may increase the likelihood of effective state-building. If the state is relatively strong, with a Weberian bureaucracy, aid can further reinforce it when aid is spent through national systems or is aligned with local priorities, with efforts to ensure that the recipient leaders reinforce state effectiveness by implementing policies that may require greater state capacity. Evidence for this argument is provided through pairwise comparison of state-building patterns between South Korea and Taiwan. 相似文献

Microbial communities have potential evidential utility for forensic applications. However, bioinformatic analysis of high-throughput sequencing data varies widely among laboratories. These differences can potentially affect microbial community composition and downstream analyses. To illustrate the importance of standardizing methodology, we compared analyses of postmortem microbiome samples using several bioinformatic pipelines, varying minimum library size or minimum number of sequences per sample, and sample size. Using the same input sequence data, we found that three open-source bioinformatic pipelines, MG-RAST, mothur, and QIIME2, had significant differences in relative abundance, alpha-diversity, and beta-diversity, despite the same input data. Increasing minimum library size and sample size increased the number of low-abundant and infrequent taxa detected. Our results show that bioinformatic pipeline and parameter choice affect results in important ways. Given the growing potential application of forensic microbiology to the criminal justice system, continued research on standardizing computational methodology will be important for downstream applications. 相似文献

DNA is one of the fastest growing tools in forensic sciences, increasing reliability in forensic reports and judgments. The use of DNA has increased in different areas of the forensic sciences, such as investigation of plant species, where plastid DNA has been used to elucidate and generate evidence in cases of traceability of genetically modified and controlled plants. Even with several advances and the practice of using DNA in forensic investigations, there are just few studies related to the identification of genetic tools for the characterization of drug and nondrug-types of Cannabis. Herein, the whole plastomes of two drug-type Cannabis are presented and have their structures compared with other Cannabis plastomes deposited in the GenBank, focusing in the forensic use of plastome sequences. The plastomes of Cannabis sativa “Brazuka” and of the hybrid Cannabis AK Royal Automatic presented general structure that does not differs from the reported for other C. sativa cultivars. A phylogenomic analyses grouped C. sativa “Brazuka” with the nondrug C. sativa cultivars, while the hybrid Cannabis AK Royal Automatic placed isolated, basal to this group. This suggests that the analysis of plastomes is useful toward genetic identification of hybrids in relation to C. sativa. 相似文献

基于海事法律关系跨国性、流动性的特点,海事诉讼中极易出现国际平行诉讼的情形。对此,学界有观点提出应当引入源于英美法系的禁诉令制度,以解决我国海事诉讼中的国际平行诉讼冲突问题。但实践中禁诉令的使用却可能面临可操作性和实际效果受限严重的问题。因此,可考虑先以《海事诉讼特别程序法》中的海事强制令制度暂行禁诉令的功能,从而循序渐进地开展在我国海事诉讼中引入禁诉令制度的尝试。 相似文献

WTO争端解决机制(Dispute Settlement Mechanism)是乌拉圭回合谈判的一个重要成果,而WTO争端解决机制比起GATT时代的争端解决程序的优越性主要在于它对执行裁决的监督上。体现在"WTO争端解决程序与规则的谅解"(DSU)中,就在于第21条"履行措施的合法性审查"和第22条"申请授权报复"的规定。这两条规定在WTO司法实践中已经成为WTO法执行的砥柱规则,使多边贸易体系解决纠纷的法律体系功能更为强大。但是,WTO的立法和任何立法一样,在具有前瞻性、预测性的同时,不可避免地具有一些滞后性,甚至在立法的当时受各种利益因素的制约,在立法上留有一些空白。针对DSU第21条和第22条规定的内在冲突,从分析WTO以往发生的案例入手,综合WTO专家小组对此问题的解释,结合各国提出的建议,对此问题进行论述。 相似文献

SE33 was a well-known autosomal short tandem repeat (STR) marker that was high polymorphic and therefore was high discrimination power. The sequence structure of STR markers has been increasingly explored with next-generation sequencing (NGS) technology. The sequencing resulted in the development of a new locus designation and allele nomenclature that was also backward compatible with the conventional capillary electrophoresis. SE33 was one of the STR markers that had been coamplified by Forenseq™ Signature Prep Kit (Verogen) but were not analyzed and illustrated in the Universal Analysis Software (UAS) (Verogen). This study reported an ambiguous sequence-based allele 16.3 of the SE33 locus. This allele was observed while analyzed by STRait Razor 3.0. The configuration file was modified from the previous studies to include 15 bp of 5′ flanking region and 24 bp of 3′ flanking region. The ambiguous allele was called 16.3 (106 bp) with a read count of 2070. However, the sequence of the repeat region cannot be designated as allele 16.3. Several possible scenarios for allele designation were presented and discussed. 相似文献
