论网络时代通讯自由的性质

各国宪法对通讯自由的权利性质有不同的规定 ,这反映了各国立宪者制宪思想的不同。通讯自由权利的实现程度和宪政价值直接受到通讯载体的发展变化的影响。在网络信息时代 ,通讯自由与公民的隐私权、自由表达权、知情权、财产权 ,及国家安全、公共权力和公共利益等密切联系和融合。该权利的性质已不能简单地界定为人身权利或者表达自由权利     

全国人大常委会的代表性探讨

人民代表机关应该而且必须具有代表性,即必须经过专用程序和方式代表人民的意愿和利益。代表性是人民代表机关的根本属性。人民代表机关只有具有代表性,才能保障自身的民主性质。只有人民代表机关具有代表性,整个政权体系才具有民主根基。全国人大常委会的代表性还很欠缺。缺乏代表性使全国人大常委会的民意代表机关的真实性成为问题;这又不能不影响全国人大常委会行使职权的正当性。应从选举环节和沟通环节增强全国人大常委会的代表性。     

我国信息网络传播权与传统著作权之比较

网络传播权与传输权本不相同 ;信息网络传播权与传统著作权及邻接权也有较多差别 ,应该廓清其间的界限 ,并甄别其保护措施 ,以期正确认识信息网络传播权 ,并加以法律规范 ,平衡作者、传播者和公众的利益     

通讯监控立法之比较——基于反恐的视角

通讯监控因其搜集反恐情报、预警恐怖活动、获取与保全恐怖犯罪证据的功能,成为各国反恐立法与实践的一把"利器"。这项措施在发挥其反恐最大效能的同时,也隐藏着对公民通信自由权和隐私权等利益的巨大威胁,因此各国立法均对其进行立法规制。我国立法对通讯监控规定还较为粗疏,为我国立法建言,有必要通过比较分析对国外通讯监控立法进行研究,从中获得启示。     

Indian Copyright Act and new communication technologies: A special focus on webcasting

The main aim of this paper is to consider whether the Indian Copyright Act 1957 (ICA) gives protection to future technologies. It follows an earlier paper on Webcaster's protection under copyright published in [2011] 27 CLSR 479–496. By way of asking that question it is sensible to examine whether webcasting/streaming is protected by ICA or not. In order to enquire the same, we need to study the penetration of streaming/webcasting technology into the Indian market and its application. Since the technology is linked with the Internet, it is also essential to examine its penetration and the availability of bandwidth and the potential market for such communications. All these aspects are studied in the first part of this paper. In the second part a brief outline is offered of the relevant provisions of the Act. At issue is whether they give protection to the future technologies or not. This will be considered in part three. The same will be examined with the proposed amendment to the Act too. The paper concludes that the Act fails to give protection to future technologies and therefore that streaming/webcasting is not protected in India under the copyright regime.

英德警务的新公共管理改革对我国的启示

在席卷欧洲行政改革的新公共管理浪潮中,英德两国的警务部门并未如外界所想象的那样按照既定模式进行改革。英国警务部门采取了对抗策略保存了原有的大部分组织制度与文化。德国警务部门则采取能动改革主义,逐步地修正新公共管理思想,最终抵御了改革的全面冲击。从两国警务改革的经验来看,我国警务改革应该改变“警务易改”的观念,建立改革的能动机制、长效机制、沟通机制,并科学地选择并适用西方理论。     

Mother-Adolescent Health Communication: Are All Conversations Created Equally?

Fifty-two mother-adolescent dyads (mean adolescent age = 16.3) participated in an observational study of communication about health topics. The aim of the study was to examine mother-adolescent conversations about health issues—drugs/alcohol, sexuality, nutrition/exercise—to determine the extent to which the mothers treat these issues similarly. Across conversations, mothers spent more time asking questions than lecturing or discussing negative consequences. Mothers discussed negative consequences less in the nutrition/exercise and sexuality conversations than in the drug/alcohol conversation. Mothers asked fewer questions when discussing nutrition/exercise than drugs/alcohol, and lectured more in the nutrition/exercise conversation than in the sexuality conversation. The results of this study have implications for intervention programmers advocating in the media that parents “talk to your kids” about these health issues. Tanya L. Her major research interests include adolescent risk behaviors and the influences on such behaviors, with a focus on family influences. Eva S. Lefkowitz is an Associate Professor of Human Development and Family Studies at The Pennsylvania State University. She received her Ph.D. in 1998 from the University of California, Los Angeles. Her major research interests include the development of attitudes, behaviors, and relationships during adolescence and emerging adulthood.
