High‐conflict parental separation cases associated with child's estrangement or contact refusal take an unusually large amount of court time and generate high emotional costs for parents and children. This paper reports on a study of a research‐based pilot project and protocol, called the Parenting Conflict Resolution (PCR), which is intended to reduce parental conflict, improve interparental communication, and support or restore the parent–child relationship. The protocol was developed at the Superior Court in Quebec City (Canada), and involves single judge case management, and lawyers' commitment to have the child's best interests as their primary consideration and to guide their clients to trust the process. The assigned judge and lawyers have the ongoing involvement of a mandated psychotherapist, taking a family systems approach with the case. The PCR also requires the parents to participate in a psycho‐educational, introspective group program to work on co‐parenting and communication skills. Ongoing communication between the professionals involved in the PCR is required to ensure cohesion and accountability. This pilot project was implemented with 10 high‐conflict families, 6 of which presented with the child's resistance or refusal to see one parent. A qualitative data study was undertaken into the experiences of all the participants. The most salient result is the resumption of parent–child contact in all six contact refusal cases. Discussion highlights key elements to successfully address these cases: (a) interdisciplinary program delivery, (b) systemic understanding of the contact problems, (c) focus on the child's best interest, (d) single judge assigned to the case, (e) lawyers' support of the parents' participation, and (f) psychotherapist reporting to the court.  相似文献

There is no general consensus of how to handle disputes arising from open adoption agreements. Some states have statutes mandating mediation, but New York does not. This Note proposes that New York enact a statute that mandates adoptive and birth parents use mediation for disputes arising from open adoption agreements. The proposed statute provides a comprehensive approach to mediation by setting forth when mediation is appropriate and when it is not. The statute will also provide when the child's preference can be taken into consideration, and who will pay for mediation.  相似文献

为进一步深化警民和谐关系的构建,公安部于年初部署了"开门评警"活动。"开门评警"活动是在"大走访"基础上的深化,是把群众对公安工作的满意度、对民警工作的满意度的评判权真实地交给群众,将群众评价作为公安工作和民警考核的重要指标。"开门评警"活动特征突出表现在三个方面:民警走访由形式主动变为了实质主动;群众监督具体化;群众路线观念在基层民警中得到认同和加强。活动开展促使民警群众工作能力提高,进一步夯实了社区警务工作。  相似文献

I do not argue for or against substantive immigration policies in this paper. Rather, my thesis concerns what kinds of reasons are morally salient in the construction of just immigration policies. I argue that philosophical proposals for regulating immigration should be evaluated according to the following methodological principle: The unit of analysis in terms of which principles for regulating immigration must be evaluated is the socially situated individual. I defend this principle indirectly by applying it to cosmopolitan principles for regulating immigration in order to demonstrate the moral inadequacy of theories of immigration that adopt an inappropriate unit of analysis. Failure to evaluate the moral adequacy of their own substantive proposals in terms of their effects on socially situated individuals leads some cosmopolitans to endorse substantive recommendations for regulating immigration (namely, open borders) that, I argue, disproportionately burden members of institutionally disadvantaged groups.

This article argues that judicial and other institutions concerned with legal interpretation are playing an increasing role in regulating and defining the concept of national security for South Africa, particularly in the realm of national security information. Part I surveys the post-apartheid evolution of accountability of South Africa’s national security agencies with particular attention to the treatment of national security information. Starting from a low base, intelligence agencies in South Africa have become more accountable, in part through the greater degree of access to national security information. Part II portrays the placement of access to national security information within South Africa’s legislative framework, taking into account the keys laws underpinning both secrecy and disclosure regulation. Here, with no definition of national security on the secrecy side, it is on the disclosure side of South Africa’s legislative framework that the judiciary and other legal actors are crafting an operative definition of national security. Part III covers three recent developments, arguing that they demonstrate the increasingly important regulatory role played by the judiciary and other legal institutions. These include two key Constitutional Court decisions and an ongoing legislative reform effort.  相似文献

政府信息公开是我国推行服务型政府的重要环节,自推行以来,取得了明显成效,但也存在诸多问题。以向国家发改委和南京市政府申请信息公开的实践为案例,通过分析比较,中央部委比地方更为高效和主动,其公开文件更新频繁,地方政府的公开则略显形式化,应当及时改进,并在此基础上提出相应的对策如下:完善信息公开的法律体系;政府部门应转变行政理念;增加信息公开的形式,保证公开渠道畅通;健全监督机制。  相似文献

改革开放以来,福建省在坚持中央侨捐政策的同时,也因地制宜地制订了一些相关的条例法规。有关部门并以合理引导侨捐流向、做好侨捐表彰工作、进行侨捐项目数据库建设、认真整改等手段,推进侨捐政策的落实,实践中并已初显成效。但与此同时,在落实过程中也存在着观念滞后、监管不力等问题,并因此而影响到福建省侨捐事业的顺利发展和海内外同胞关系的和谐,需要加以纠正。  相似文献
