思维方法的实践性是指从思维方法的实践指导作用角度研究思维方法。将思维方法仅仅作为认识方法研究,虽然有着历史的必然性、合理性,但已不适应时代发展和哲学研究方向变革的要求,也不利于思维方法自身发展和完善的需要。相对于思维方法的认识功能研究,思维方法的实践性研究具有更强的综合性特点,因而研究思维方法的实践性既是必要的又是艰巨的、它应是当前思维方法研究的首要任务。

Identities in reconstruction: from rights of recognition to reflection in post-disaster reconstruction processes

This article examines the role of rights in both governing and shaping women’s relationship with the reconstruction process and their position in the reconstructed society. Through four years of empirical research in the post-earthquake reconstruction process in Maharashtra, India, this article focuses upon how women’s rights in social reconstruction are contingent upon processes of recognition. From the United Nations to local women’s organising, the article considers how women’s rights to “determine the pattern of their lives and the future of society” (United Nations Convention on the Elimination of All Forms of Discrimination Against Women (C.E.D.A.W.). General Recommendation No. 23 (1997), Article 7, para. 9.) are dependent upon processes of recognition. Through a critique of cultural, material and spatial acts and frameworks of recognition within the U.N., World Bank, State Government, public interest litigation, personal and nonformal law, rights are seen to actively and hierarchically construct either a modern, liberal subject or a religious, communitarian subject, which both either deny or prescribe agency. The experience of women’s organising reveals the possibility of reconstructing a feminist rights strategy of reflection.

学术批评认识中的四个误区

当前学术界存在严重的学术腐败现象,亟须进行严肃的学术批评。但对学术批评,人们却在认识上存在四个误区:一是认为学术成果不具有学术性;二是认为学术批评者是为了追名逐利;三是认为搞学术批评是别有用心;四是认为只有“圣人”或“神”才有资格做学术批评。结果,在学术批评上出现了所谓“沉默的大多数”。学术界真正的希望不在于他们,而在于那些勇于捅破学术“溃疡”的人们。     

起查中运用辨认措施存在的问题及其对策

尽管辨认在我国侦查实践中发挥着重要的作用，但现实中仍然暴露出实施辨认的条件把握不严，辨认前的询问和告知程序被忽略，主持辨认的侦查人员数量和身份不合法，混杂辨认对象的数量混乱，且陪衬对象的选择过于随意等问题，为了更好地发挥辨认在侦查中的作用，建议进一步加强对辨认的立法，完善辨认规则，制定科学合理的辨认操作程序，加强对辩认的监督和完善对辨认结论的审查判断机制。

我国承认与执行外国仲裁裁决的程序性规范零散，缺乏系统性及基本原则的统帅及指导，导致司法实践程序问题多多。因此，应当确立相应的法律基本原则，参照民事诉讼程序建立审查法律制度，以完善我国承认与执行外国仲裁裁决的程序法。     

Two principles of equal language recognition

Within the umbrella of equal recognition, several principles of linguistic justice can be distinguished. A first, the per-capita principle, mandates prorating language recognition based on a per-capita distribution. A second, the equal-services principle, prescribes upholding the official languages as the languages in which the state speaks and in which public services are provided, irrespective of changing numbers of speakers. Alan Patten defends the prorated per-capita principle. I argue for the equal-services principle, which practically will often amount to a form of linguistic maximin: the more vulnerable the language, the more numerous the resources.
