无正本提单交付货物的中英法律解读

无正本提单交付货物一直是困扰国际海上货物运输的主要问题之一。应该说,自从提单这一运输单证诞生并开始肩负作为交付货物凭证的功能时起,无单放货就伴随其产生了。从承运人的角度来说,最关心的莫过于如何认定无单放货的形式和性质以及因承担无单放货而产生的责任;从正本提单持有人的角度来说,在承运人无单放货的情况下如何行使索赔权则是其关注的核心。为了解决中国海事司法审判实践中出现的有关无正本提单交付货物纠纷的法律适用方面的问题,最高人民法院在2009年3月5日出台了《最高人民法院关于审理无正本提单交付货物案件适用法律若干问题的规定》,由于在起草过程中大量借鉴了国外海事审判经验,而英国又是海事审判最先进的国家之一,积累了大量有关无单放货的判例,因此有必要通过这些案例来对该规定的主要内容进行解读,以便对相关内容进行更好的理解和把握。     

和谐社会视域下的农村政治文化建设

农村政治文化建设是新农村建设的内在要求。当前,宗族观念盛行、民主法制观念淡薄、政治参与意识淡薄等因素制约着农村政治文化的发展。发展农村政治文化,应进在促进农村经济发展的基础上,加强相应制度建设,加强对农民的政治教育,并拓展农民政治参与的渠道,引导其积极参与民主政治的实践。     

重复热应激致公兔性腺氧化损伤的研究

为探讨热应激对雄性兔性腺的氧化损伤机制,以体重相近的110日龄雄性新西兰兔为研究对象,每天在固定时间分别以31～34℃和38～40℃进行热应激,并分别在热应激后的第15、30、45及60天处死兔,取样检测性腺组织内总抗氧化酶活性、丙二醛及蛋白质羰基含量。结果显示,随着温度升高,睾丸和附睾组织丙二醛含量增加,总抗氧化酶活性降低,蛋白质羰基含量呈上升趋势,表现出明显的温度-时间效应。表明高热可改变兔睾丸和附睾的正常生理机能,使自由基在组织内累积,引起蛋白质氧化损伤,进而降低繁殖机能。     

Party Politics and Governance in Grenada: An Analysis of the New National Party (1984–2012)

Abstract

This article examines party politics and governance in post-revolutionary Grenada, using the case of the New National Party (NNP). The central question is what does the evolution of the NNP suggests about governance and democracy in post-invasion Grenada? The article traces four phases of the NNP since its formation in 1984: (1) externally imposed marriage of convenience; (2) intra-party conflict and splintering; (3) rebranding, consolidation and dominance; and (4) electoral defeat. The article contends that Grenada has transitioned to formal democracy and the NNP is a significant actor. Yet, despite this transition, Grenada has not become the showcase of democracy that the US said it would in 1984.     

Continuing Revolt of the Urban Chinese Voters: The Case of Kepong

Abstract

Since the 2008 Malaysian general election the Chinese vote has swung overwhelmingly to the opposition, and this trend has continued in the 2013 general election. When announcing the results of the 2013 general election, Prime Minister Najib labelled it as a ‘Chinese tsunami’. Taking the case of Kepong, this article attempts to explain the reasons for the urban Chinese voters’ continuing support for the Democratic Action Party.     

Expectations from Administrative Reforms: An Attempt to Implement the Balanced Scorecard in a Public Sector Organization

The aim of this case study is to explore what actors in a Swedish municipality expect from a new administrative reform (i.e., an attempt to implement the Balanced Scorecard). The findings show that the expectations on changes are highest among the politicians, moderate among the administrators, and lowest among the operative employees. The differences can be explained by the way the reform is anticipated to favor or disfavor the actors, who in turn are influenced by the actors' past experiences. Most of the expressed expectations concern expectations of the outcome of the administrative reform, but some concern expectations on the reform itself.

新型农村社区建设是城乡一体化发展的迫切需要,是国家农村发展战略转变的现实要求,有利于促进城乡公共服务均等化,是构建社会主义和谐社会的重要基础。近年来,邓州市在新型农村社区建设中取得了显著成绩,但同时也存在土地利用遭遇政策瓶颈、资金来源渠道狭窄、农村居民思想认识不足、管理体制不完善等问题。为了推进邓州市新型农村社区建设,必须坚持规划先行,节约集约利用土地资源;建立多元化投入机制;提高农村居民素质,促进其生产生活方式的转变;创新体制机制,不断提高社区管理服务水平。     

德国社会救助法律制度及其启示——兼论我国行政法学研究领域的拓展

德国社会救助制度作为一项重要的社会保障制度对保障人权、维护人的尊严发挥了重要作用。其历史发展、改革背景、宪法依据和具体制度规定对我国正确认识和定位社会救助、建构适合我国国情的社会救助制度都具有一定的借鉴和启发意义。加强对社会救助法律制度的研究,有助于拓宽我国行政法学的研究范围和视野,有利于在社会管理创新的背景下,建构"回应型"的"新行政法"。     

Marie Corelli's British new woman: A threat to empire?

At the height of the British Empire, England was in the midst of major social, economic and moral upheaval. The roles and status of middle-class women were particularly affected by many of these changes. In turn, as the gap between idealism and ‘reality’ grew, the validity or usefulness of Victorian notions or ideals of womanhood increasingly came under attack. Arising from this commotion was the figure of the late Victorian and Edwardian ‘New Woman.’ Her appearance provoked further confusion and ambiguity about gender that had repercussions for empire. This paper addresses the way in which the role of English women in sustaining the British Empire intensified the social pressures on them in the metropole. It examines the threat to nation and empire represented by the New Woman by looking at how she was presented to the rapidly growing general reading public at the end of the nineteenth- and beginning of the twentieth century. This is achieved by looking at the bestselling novels of Marie Corelli, a phenomenally popular turn-of-the-century author. Corelli's novels repeatedly affirm that the New Woman represented the threat of ‘modernity,’ that she was a danger to ‘civilisation’ and therefore to British imperialism.     

New economy housing markets: Fast and furious—but different?

Abstract

This article explores the effects of metropolitan industrial structure on housing market outcomes. Housing prices in new economy metropolitan areas are found to be higher, peakier, and more volatile than in old economy markets. Homeownership rates are found to be lower in new economy metropolitan areas, while crowding is higher. Although the distribution of housing values, costs, and rents was more equal in new economy markets, the cause would seem to be differences in area income levels, with poorer metropolitan statistical areas having greater inequalities.

Regression analysis is used to identify the contribution of traditional supply and demand factors, such as job growth, income, and residential construction, as well as new economy indicators, to housing market outcomes. Rather than being fundamentally different, new economy housing markets are found to be faster and more extreme versions of traditional housing markets.
