从海权的角度分析俄苏的兴衰是一个尚未有人进行充分探讨的问题。在数百年的争夺中 ,海权的扩张固然构成了俄苏崛起的一个因素 ,但从长远的角度看 ,对海权的过度追求又构成了俄苏走向衰落的根源之一。具体说来 ,从俄苏海权扩张西进、南下和东进 3条线路中 ,西进战略较为成功 ,并促进了俄苏的崛起 ;南下和东进战略虽有所收获 ,但都遭遇挫折 ,尤其是南下的世界扩张战略直接导致了苏联的衰落。从本质上来说 ,地缘政治条件的制约、俄苏海权过渡扩张所导致的一系列矛盾构成了俄苏海权战略失败并导致国力衰微的根源之一。  相似文献

中国南海断续线是在1933年法国占领南沙九小岛、二战后法同继续占领西沙群岛,以及菲律宾企图把南沙群岛并入其国防范围内的背景下产生的,其目的是,向世界公布中国在南海的管辖范围,维护中国在南海的领土主权.在1951年<旧金山对日和约>草案中,美英故意不提西沙群岛和南沙群岛的主权归还问题,为以后的南海领土争端埋下了祸根.在这种情况下,南海断续线起到了一定的效用,它不仅反映_r南海诸岛是在中国领土范围内的历史事实,而且是对<旧金山对日和约>领土处理的否定.  相似文献

The current focus in forensic anthropology on increasing scientific certainty in ancestry determination reinforces the need to examine the ancestry of skeletal remains used for osteology instruction. Human skeletal remains were discovered on the University of North Dakota campus in 2007. After recovery, the osteological examination resulted in a profile for a 33- to 46-year-old woman of African descent with stature ranging from 56.3 to 61.0 in. The pattern of postmortem damage indicated that the remains had been prepared for use as an anatomical teaching specimen. Review of the American history of anatomical teaching revealed a preference for Black subjects, which apparently extended to states like North Dakota despite extremely low resident populations of people of African descent. This study emphasizes the need to examine the ancestry of older teaching specimens that lack provenience, rather than assuming they are derived from typical (i.e., Indian) sources of anatomical material.  相似文献

Two‐level games models predict that domestic division within a state can alter the extent to which that state is able to reach agreements with other states, and also alter the content of any agreement that is reached. I extend the model by introducing internal side‐payments composed of unrelated domestic issues. Domestic opposition to an international agreement will inhibit cooperation most when the executive and median legislators are in relative agreement about other salient domestic political issues. Domestic opposition to an international agreement will inhibit cooperation least when the executive and median legislators are in relative disagreement about other salient domestic political issues. 斯瓦尔巴群岛又称斯匹次卑尔根群岛,是北极地区的重要岛屿。1920年的《斯匹次卑尔根群岛条约》改变了斯瓦尔巴群岛无主地的法律地位,将该岛主权赋予挪威,在群岛上确立了“主权确定,共同开发”的原则,但挪威对斯瓦尔巴群岛享有的“完全和绝对的”主权是在《斯匹次卑尔根群岛条约》规定限制下的有限主权,与传统国际法意义上主权的概念不尽相同。挪威以这种“有限”主权依据《联合国海洋法公约》规定享有专属经济区和大陆架,必将损害《斯匹次卑尔根群岛条约》设立的公平原则,未来对斯瓦尔巴群岛法律地位的争议还将长期存在。  相似文献

Abstract

This paper examines Jamaica's efforts to implement of the conservation and management provisions of the United Nations Convention on the Law of the Sea (UNCLOS), bearing in mind that prior to 1982 there was an existing legal framework that sought to address issues relating to fisheries management. More specifically, the paper looks at the issues related to the conservation and management of straddling and highly migratory fish stocks under UNCLOS and subsequent agreements negotiated under the auspices of UNCLOS. It also addresses the problems Jamaica faces with the conservation and management of Queen Conch (Strombus Gigas), in particular, the UNCLOS provisions regarding access to such resource, taking into account the limitations to such access as regulated by the Convention on the International Trade in Endangered Species of Wild Fauna and Flora (CITES).  相似文献

Abstract

As the United Nations Convention on the Law of the Sea (UNCLOS) establishes itself as one of the premier regimes in international law, member states are increasingly availing themselves of the significant dispute settlement provisions found in Part XV. The International Tribunal for the Law of the Sea (ITLOS) is beginning to take its place in the pantheon of major international tribunals. Although its jurisprudence thus far has largely consisted of applications for prompt release of vessels, these cases have arisen from disagreements over fishery practices and the enforcement of fishery laws by coastal states. The ITLOS is developing into a transparent, consistent and speedy forum to adjudicate marine disputes arising from UNCLOS. While the overall scope and reach of Part XV may be uncertain at the present time, especially vis‐à‐vis other dispute settlement institutions, the early activity under Part XV is promising. Those concerned with marine wildlife issues should be encouraged by the potential of Part XV, the ITLOS in particular, to serve as an effective regime in the realm of marine wildlife dispute settlement.  相似文献

This survey of three hundred and twenty undergraduate students attempted to determine their knowledge of crime and punishment in North Carolina. Respondents answered a series of open- and closed-ended questions regarding various legal topics, such as statutory rape and the legal ages for tobacco and alcohol use. The participants were also asked to list punishments for various offenses, such as possession of marijuana, driving while intoxicated, and rape. They were then asked to define certain legal terms such as larceny. The results indicated that most students were unable to provide correct corresponding punishments for many offenses. They were also unable to accurately define various legal terms, such as robbery or rape. The implications for stronger education in the area of criminal justice are discussed.  相似文献
